
Mind-bending excuse woke Oregon judge made to set free dad who killed 15-month-old daughter in most abhorrent way
A father who killed his infant daughter will soon walk free after an Oregon judge ruled prosecutors acted with racial bias.
Darian McWoods had his lifetime sentence overturned and massively reduced to 10 years after appellate judge Josephine Mooney tossed his conviction because two black people were excluded from the jury.
Having already served 8.5 years, McWoods will be released in 18 months despite being found guilty in 2018 of killing his daughter Kamaya Flores from a methadone overdose. She also suffered broken ribs, bruises, bleeding, and strangulation.
In the original trial, the jury heard of McWoods' violent bedtime routine in which, instead of rocking or holding Kamaya to sleep, he would hold her down in her crib until she stopped struggling.
But Judge Mooney ruled in 2022 that the jury that heard those arguments didn't include two black candidates - despite acknowledging Multnomah County Senior Deputy District Attorney Amanda Nadel had given 'race neutral reasons' for striking them.
'Racial discrimination in the selection of jurors is harmful,' Mooney wrote in 2022. Mooney resigned from the court of appeals in 2024 after being accused of being biased in cases.
In order to avoid a second trial, Judge Christopher Marshall resentenced McWoods, 32, on Wednesday to the greatly reduced 10 years, with time served, meaning he only as 1.5 years left in custody.
The original trial heard that the amount of methadone found in the baby's system was enough to slow or stop her breathing. Methadone is a narcotic that is often used to ween drug addicts off of opioids like heroin.
Under the resentencing deal, the father-of-one pleaded guilty to first-degree manslaughter, criminal mistreatment, and admitting that his daughter died due to him not seeking medical care for her, The Oregonian reported.
'He did not give his daughter drugs, he did not assault or abuse her - but he failed her,' his attorney, Lynn Morgan, said on Wednesday.
'I aspire to atone,' McWoods told the court. 'I just wish everybody the optimal healing that's available to them.'
The girl's grandmother, Raquelle Flores, has made peace with the decisions, despite the family being left with some unanswered questions.
'This pain is no longer mine to carry, and the burden is now Darian McWoods' karmic path to walk,' she said, according to the outlet.
The family did not address McWoods in court, but remembered the girl loved Elmo, spending time with family, laughing, and was very joyful.
McWoods looked at a photo of his daughter that was displayed in court, the outlet said.
Chief Deputy District Attorney Amanda Nadell said prosecutors understood the new sentence was significantly lower than the original, but said the family just wanted closure.
Baby Kamaya was found dead in McWoods' home in December 2013, after he spent time alone with the child.
The night before his daughter's death, McWoods told police that he picked her up from a relative's house between 10pm and 11pm.
She was sleeping so he woke her up, bringing her along to the grocery store and then a Jack in the Box for french fries. She was not interested in eating, so she went back to sleep between 2am and 4am.
When McWoods tried to put his daughter down for a nap later that day, he said she had been fussy.
When he went back to check on her, he claims he found her with her face wedged face down in a gap between the mattress and the wall and she wasn't breathing.
Emergency 911 dispatchers got three calls about the girl between 12:36pm and 12:46pm. The calls came from McWoods and his sister, Diamond, and were contradictory - saying she was either fine or unresponsive.
They rushed to the home anyway and found that she had been dead for a while.
Her heart was no longer beating, her body was cold and her face was blue - indicating oxygen deprivation.
An autopsy also revealed that some of her ribs were cracked and that her liver was lacerated.

