
Have publicly pledged to refuse post-retirement jobs: CJI BR Gavai
Chief Justice of India BR Gavai has said that he and his colleagues in the Supreme Court have publicly pledged to not undermine the public's trust in judicial integrity by accepting post-retirement roles or positions from the government.
Speaking at a round table in the U.K. Supreme Court, Chief Justice Gavai said a judge contesting elections for political office immediately after retirement or resignation could lead to doubts about the independence and impartiality of the judiciary, 'as it may be seen as a conflict of interest or as an attempt to gain favour with the government'.
'If a judge takes up another appointment with the government immediately after retirement, or resigns from the Bench to contest elections, it raises significant ethical concerns and invites public scrutiny… The timing and nature of such post-retirement engagements could undermine the public's trust in the judiciary's integrity, as it could create a perception that judicial decisions were influenced by the prospect of future government appointments or political involvement,' Chief Justice Gavai said during a discussion on 'Maintaining Judicial Legitimacy and Public Confidence'.
The Chief Justice referred to the striking down of the National Judicial Appointments Commission in 2015 as a counter-action to government's efforts to dilute judicial independence, saying 'there may be criticisms of the Collegium system, but any solution must not come at the cost of judicial independence. Judges must be free from external control'.
'Judiciary acts as a counterbalance against the arbitrary exercise of power… Certain fundamental principles, such as democracy, rule of law, and the separation of powers, are inviolable and cannot be altered,' the CJI said.
Chief Justice Gavai acknowledged the recent incidents of corruption in judiciary but said the path to handling judicial misdemeanour and re-build the path to public trust was 'swift, decisive, and transparent action'.
'In India, when such instances have come to light, the Supreme Court has consistently taken immediate and appropriate measures to address the misconduct,' the CJI said even as the Parliament is expected to bring a removal motion against High Court judge, Justice Yashwant Varma.
The Chief Justice also referred to the voluntary disclosure of assets by the judges of the Supreme Court to promote greater accountability and ethical leadership, live streaming of court proceedings, real-time information on case pendency offered on the National Judicial Data Grid, translation of apex court judgments to regional languages and broader access to justice for vulnerable communities through the public interest litigation system.
'Article 32, which guarantees all citizens the fundamental right to approach the Supreme Court, has been referred to as the 'soul' and 'heart' of the Constitution,' the CJI noted.
Chief Justice Gavai highlighted the importance of courts having an independent power of judicial review while examining the constitutionality of laws. The court is currently seized of a challenge to the amendments to the waqf law.
'Courts must have the power of independent judicial review, allowing judges to assess the constitutionality of laws and government actions that conflict with the provisions of the Constitution or established constitutional principles,' the CJI said.

Supreme Court Leaves Intact Ban on High-Capacity Gun Magazines
(Bloomberg) -- The US Supreme Court turned away a fresh gun-rights appeal, refusing to question the District of Columbia's ban on large-capacity ammunition-feeding devices. The justices on Friday rejected arguments from four firearms owners who said the ban violates the gun-rights protections in the Constitution's Second Amendment. On June 2, the high court rejected a similar appeal in a Rhode Island case along with a challenge to a Maryland ban on so-called assault weapons. In each case, the court fell one vote short of the four required to take up a new case. In addition to DC, 14 states outlaw high-capacity ammunition-feeding devices, according to Giffords Law Center, an interest group that supports gun restrictions. The DC law makes it a felony to possess gun magazines that can hold more than 10 rounds. It was enacted in the aftermath of the Supreme Court's landmark 2008 decision striking down the district's handgun ban and for the first time saying the Constitution protects individual gun rights. A federal trial judge and then an appeals court upheld the DC restrictions. Gun-rights advocates who sued to block the DC measure sought to extend the 2022 Supreme Court decision that declared a constitutional right to carry a firearm and established a tough new test for assessing restrictions. The challengers said Americans possess hundreds of millions of large-capacity magazines, many of them for self-defense purposes. Supporters of the bans say the devices have been repeatedly used in mass shootings. The law was backed at the lower court level by Everytown for Gun Safety, an advocacy group founded and backed by Michael Bloomberg, founder and majority owner of Bloomberg News parent company Bloomberg LP. Assamese web series spotlights NRC ‘scam'
GUWAHATI Sixteen years after a petition in the Supreme Court led to the exercise to update Assam's list of citizens, the National Register of Citizens (NRC) is back in the form of entertainment. The trailer of Scam 2019, an Assamese web series based on alleged financial irregularities in the Supreme Court-monitored updating process that cost the government more than ₹1,600 crore, was released on Friday (June 6, 2025). Aabhijeet Sharma, the producer and story writer of the web series, did the honours along with others involved with it. As the head of Assam Public Works, an NGO, he was the key person behind the 2009 petition in the Supreme Court seeking a mechanism to weed out '41 lakh illegal immigrants' from the State. The NRC process began in 2013, with retired bureaucrat Prateek Hajela as its State Coordinator. The complete draft of the NRC, published in August 2019, excluded 19.06 lakh people out of 3.3 crore applicants for lack of documents to prove their citizenship. Mr Sharma insisted Scam 2019 is a fictional account of a corrupt officer, who becomes involved in a massive scam when entrusted with the responsibility to preserve the identity and culture of Assam's indigenous communities. 'This scam not only leads to financial loss, but also triggers a multi-faceted crisis affecting the State's physical, emotional, and cultural fabric,' he said. Hitesh Dev Sarma, who succeeded Mr Hajela as the State NRC Coordinator, said the exercise was fraught with corruption, involving kickbacks and money laundering. He also accused his predecessor of fraudulently including the names of suspected foreigners in the updated NRC. The trailer, however, indicates it is closer to reality than fiction. One of the main characters, played by popular actor Jatin Bora, is based on Mr Sharma and his activism. The web series will stream on Red Cinemas 18+, an OTT platform with multilingual subtitles targeting regional and international audiences. Apart from Mr Bora, the cast includes Bibhuti Bhushan Hazarika, Maytrayee Goswami, Manik Roy, Yankee Parasar, Bhabesh Das, Arsana Pujari, and R.K., who is also the director of the web series. Bhaskar Deka has penned the screenplay and dialogues, while Bitul Das has handled the cinematography, Jhulan Krishna Mahanta the editing, and Rideep Das the music.
