
DPP appeals sentence for serial offending ex-GAA star for driving over cyclist
A serial offending ex-Donegal GAA star who was banned from driving when he broke a red light and ran over a cyclist, causing injuries so severe she had to be placed into an induced coma, was released from an open prison after spending just nine months of his 21-month sentence in custody, the Court of Appeal has heard.
Kevin McMenamin, 42, must now wait to hear whether his sentence for dangerous driving causing serious bodily harm will be increased on foot of an appeal by the Director of Public Prosecutions (DPP). The maximum sentence for the offence is 10 years.
The State argued on Tuesday that McMenamin, who has 33 previous convictions, including those for drink driving and driving without insurance, is "someone who drives with disregard for the rights of other road users'.
The sentencing court previously heard that McMenamin, from Church Town, Letterkenny, Co Donegal, was an "extremely talented athlete" who represented his county for three years in the national league and had trials for Aston Villa and Celtic.
McMenamin pleaded guilty at Dublin Circuit Criminal Court to dangerous driving causing serious bodily harm at the junction of Herbert Park Road and Morehampton Road in Ballsbridge. On January 19, 2024, he was sentenced by Judge Martin Nolan to 21 months in prison and was disqualified from driving for five years.
The sentencing hearing was told that on July 22, 2021, McMenamin broke a red light in Dublin 4 and made a sudden turn, colliding with a cyclist in her late sixties. He was disqualified from driving at the time.
The woman was trapped between the two sets of wheels on the truck and dragged for two metres before surrounding motorists alerted the truck-driver by sounding their horns. She spent nearly five months in hospital and underwent major surgery for her injuries, which included a broken pelvis and severe leg trauma.
The Court of Appeal heard on Tuesday that McMenamin was moved to an open prison after less than two months incarceration and was released from custody in October 2024 after applying for enhanced remission.
The former GAA star has 33 previous convictions, including numerous road traffic offences such as drink driving and driving without insurance. He was disqualified from driving for five years in March 2018 by Kilkenny District Court.
Appealing against the leniency of the 21-month sentence at the three-judge Court of Appeal, Jane Horgan-Jones BL, for the DPP, said the maximum custodial sentence available in respect of this offence was ten years.
'It was dealt with at sentence as a case which was firmly in the lower range,' she said. 'That, in my submission having considered all the factors, led the court into error.'
She said McMenamin broke a red light when making a turn, failed to indicate whilst driving a heavy articulated vehicle in a built-up, residential area and failed to notice the cyclist.
Ms Horgan-Jones said all of these factors fed into the serious nature of the incident and submitted this brought it out of the lower end of the range of sentences available for offending of this type.
'This is an individual who is disqualified from driving and has elected to drive commercially for money,' she said.
The judge had characterised the incident as 'a momentary lapse' in concentration, the barrister said, going on to suggest that this assessment was incorrect given the 'series of errors' that led to the accident taking place.
She highlighted the fact that the five-year driving ban imposed was just one year above the mandatory minimum disqualification of four years for an offence of this type.
Ms Horgan-Jones said the judge had identified driving whilst disqualified as the sole aggravating factor in the case.
She pointed to McMenamin's previous convictions for road traffic offences and argued these would have been an aggravating factor in the case even if the respondent had not been disqualified at the time.
'He is someone who drives with disregard for the rights of other road users,' she said, adding McMenamin has numerous previous convictions, including eight for driving without insurance and two for drink driving.
Ms Horgan-Jones also suggested the discount given for mitigating factors in the case, including McMenamin's plea of guilty and work history, were 'simply too generous'.
Oisin Clarke BL, representing McMenamin, argued the 21-month sentence did not represent an error and noted there were cases with worse aggravating features where lower or similar sentences were imposed.
'One could not say that this is of such divergence that it would require this court to intervene,' he said.
The barrister went on to note that the decision to turn 'was made in a second' and was a 'momentary lapse in judgement'. There was a line of traffic so it was 'highly unlikely' McMenamin was going at speed at the time, he said.
Mr Clarke said he could not get away from McMenamin's history of road traffic offending and the fact he was disqualified from driving at the time. However, he said these factors were referenced by the judge when imposing sentence.
'The disqualification is a year more than the mandatory, so it was something the court took into consideration,' he said, adding a five-year driving ban for someone who drives for a living was 'a significant amount of time'.
