Slap on the wrist? No jail time for Hawaii fireworks offenders

HONOLULU (KHON2) — Is it a step in the right direction or a slap on the wrist?
That is the question after two men pled no contest relating to illegal fireworks charges and received no jail time. Some told KHON2 that it sends the wrong message after a deadly New Year's Day on Oahu.

The Department of the Attorney General said Wolfgang Clark and Daniel Young were accused of selling illegal fireworks in 2024. The AG's office said both men were recently granted a deferred plea despite the state's objection.
The men will receive four years of court supervision, a $5,000 fine and no jail time.
'The biggest term that usually happens during this period is that they can't commit another crime and they certainly can't commit the same crime again during this time. If they do, then this deferral goes away and it automatically becomes a conviction,' said legal expert Doug Chin.

A former judge said courts have given the accused a chance to expunge the charges from their record if they stay out of trouble for their court supervision period by deferring a conviction.
'So what's the consequences now by giving a deferral? At the end of the four year period, it gets wiped out,' said former judge Randal Lee. 'Like if it never happened.'
Lawmakers said current legislation increases penalties that would have impacted this case if they had been law.

'My feeling is that if we're going to get a handle on it, the penalties are going to have to be a little harsher because typically, the real deterrent is thinking you're going to get caught,' said Senate Judiciary Committee Chair Sen. Karl Rhoads.
Rhoads pointed out that illegal fireworks cases have rarely even made it to prosecution in Hawaii in the past, and he is a little disappointed in the light punishment but said the process itself is a step in the right direction.
'Whether you spend any time in jail, having to pay a fine and having to be monitored for I think it was four years, that does not do you any good,' Sen. Rhoads said.
'It moved in the right direction, but then by granting a deferral is basically saying it never happened,' Lee said. 'It's kind of like getting into the concert, but then you can't hear anything.'

PETERSBURG, Fla. - More than a month after an Allegiant Airlines flight attendant found a bomb threat just before taking off from St. Pete-Clearwater International Airport, the FBI is continuing to search for the person responsible. The FBI's Tampa Field Office released a photo of the bomb threat, which was found written on a lavatory door on an Allegiant Airlines flight on April 25. It comes as they seek the public's assistance in finding the person who wrote it. But as the plane was taxiing from the gate just before departing, a flight attendant found the message on the lavatory door. The pilot, then, immediately stopped the plane and helped work to evacuate passengers, authorities said. The passengers were quickly deplaned, and the Pinellas County Sheriff's Office swarmed the airport and spent hours that night searching multiple flights for anything suspicious. Officials said at the time, nothing was found. The Brief An Illinois woman is charged with child abuse, and prosecutors say she tried to stage an accident to cover up the abuse. 26-year-old Nour Al Thafiri was arrested on Tuesday, June 3, after a weeks-long investigation by Kenosha police. Her bond was set at $10,000. KENOSHA, Wis. - Kenosha prosecutors charged a daycare worker with child abuse, saying she staged an accident. That woman was in court on Thursday, June 5, 2025. 26-year-old Nour Al Thafiri is from Waukegan, Illinois. Prosecutors say this goes back to April when a Kenosha family reported their two-year-old came home with bruising that looked like finger marks. To find bruising on the boy's upper arm, shoulders and back. "The allegation is that my client grabbed this child too tightly and left some bruises," said defense attorney Carl Johnson. Prosecutors charged 26-year-old Nour Al Thafiri with child abuse. Investigators say the daycare told the child's parents his head got stuck under a cabinet while playing with a ball. Prosecutors say the injuries tell a different story. "Showed a video of the defendant knocking a stuffed animal away from the child victim. The defendant responded 'he don't want it anymore,'" said Kenosha County District Attorney Xavier Solis. Investigators say they looked at the daycare's video surveillance, showing Al Thafiri grabbing the boy by his arms multiple times and, at one point, putting a blanket over him, covering his head. Then, prosecutors say, the video shows her "examining the child's upper right arm and upper back." Ten minutes later, prosecutors say Al Thafiri rolled a ball under the cabinet, to play "fetch." Prosecutors believe that she quote "staged a ball-rolling incident to explain the injuries in a way that could avoid consequences." The defense says the 15-page complaint took him a couple of reads to figure out the alleged abuse. "This is not a case where there are allegations of punching or kicking a child, striking a child," added Johnson. Al Thafiri's bond was set at $10,000.
