Wishaw delivery driver made almost half a million pounds from illegal activities

A delivery driver serving time for organised crime offences made almost half a million pounds from illegal activities, a court has heard.

However, the High Court in Edinburgh heard on Monday how Kelly, of Wishaw, only has £45,599.50 of the fortune available at this point in time.
The news emerged at the conclusion of a proceeds of crime hearing brought against Kelly by prosecutors.
Crown lawyers brought the action after Kelly was given a seven and a half year sentence following his guilty plea last year for a charge of involvement in serious organised crime.
The High Court in Glasgow heard how Kelly was detained during a Police Scotland initiative called Operation Aversion.
The court heard how detectives were able to link Kelly to the purchase of more than £400,000 of cocaine and cannabis.
He also gave 'advice' to mob associates to avoid being caught for a raid on a man's house which saw his home and car 'wrecked'.
Kelly's involvement in the gang was mainly uncovered via messages to other clan members on WhatsApp and the EncroChat phone network favoured by criminals before it was smashed by law authorities.
In 2018, Kelly – known as 'Ants' – discussed a news report about Police Scotland investigating 3282 individuals involved in organised crime.
He stated to an associate: 'Hope they give us a bit of credit and not put us at the bottom of the list.'
Prosecutor Lindsey Dalziel said the WhatsApp chats made 'ongoing references' to the trafficking of cocaine, cannabis as well as ecstasy.
In late 2018, Kelly became panicked when a gang member was caught by police with a class A drug haul.
He described it as 'a f***ing mess'.
Kelly's home in Wishaw was initially raided months later.
Miss Dalziel said: 'A number of items were recovered including a selection of expensive jewellery, electronic devices and also cash.'
However, no charges were brought at that time.
Kelly remained part of the gang and continued to contact associates via EncroChat in 2020.
Miss Dalziel continued: 'There were messages...indicating significant quantities of drugs and money changing hands.'
The total amount of cocaine purchased by or on behalf of Kelly was more than £400,000 with cannabis valued at £14,700.
The court also heard of a raid at the home of a man in Wishaw in May 2020.
Masked gang members had yelled they were 'armed police' before bursting in.
Miss Dalziel added: 'They gained entry through the front door, damaged property and threw petrol over the furniture.
'They damaged a motor vehicle outside using an axe.'
The hearing was told Kelly did not take part in the attack itself.
But, the prosecutor explained: 'He knew about it in advance and gave advice afterwards to those involved to avoid detection for their part in it.'
One of the raiders told Kelly via EncroChat that they had 'wrecked the entire house', left the car a 'write off' and that the man who lived there was 'terrified'.
Kelly was arrested in October 2021, but initially made no comment.
Judge Andrew Miller jailed Kelly for seven and a half years at the High Court in Aberdeen.
Passing sentence, judge Miller said: 'This is a very serious offence, particularly bearing in mind the damage which the supply of class A controlled drugs, and other criminal activities which are associated with the supply of controlled drugs, causes to individuals, families and communities.'
On Monday, judge Lord Renucci made an order that forces Kelly to hand over £45,599.50 after a short hearing.
The Crown can return to court to obtain more money if they identify more of Kelly's ill gotten gains.

Prosecutor Christopher McKenna said: 'The accused murdered his girlfriend, Phoenix Spencer-Horn, in the top-floor flat they shared. Late on Saturday November 16, he strangled her and stabbed her. He dialled 999 but not until November 18. 'Her mutilated and decapitated body was discovered only on November 18.' The court heard that Miss Spencer-Horn had seen her mother the day before and had been in good spirits at work the day she was murdered. Mr McKenna said: 'The police recovered texts between the accused and Phoenix, he complained of feeling lonely because of the hours she worked and he apologised.' The court heard that a food order was placed around 8pm and Methven 'did not appear to be drunk or under the influence by the delivery driver', however, in a 999 call, he claimed that the murder happened when he had a psychotic episode induced by cocaine, alcohol and steroids.

A high-risk sex attacker who dragged a schoolgirl into woods and subjected her to a 'devastating' rape ordeal has been jailed for eight years. Drink and drug fuelled Valentin Tica, 24, insisted on walking his victim home after meeting her in Edinburgh and offered her drugs before launching the appalling assault on the 13-year-old child. The High Court in Edinburgh heard that Tica faces deportation to his Romanian homeland at the end of his jail sentence where he faces a further 12-month prison term for assault. A judge told him: 'You have pled guilty to rape of a 13-year-old schoolgirl. You were aged 22 at the time.' Lord Ericht said: 'Your victim was sitting with a friend on a bench on a path near a wood and a hill. You came and sat beside them. 'When the friend left, you insisted on chumming your victim towards her home, even though she did not want you to do so. On the way, you dragged her into the woods and raped her,' said the judge. He pointed out that a background report on Tica ahead of sentencing assessed him as presenting a high risk of harm. Lord Ericht said that Tica's previous convictions in Scotland were of a minor nature and were not for sex offending. The judge said: 'I have also had the benefit of a victim impact statement from your victim's mother which speaks eloquently of the devastating effect you have had on her daughter's life.' He imposed a non harassment order prohibiting Tica from contacting or attempting to contact the girl for an indefinite period. Tica, a prisoner in Edinburgh's Saughton jail, earlier admitted attacking and raping the schoolgirl on November 3, 2023. During the assault he made sexual remarks to the child victim, grabbed and pushed her and molested her before he seized her by the body and hair and pulled her into bushes and raped her. Tica's defence counsel Ian Duguid KC said that he previously met the girl in the street and thought she was 16. He said: 'As far as the accused is concerned he was not aware that she was of such a young age.' The defence counsel said: 'The sentence which he faces in this case is undoubtedly going to be a substantial one.' Mr Duguid told the court: 'The report indicates that he is apologetic about his conduct. He says that he was affected by drugs and alcohol which he had consumed.' He said he understood that Tica had offered the girl cannabis. The defence counsel said that Tica was facing deportation following the completion of his prison sentence for the rape and a further jail term awaited him in Romania. Mr Duguid said: 'He has a 12-month sentence following the commission of an assault in the course of a fight. I understand that is the information contained on the application for extradition by the Romanian authorities. It is not a previous sexual incident.' Tica, who was living in Edinburgh at the time of the sex attack, followed the court proceedings with the aid of a Romanian interpreter. The court heard how he killed her by repeatedly striking her on the head and body with a knife or knives. He also choked her before mutilating her remains in a bid to hide what he had done. Members of Phoenix's grieving family were also present as Methven's KC Tony Graham entered guilty pleas to charges of murder and attempting to defeat the ends of justice. This was accepted by advocate depute Chris McKenna. The hearing, before judge Lord Matthews, continues.
