Anwar likely to exhaust right under law to refer constitutional questions to Federal Court — Hafiz Hassan
JUNE 4 — In the case of Badan Peguam Malaysia v Yang Berhormat Perdana Menteri Malaysia, Tan Sri Dato' Hj Mahiaddin bin Mohd Yasin & Anor [2024], the Malaysian Bar (Bar) applied to the High Court (HC) to refer no less than 27 constitutional questions to the Federal Court pursuant to Article 128 of the Federal Constitution (FC) and/or Section 84 of the Courts of Judicature Act 1964 (CJA).
The HC dismissed the reference application, essentially on the ground that the questions raised were not constitutional questions that fell exclusively within the jurisdiction of the Federal Court alone to answer. Aggrieved by the decision, the Bar appealed to the Court of Appeal (COA).
Having heard the appeal, the COA affirmed the decision of the HC. One of the main grounds for dismissing the appeal was that the HC had not committed any appealable error in refusing to refer the questions posed to the Federal Court.

President of COA, Abang Iskandar, having analysed the questions of law and the applicable law, dismissed the Bar's application for leave to appeal. His Lordship said:
'Our analysis of all the proposed questions of law is that they are essentially proposing to us to relook into the meaning, application and scope of Section 84 of the CJA, read with Article 128(2) of the FC. In our view... all the cited cases had comprehensively dealt with the matter. We find that the Bar had failed to satisfy us as to where and what the gaps are in those cited cases to merit the grant of leave.
'In the upshot, we are of the unanimous view that the threshold requirement [for leave to appeal] has not been met, with respect, by the Bar in this case, and as such, this leave application ought to be and is dismissed with no order as to costs.'
The point is this: application to refer question or questions of law to the Federal Court pursuant to Article 128(2) of the FC and/or Section 84 of the CJA is available to any party to a dispute.
Accordingly, Prime Minister Anwar Ibrahim is as entitled as the Bar to apply to the court to refer constitutional questions to the Federal Court.
Anwar is also entitled to appeal against the decision of the learned High Court judge dismissing his application to refer the constitutional questions to the apex court.
He is likely to exhaust his right under the law.

Klang villagers up in arms over columbarium project

He said the project had not been discussed with the residents, who only became aware of it two weeks ago. 'Many residents are worried that the village area may become polluted by ashes generated from the cremation process, particularly for homes situated less than 10 metres from the site,' he told reporters after participating in a peaceful protest on Persiaran Raja Muda Musa in Port Klang today. Dozens of village residents were at the protest, expressing their opposition to the construction of the columbarium. Azhar said that in the last two days, residents have submitted over 300 protest notices online to the Klang city council regarding the planned project. He said the villagers want the construction of the columbarium to be cancelled, to ensure the comfort of residents, especially Muslims. The imam of Kampung Raja Uda mosque, Bazaireen Baharuddin, said: 'We strongly oppose the construction of this four-storey complex' less than 50m from our place of worship. 'I am concerned that once the columbarium begins operating, it will host many religious ceremonies, making the Muslim residents here feel uncomfortable,' he said. He said the villagers hoped the MP, state assemblyman, and Klang mayor would listen to their concerns.

Manet said Cambodia adheres to the principle of maintaining peace, friendship, and good cooperation with Thailand, Bernama reported. 'Cambodia's decision to refer Ta Moan Thom Temple, Ta Moan Tauch Temple, Ta Krabei Temple and Mom Bei areas to the International Court of Justice is to seek an early, peaceful and permanent solution to the border issue in these areas rather than to prolong the uncertainty which can lead to renewed armed conflicts,' he said. Tensions between the two neighbours escalated after a Cambodian soldier was killed in a clash with Thai troops in Preah Vihear province on May 28. Manet also said that Cambodia continues to cooperate with Thailand to expedite the demarcation and delimitation of the border, save for the four mentioned areas, through a joint border commission, which is expected to meet in Phnom Penh on June 14.

(EPA Images pic) SUBANG JAYA : As Muslims look forward to celebrating Hari Raya Aidiladha tomorrow, residents of Kampung Kuala Sungai Baru in Puchong must summon the strength to face the day, two months after their homes were destroyed in the gas pipeline inferno on April 2. Among them was Nasir Ab Hamid, 69, who said sheer will and determination have been his family's main source of strength in forging ahead despite now living with minimal means after losing most of their belongings in the fire. 'My family and I are grateful to be alive and to have received support from the community and various parties. However, I hope the recovery process, particularly the promised rebuilding of our home, can be expedited so that life can return to normal,' he said. Nasir's house remains without a roof, except for the garage, and the interior was devoid of furniture or electrical appliances, which had been destroyed in the intense heat of the fire. Nasir lives in the house alone, sleeping in the garage on a mattress he received from the temporary relief centre. 'Although I received financial assistance to rent a house, I feel more comfortable staying in my own home as I can also keep an eye on what's left of my belongings while my wife and four of our children occupy the rented house,' he said, expressing hope that the government would expedite the repair process for all victims' homes. Another resident, Ahmad Danial, 25, said that their lives are no longer the same, especially with the lingering trauma still deeply affecting the entire family. 'There are no major preparations (for Aidiladha). The house is still in ruins, making it difficult to gather comfortably with the family. We are relying on donations from local associations and neighbours,' he said, adding that he lost his job following the incident. Ahmad Kamarul Meskam, 42, expressed despair for not being able to gather with his siblings for Aidiladha after their mother's house was destroyed in the incident. He said before the fire, they lived in the same village. 'We have no plans to celebrate Aidiladha since we are now living in separate areas.,' he said, admitting that the tragedy has left a profound emotional impact. It is understood that the Kampung Sungai Baru Residents Association will hold a sacrificial ritual in conjunction with Aidiladha on Sunday on a plot of land in the village, thanks to donations of several cows and goats from an anonymous benefactor. The gas pipeline fire, which occurred at 8.10am, resulted in flames shooting up 30 metres high, with temperatures reaching 1,000 degrees Celsius. Firefighters took nearly eight hours to completely extinguish the fire. A total of 81 houses were destroyed, with more than 40% of the structures sustaining structural damage; 81 other houses were partially destroyed, 57 houses were affected but not burned, and 218 houses remained unaffected.