Mr Justice Patrick McCarthy said the court would reserve judgement in the case and deliver its decision on May 9, directing that McMenamin attend in person on that date.
A prosecuting Garda told McMenamin's sentencing hearing that the female cyclist was travelling home from town through Ballsbridge that afternoon when she noticed a large truck bouncing over speed bumps and going very fast.
She approached the lights on Herbert Park Road, intending to go straight through the junction and was confident that she would get through the lights before they changed from amber to red.
At the same time, witnesses described seeing the truck accelerating quickly and driving at an inappropriate speed along Herbert Park Road, before making a sudden left turn down Morehampton Road just after the lights turned red. Witnesses said the truck did not indicate before turning left.The cyclist was just ahead of the truck and was hit by the vehicle and trapped between its two sets of wheels.

Presenter Roz Purcell said she hopes potential new leads generated by her podcast on one of the country's most notorious murders will finally bring about justice for the family of Elizabeth Plunkett. It comes as Elizabeth's family have written to the DPP, Garda Commissioner Drew Harris and Justice Minister Jim O'Callaghan requesting a cold-case review into her death and a renewed public appeal for evidence. Englishmen John Shaw and Geoffrey Evans confessed to abducting, raping and murdering Elizabeth in Brittas Bay, Co. Wicklow, and also Mary Duffy in Connemara, Co. Galway, in 1976. Both men were initially charged with murder, rape and false imprisonment of Ms Plunkett and Ms Duffy. But when Shaw began a parole application nearly two years ago, it emerged he had never been convicted for Ms Plunkett's murder, despite previous reports. The Plunkett family are collaborating with the team at RTÉ's Documentary On One on Stolen Sister, a six-part podcast series, to raise awareness of Ms Plunkett's case, which led to an inquest being held into her death earlier this year. And Ms Purcell said the podcast team are hopeful the documentary will help the family's 'search for justice'. The model and presenter told 'We're retelling Elizabeth's life with her family. We want to do it in the right way, with the end goal of getting her family justice, and getting Elizabeth justice that she hasn't had in almost 50 years.' Geoffrey Evans died in 2012, and John Shaw remains in Arbour Hill Prison. Last week Shaw was denied parole. Members of Ms Plunkett's family were initially invited to provide impact statements to the court, but their statements were withdrawn when they were informed – for the first time – that while Shaw had been convicted of Elizabeth's rape and false imprisonment, he was never convicted of her actual murder. 'I'm doing this and Elizabeth's sisters are doing this because hopefully there's a conclusion, that we get them something, There's a mission for us, to have this case relooked at.' Documentary producer Nicoline Greer added: 'As a result of the podcast, we're getting people contacting us and saying that they were in Brittas Bay at the time. We're even getting people coming to us and saying that Shaw and Evans attempted to abduct them. 'It's unbelievable how predatory these guys seem to have been – way more so than we realised when we started this.' Because Shaw was not prosecuted for Elizabeth's murder, the case can be reopened if new evidence comes to light. 'The podcast is giving Elizabeth's story publicity and people are remembering things that happened back then that they haven't mentioned before,' Ms Greer said. When Evans and Shaw were arrested, the killers admitted their goal was to abduct, rape and murder one woman a week. 'They were always looking for women to abduct. They knew they were going to be caught… they just didn't care. They were doing what they wanted,' said Ms Greer. The producer said another woman in the Brittas area who was 18 at the time of Elizabeth Plunkett's murder approached them about her personal experience with the killers. 'She was walking home one evening… a car came along… she managed to run across fields to get away from them and got to her friend's house and closed the door. She was absolutely petrified. Pic: File She said another woman from Galway, also of student age at the time, 'managed to run as well, but they actually chased her'. An inquest was finally held into Elizabeth Plunkett's death in January, when the coroner officially gave the cause of death as 'unlawful killing'. The family were also issued a death certificate for the first time. Former State pathologist John Harbison initially found that Ms Plunkett hadn't died by drowning. 'She was dead before she went into the sea,' Ms Greer said, adding the inquest 'was the first official acknowledgement from the State that Elizabeth died, let alone at the hand of another'. The producer praised the Plunkett family for their bravery in helping to make the podcast. 'It is hard for the Plunketts to hear all this again, but they're being really brave and doing it for Elizabeth. They believe that Elizabeth would do it for them.' Mechanic drove into Garda car inside GAA club grounds after high speed chase, court told
