
Labourer gets 6 years' jail, caning for sodomising disabled man

PETALING JAYA : The Kuala Terengganu sessions court has sentenced a labourer to six years in prison and one stroke of the cane for sodomising a man with learning disabilities.
Judge Zul Zakiquddin Zulkifli handed down the sentence after Jaya Ghani, 40, pleaded guilty, Harian Metro reported.
According to the charge sheet, Jaya engaged in intercourse against the order of nature with the 46-year-old victim without his consent.
The offence was committed in a bathroom at a house in Marang at around 12pm on June 7.
He was charged under Section 377C of the Penal Code.
The court ordered the prison sentence to begin from the date of his arrest, which was June 15.
Deputy public prosecutor Aisyah Mohamad prosecuted, while the accused was unrepresented.

Pilot loses nearly RM95,000 in haj package scam
SEREMBAN: A female pilot lodged a police report today claiming she was cheated in a haj package deal, resulting in a loss of RM194,970. Nilai police chief Superintendent Abdul Malik Hasim said the victim, in her 30s, filed the report at the Nilai police station at 11.23am, saying that she had dealt with an individual from an Umrah travel agency who offered the haj package on Jan 14. "The victim, who works for a local airline, made several transfers totaling RM194,970 to the agency's account as full payment for the package. "However, she realised she had been scammed on March 15 after finding out that the agency was no longer in operation and she would not be able to perform the haj as promised," he said in a statement today. JAC questioned senior judge on alleged judicial interference, says source
At the opening of the legal year in January, Chief Justice Tengku Maimun Tuan Mat warned that any attempt to interfere with the JAC's independent functions would constitute a criminal offence. PETALING JAYA : A senior judge was summoned by the Judicial Appointments Commission (JAC) to answer several allegations of interference in the appointment of judicial officers dating back to last year, says a source. 'Following the questioning, there was a heated discussion at last month's monthly meeting of the JAC, which is now split into two factions, with one sympathetic to the judge,' the source told FMT, declining to provide further details. Chief Justice Tengku Maimun Tuan Mat chairs the nine-member JAC. Other members include Court of Appeal president Abang Iskandar Abang Hashim, Chief Judge of Malaya Hasnah Hashim, and Chief Judge of Sabah and Sarawak Abdul Rahman Sebli. These four are members of the JAC by virtue of holding the top administrative positions in the judiciary. In February, Prime Minister Anwar Ibrahim appointed senior Federal Court judge Zabariah Yusof to the JAC under Section 5(1)(e) of the JAC Act 2009. Last year, Anwar also appointed former attorney-general Idrus Harun, former Federal Court judge Zainun Ali, former Sarawak attorney-general Mahmood Abdul Rashid, and academician Hartini Saripan to the JAC. Meanwhile, a subordinate of the judge concerned lodged a police report two weeks ago against a reporter from a news portal who had sent a text message seeking the judge's response to the allegations of interference. In the report filed at the Putrajaya police station and sighted by FMT, the officer said the journalist's questions pertained to matters discussed at the May 16 JAC meeting. 'This report is being made to urge the authorities to investigate how such information was leaked,' the officer stated. She added that bypassing the provisions of the JAC Act could render such appointments unconstitutional or unlawful.

Duo who punched, bit policeman in Penang to be charged tomorrow
GEORGE TOWN: Two men who assaulted a policeman at the state police contingent headquarters will be charged in the Georgetown Magistrates' Court tomorrow. Northeast district police chief Assistant Commissioner Abdul Rozak Muhammad said the suspects will be charged under Section 323 of the Penal Code for voluntarily causing hurt, and Section 14 of the Minor Offences Act 1955 for using threatening behaviour likely to disturb the peace. "Both will be charged tomorrow in connection with the case," he said when contacted today. The incident occurred about 4.30pm yesterday, when a 30-year-old policeman detained the two men, aged 19 and 20, near the main gate of the police headquarters on suspicion of being intoxicated. "It was inside the post where the suspects allegedly became aggressive, punching the policeman in the cheek and biting his chest. "The policeman sustained injuries, including swelling around his left eye and bruising on his chest. "The duo also shouted abusive language at the policeman," he said. The two were remanded for three days, ending tomorrow.
