Mumbai: Raising doubts about the credibility of the prosecution's witnesses, a court has acquitted two south Mumbai residents who were accused of procuring passports by forgery and impersonation and attempting to travel to Dubai with them nearly 20 years ago.Additional chief judicial magistrate Vinod Patil cleared Abdul Rashid Ahmed Mistry (84), and Zuber Noor Mohammad Chali (64) of cheating, forgery, breach of trust and
criminal conspiracy
.
According to the prosecution, based on a lookout notice, Mistry was intercepted at the city airport just before he could board a flight to Dubai under the alias Shoeb Ahmed Raza on Nov 19, 2005. During questioning, he allegedly revealed his identity and admitted to obtaining a passport using forged documents. The court noted that an immigration official deposed that a person named Shoeb Ahmed Raza submitted his passport and boarding pass at his counter and the documents matched the name on the lookout notice.

"He was the best person who could have identified the accused. However, he did not identify him," it said. It added that had the prosecution successfully established that the documents had been seized from the custody of the accused, then the onus of proving his innocence would have been on him. "But except for the investigating officer, no one has stated that those documents were seized from the accused... Panch witness Iqbal Rizvi... did not support the prosecution," the judge said. The accused's counsel Aftab Qureshi said the prosecution did not produce any credible or independent evidence. "The case was based on unsubstantiated oral statements, lacking any corroboration."Sahar police had lodged the case, which was later transferred to DCB CID unit 8. The chargesheet was filed in Feb 2006 and charges framed in Nov 2008, but the trial began only in March 2015.

Sharmishta Panoli row: Wajahat Khan Qadri, man who filed case against influencer, arrested in Kolkata

The Kolkata Police on Monday arrested Wajahat Khan Qadri, the man who filed a case against social media influencer and law student Sharmistha Panoli, reported India Today. According to the Kolkata Police, Khan's police complaint led to the arrest of the social media influencer. Khan was allegedly on the run since 1 June after a series of raids. Earlier, a case was registered against Wajahat Khan at the Golf Green Police Station in Kolkata for allegedly spreading hate speech and hurting religious sentiments via his social media activity. Despite the police serving Khan three notices at his Garden Reach residence and directing him to appear for questioning, he remained on the run until his arrest. Khan's arrest comes amid mounting controversy over Panoli's arrest, who was held from Gurugram on 30 May by Kolkata Police, following a controversial video she posted on social media which drew strong reactions. In the video, she allegedly criticised Bollywood celebrities for staying silent on Operation Sindoor. After intense trolling and threats in the comments, Panoli removed the video and issued a public apology on 15 May. Earlier on 3 June, the Calcutta High Court had rejected the interim bail plea of Panoli. On 2 June, Shree Ram Swabhiman Parishad filed a formal complaint against Wajahat Khan with the Kolkata Police, accusing him of using derogatory, inflammatory, and sexually explicit language targeting Hindu deities, religious traditions, and the community at large. In the letter to the Officer-in-Charge of the Garden Reach Police Station, Shree Ram Swabhiman Parishad alleged that Khan in his social media posts referred Hindus by using terms including "rapist cultures" and "urine drinkers". The Hindu body requested the police to take action against Khan under sections of the Bharatiya Nyaya Sanhita and the Information Technology Act.

'In breach of natural justice': Bombay HC sets aside student's rustication from Pune college; she criticized govt over Operation Sindoor

Bombay high court (File photo) NEW DELHI: The Bombay high court on Monday set aside the rustication of a student from a Pune-based engineering college over her post on Operation Sindoor . The division bench of justices Makarand S Karnik and Nitin R Borkar noted that the expulsion letter by Sinhgad Academy of Engineering was "in breach of natural justice" as the student was rusticated without being heard, news agency PTI reported. However, the bench granted the institute liberty to take an appropriate decision after hearing her and complying with the principles of natural justice. This comes after the court, on May 27, suspended Sinhgad Academy's order to expel her. It also allowed the girl to appear for her second-year semester examinations. The controversy began on May 7 when the student, pursuing a Bachelor of Engineering (Information Technology) degree, shared a post on Instagram from an account named "Reformistan." She criticised the government for Operation Sindoor, which was launched earlier that day, and targeted terror sites in Pakistan and Pakistan-occupied Kashmir.