Shocking new details have emerged about the alleged gang-rape of a 19-year-old girl - as the family of one of the suspects lashes out over his arrest. Adam Abdul-Hamid, 19, was arrested at a home in Heckenberg, in Sydney 's south-west, at about 6am on Tuesday. Abdul-Hamid was one of four males, including a 14, 16 and 18-year-old, arrested for their alleged involvement in the horrific sexual assault of a 17-year-old girl on December 15, 2024. Dramatic police footage showed Strike Force Police, along with the Public Order and Riot Squad, breaking down the door as they executed a warrant at the home. Abdul-Hamid was charged with five counts of aggravated sex assault - offender in company with other person/s over the alleged sexual assault of a 17-year-old girl in December, last year. The 17-year-old girl was allegedly approached at about 5.30pm at a shopping centre in Liverpool, 31km south-west of Sydney's CBD. The 16-year-old allegedly followed the girl to her car and she reluctantly let him inside before he began sexually assaulting her. A short time later, the male asked to be driven to Wheat Park in Sadleir, to which the victim agreed on the understanding he would get out of the car when they arrived. At the park, two other males entered the car, and they also allegedly sexually assaulted the girl. A fourth male then arrived in another vehicle, and the sexual assault continued as the girl was driven around. The six-hour ordeal ended at about 11.30pm when the males departed and left the victim in her car. The teenager immediately contacted a friend who took her to Liverpool Police Station to report the attack. The matter was referred to State Crime Command's Sex Crimes Squad who established Strike Force Dungannon to investigate. State Crime Command's Sex Crime Squad commander Detective Superintendent Jayne Doherty said in a press conference on Wednesday morning it will be alleged it was the 16-year-old boy who approached the woman. Doherty said the boy 'struck up a friendly conversation' with the 17yo girl before following her to her car in a shopping centre parking lot. 'She reluctantly allowed the male into her car, where the conversation continued,' she said. Police will allege that during the sexual assault, the 16yo boy had a video call with the co-accused and filmed parts of it, sending it through to the other offenders. 'The female was trying to get him out to leave her car after the sexual assault,' she said. Doherty said the accused drove her car 'erratically' and continued to degrade and assault this victim over a period of six hours. When they arrived at Wheat Park another car pulled up and she was allegedly sexually assaulted by two other males. 'They took control of the vehicle and drove her in her own car around the suburbs of Sadleir and Miller over a six hour period, continuing to act together and encourage each other and degrade the victim in the way that they did. 'That type of thinking in any person is just unbelievable and unacceptable to any standards.' When asked how the young woman was Doherty said: 'Obviously she's very distraught. This will impact the rest of her life.' Footage of the arrest showed his family outside the home as detectives escorted a handcuffed Abdul-Hamid to a police vehicle. One male family member is heard screaming 'why... why are you arresting him' as Abdul-Hamid is led out of the home. Other family members attempt to restrain the man as he continues to hurl insults at the officers. 'F**k your mothers,' the man said in Arabic before yelling 'all of you' in English. A woman is also seen using her phone to film police as they arrest the 19-year-old. 'I'll go this way, don't touch me. Don't touch me. Don't touch me or sexual assault me,' the woman said. As police load Abdul-Hamid into the back of the vehicle, the 19-year-old calmly tells his family in Arabic to 'don't say a word to anyone, yeah'. The woman echoed the 19-year-old's words and responded in Arabic 'don't say a word to anyone' before yelling in English: 'Don't trust these dogs, you can't trust these f***ing dogs'. The two younger males faced a children's court that same month, while months of investigation led to the two older alleged culprits being arrested on Tuesday. Officers arrested a 16-year-old boy at a home in Condell Park in southwest Sydney's CBD, on December 20, 2024. He was taken to Bankstown Police Station where he was charged with 24 offences: nine counts of sexual intercourse without consent, eight counts of aggravated sex assault - offender in company with other person/s, five counts of sexually touching another person without consent and two counts of aggravated sexual assault in company and inflicting actual bodily harm. Detectives arrested a 14-year-old boy at a home in Miller, also in Sydney's southwest, and also on December 20. He was charged with 10 offences: seven counts of aggravated sex assault - offender in company with other person/s, aggravated sexually touching another person, inflicting actual bodily and sexually touching another person without