HC orders framing of charges against advocate and ex-BJP minister in contempt case

Shimla, June 27 (UNI) The Himachal Pradesh High Court has rejected the apology tendered by counsel Dhairya Sushant and his father, former BJP minister Rajan Sushant, for allegedly making scandalous allegations against sitting judges on social media. The court has directed that charges be framed against both on July 16 in a suo motu contempt petition.
The division bench of Justice Tarlok Singh Chauhan and Justice Sushil Kukreja ruled yesterday that the apology submitted by the respondents lacked sincerity, repentance, or remorse, and appeared to be a tactical move to escape legal consequences.
The case arose from a video posted by Dhairya Sushant on Facebook earlier this year, in which he accused a sitting High Court judge of favoritism and being part of a nexus involving drug dealers, lawyers, and judicial officers.
In the video, he claimed that justice was being delivered on the basis of face value and that the court had failed to act against criminals despite strong evidence.
The court found that both the advocate and his father, Rajan Sushant, had prima facie committed criminal contempt by tarnishing the image of the judiciary and undermining public confidence in the justice system.
Rejecting their last-minute apology submitted through counsel, the bench observed: 'We are convinced that it is a device adopted by the respondents to escape the rigours of the law… There has been no genuine remorse or repentance.'
The High Court said that the apology was nothing more than a 'paper apology' and said it could not be accepted without compromising the dignity of the judiciary. The matter will now be taken up on July 16 for framing of charges.

COIMBATORE: The operation of unauthorised bars near Tasmac outlets has tied the hands of employees, as they are unable to affix the hologram sticker, which is necessary for the liquor bottle buy-back scheme, implemented by Tasmac after a Madras High Court direction. Sources said almost two-thirds of the 286 bars attached with outlets in the district have been functioning out of contract. A Tasmac outlet supervisor attached to Coimbatore South, who did not wish to be named, said, "Bar contractors can take the bottles to the bar and store them and sell it to anyone. As unauthorised bars cannot store and sell bottles, those should be maintained by employees and handed over to the firm which has got the contract. As most bars attached to outlets in the district are operating without renewing their contract, bottles are not be stored in the bars. That makes employees refrain from sticking the Rs 10 hologram." "Despite not pasting stickers and collecting empty bottles, supervisors of the shops are required to pay Rs 3 per bottle to the contractor, who is supposed to collect empty bottles. Without performing their duty, the private firm receives money from Tasmac, which is borne by employees of the outlets," he added. Officials contact the supervisors and instruct them to clear the total amount, which would come into lakhs each month, leaving the salespersons with no choice, other than to collect an extra of Rs 10 per bottle from customers, he further said. A John, the secretary of Tasmac employees union affiliated to CITU said, "The buy-back system was implemented to prevent disposal of empty bottles in open areas as per the High Court's order. However, the system is not followed in outlets due to structural level failure in the administration. Without correction of flaws, the buy-back system would not attain its objective and salespersons and customers will have to bear the brunt." Speaking to TNIE, R Govindharasu, senior Regional Manager of Tasmac, Coimbatore said, "The buy-back system was implemented partially in the district. We have instructed the employees to follow the norm. I will also look into the matter."

KOZHIKODE: The education department's decision to introduce zumba sessions in school curriculum to fight drug menace is now at the centre of controversy, with more Muslim organisations coming out opposing the move. After Wisdom Islamic Organisation, the Sunni Yuvajana Sangham (SYS) has also criticised the decision, alleging that it violates moral norms. However, opposition to the initiative — intended to promote the physical and mental well-being of students and teachers — has invited sharp criticism from various corners. Such opposition will take society backwards, social activists said. The first objection was raised by Wisdom Islamic Organisation general secretary T K Ashraf in a Facebook post on Thursday. Ashraf, a school teacher from Palakkad, told TNIE that neither he nor his children took part in the zumba sessions arranged at the school as part of International Day against Drug Abuse. 'I send my child to a public school for quality education — not to promote a culture where boys and girls mingle, wear short clothes, and dance to music,' he said. By Friday, more leaders echoed similar sentiments. Abdussamad Pookkottur, state secretary of Sunni Yuvajana Sangham (SYS), the youth organisation of the Samastha Kerala Jem-iyyathul Ulama, labelled zumba harmful to moral values and urged parents to respond critically. Another SYS leader, Nazar Faizy Koodathai, also argued that group dancing in 'vulgar' attire is objectionable, especially in the case of older students. 'Zumba goes against Indian moral values. From what I understand, it involves students wearing tight clothes and dancing together. This cannot be tolerated. The government should have consulted student organisations before taking such a decision,' he told TNIE. However, the criticism was swiftly countered by social activists and LDF leaders. Progressive Women's Forum president V P Zuhra accused leaders of Muslim organisations of trying to steer Kerala towards Taliban-style conservatism. 'How can a teacher like Ashraf say boys and girls should not be together? Their aim is to pull the youth backwards. The youth must resist this,' Suhara said.

The high court had taken a suo motu notice after a video was uploaded on Facebook, levelling allegations against the judicial system. (Getty Images/iStockphoto) 'We are sorry to say we cannot subscribe to the 'slap, say sorry and forget' school of thought in the administration of contempt jurisprudence… Saying sorry does not make the slapper poorer, nor does the cheek which has taken the slap smart less upon the said hypocritical word,' said the division bench comprising Justice Tarlok Singh Chauhan and Justice Sushil Kukreja while referring to Supreme Court judgements refusing to accept the apology. 'Apology tendered herein is nothing but a paper apology, which in the given facts and circumstances cannot be accepted. Had the respondents been sincere and honest, they they would have made all endeavour to have apologised at the earliest given opportunity. Therefore, the apology cannot be accepted,' the court said in its 21-page order. 'An apology can be accepted in case the conduct for which the apology is given is such that it can be ignored without compromising the dignity of the court, or it is intended to be evidence of real contrition. It should be sincere. Apology cannot be accepted in case it is hollow, more especially, when there is no regret and repentance,' ruled the court while listing the matter for July 16 for framing of charges. Both Rajan and Dhairya have been directed to personally remain present before high court.