The court was told how the vehicle appeared to be trying to capture the attention of gardaí who were on patrol at the time by stopping in the middle of the road and recording officers on a mobile phone. Conor McPhillips led gardaí on a high speed chase across Monaghan in a pursuit that ended in a GAA club grounds. A mechanic went 'buck mad' when he led gardaí on a high speed chase before turning and driving into a garda patrol car inside the grounds of a GAA club, a court has heard. Conor McPhillips (32) Kincorragh, Smithborough, Co Monaghan was eventually stopped after his attempts to give gardaí the slip moments after entering the vicinity of Tyholland GAA ended in failure during the early hours of July 21 last year. McPhillips appeared at a sitting of Monaghan District Court where he pleaded guilty to dangerous driving, no insurance, refusing to provide a specimen to gardaí and of having no driving licence in place in the wake of the incident. Sgt Lisa McEntee outlined how gardaí had been drawn to the movements of a VW Passat shortly before 4am after it was spotted being driven in an erratic manner. Moments later, the vehicle proceeded out the N2 and towards Emyvale where its driver failed to stop despite attempts by gardaí to signal to its driver to pull in. As the VW Passat continued towards Emyvale, gardaí temporarily lost sight of the vehicle before noticing it then travelling behind the patrol car minutes later. The same vehicle carried out what was described in court as a 'dangerous' overtaking manoeuvre by crossing a number of traffic islands in the Gortmoney area of the county. As gardaí set off in pursuit of the vehicle once more, its driver undertook a second dangerous overtake a short time later before it was spotted circling around a roundabout 'numerous times' as it made off in the direction of Tyholland. Today's News in 90 Seconds - June 13 2025 Sgt McEntee said it was at that stage, gardaí observed the accused turn his vehicle and drive directly into the garda patrol car, causing damage to its front bumper in the process. Judge Raymond Finnegan was informed how McPhillips proceeded to drive around the outside perimeter of the Monaghan club side's pitch before he subsequently exited the vehicle and was arrested. Defence solicitor Martin Cosgrove described his client's actions as a 'big outing for a first outing' in light of his lack of any previous convictions. 'He has no real explanation and just went buck mad that night,' said Mr Cosgrove as he handed in €400 on behalf of McPhillips for the damage that was caused to the garda patrol car. The local solicitor insisted that while there was no damage inflicted upon the pitch or gates of Tyholland GAA which McPhillips rammed during the course of the chase, it was conceded his 'cooperation wasn't great' with gardaí when he was brought to a local garda station following his arrest. 'This is worthy of a prison sentence,' replied a visibly irritated Judge Finnegan as he ordered McPhillips to spend a spell in the holding cells of Monaghan Courthouse while he considered his verdict. When the accused was brought back up shortly before lunchtime, McPhillips said that experience was one he did not wish to encounter anytime soon again. 'How would you like nine or ten months in it because from what I heard this morning you deserve it for the way you conducted yourself,' said Judge Finnegan. McPhillips responded by insisting his actions on the night of the incident were 'completely out of character', something which drew a terse response from Judge Finnegan. 'Do you know how many times I have heard that in here? Everything is out of character when you end up in the court,' he said. McPhillips was consequently fined €500 for one of the dangerous driving charges and banned from driving for two years, as well as being fined €500 for the section 12 refusal alongside an accompanying four year ban. A €350 fine, meanwhile, was also handed down for driving without insurance. In 'taking into consideration' the no driving licence charge and criminal damage charge given the €400 compensation which was handed in earlier, Judge Finnegan told the 32-year-old: 'You are a very lucky man Mr McPhillips.' In the aftermath of that ruling, Mr Cosgrove applied for a brief postponement to McPhillips' disqualification in view of the fact he lived at home with his parents and was presently bringing his mother to medical appointments for treatment to a shoulder injury. Those overtures, however, fell on deaf ears as Judge Finnegan insisted his client needed to recognise the error of his ways. 'No, I won't do it (postpone driving ban),' he said. 'Let him pay for a taxi as he needs to take responsibility.'