consent and aggravated sexual assault in company. Both the 16-year-old and 14-year-old boys were refused bail and faced a children's court on December 21, 2024. Following an extensive investigation, strike force detectives identified the two other males allegedly involved in the sexual assault. At about 6am on Tuesday, detectives, along with the Public Order and Riot Squad, simultaneously executed two warrants at homes in Sadleir and Heckenberg - both in Sydney's south-west. Police arrested an 18-year-old man at the Sadleir property before taking him to Liverpool Police Station. He was charged with nine counts of aggravated sex assault - offender in company with other person/s. He was denied bail and is set to face a children's court on Wednesday. Staggering number of times glamorous teacher is accused of sleeping with student as husband stands by her side amid fresh claims
A glamorous teacher accused of grooming an underage student allegedly slept the teen boy at least 50 times. Christina Formella, 30, faced an Illinois court on Tuesday as she was hit with 52 new charges, supported by her loyal husband Michael, who has stood by her side throughout the scandal. The teacher and soccer coach is now accused of additional counts of sexual assault, indecent solicitation of a child, grooming and aggravated criminal sexual abuse. According to the new complaint, Formella groomed a 15-year-old male student and then had sex with him at least 45 times at Downers Grove South High School while classes were in session, and another five times at her home. She was the boy's soccer coach and tutor. The alleged abuse began in January 2023 and continued through at least August 2024. It was only discovered when the student's mother found disturbing messages between the two when she logged into her son's iCloud account. 'The new allegations against Ms. Formella, including the allegations of grooming and that the abuse lasted nearly two years, are beyond disturbing,' State Attorney Robert Berlin said. 'I thank the victim in this case for having the courage to come forward during what I image is an extremely difficult time for him.' Prosecutor Jaclyn McAndrew told the court that the new evidence suggests Formella first began contacting the boy when he was just 14 years old. The contact, McAndrew said, lasted far longer than prosecutors initially believed when she was initially charged. Formella was arrested in March during a traffic stop outside of Chicago and initially charged with just three criminal counts. She has pleaded not guilty. 'She is unbelieving conniving, and she is unbelieving controlling,' McAndrew told the judge, according to the Daily Herald. McAndrew claimed Formella had told the boy she did not intend to marry her husband, and that he was having an affair with her best friend. Formella allegedly told him that her husband would leave her and she would come into millions of dollars. It is also alleged that she was texting the boy while on a vacation with her husband in Italy. Shocking police bodycam footage captured the moment she was arrested as she sat in her car next to her husband. DuPage County prosecutors claimed that during her police interview, Formella tried to portray her victim as a boy obsessed with a teacher because she's 'good looking' and claimed her husband was aware of the situation. 'Throughout her interview, [Formella] tried to paint [the accuser] as her 'stalker' and claimed that her husband was aware,' prosecutors said in court documents obtained by the New York Post. However, her husband told investigators it was the first time he had heard about a situation involving the boy. 'Oddly enough, her husband told detectives that he knows nothing about [the accuser] beyond his status as a soccer player,' prosecutors said. Formella allegedly sent shockingly lewd messages to the boy, telling him how much she 'loves him' and 'loves having sex' with him. The teacher has maintained that she never sexually assaulted the student and that 'everybody comes after her because she is good-looking,' according to court documents. She confessed to police that she 'cared too much' about the student, but claimed that he broke into her phone and sent the text messages as blackmail. 'She claimed that one day, [the boy], had grabbed her phone unattended, had entered her passcode... had sent the message to his phone, had then deleted the message from her phone, and had saved it to his phone as blackmail,' the documents said. Formella's next court appearance is scheduled for August 4, 2025.

'As a dad, I still do not understand why the CIF officials berated my daughter, stripped her of her title, banned her from competing in the next race and ignored me when I attempted to get an explanation of what was going on,' her dad David added to PEOPLE 'As a father I was angry about how they physically grabbed and yelled at her. I am still at a loss as to why they treated her and that way. She's a kid and they treated her like an adult and gave her the maximum punishment without any warning or explanation.'
