New Delhi, The Supreme Court on Thursday agreed to examine whether consecutive life sentences can be handed out to a person convicted twice for the offence of murder.
The issue cropped up when the bench was hearing a plea arising out of a 2015 verdict of the Punjab and Haryana High Court in a 2010 double murder case.
A bench of Justices Prashant Kumar Mishra and Manmohan learnt that a five-judge Constitution bench of the apex court in July 2016 held that while multiple sentences for imprisonment for life can be awarded for multiple murders or other offences punishable with life term, they cannot be directed to run consecutively.
"Issue notice limited to the question of ascertaining as to whether the imposition of consecutive life sentence for being convicted for the offence punishable under section 302 is lawful in view of the observations made in ... , returnable in eight weeks," the bench said.
The high court, while upholding the conviction of a man in the case, had turned down the reference for confirmation of death sentence awarded to him by a trial court.
The high court awarded life imprisonment to the convict twice for the offence of murder under Section 302 of the erstwhile IPC.
Life term, it said, was a sentence for imprisonment till the last breath of a person's natural life and as such, imposition of "two life sentences is otherwise superfluous".
"...however, since by executive action, in the form of remissions and pardons, such life imprisonment is often reduced to imprisonment for a lessor period, therefore, in such a situation, sentence of a second life imprisonment can be directed to run from the date when a person completes one sentence of such imprisonment, if remissions are granted to him," the high court added.
It directed that if any remission was granted to the convict in any one of his life sentences, the life term imposed upon him for the other offence of murder would start running from the date the first period of imprisonment was completed.
During the hearing in the apex court on Thursday, the counsel for the petitioner referred to the July 2016 verdict of the Constitution bench.
The lawyer referred to the apex court holding that when it comes to life imprisonment, it couldn't be imposed consecutively.
"That is exactly what has been done in this case," she argued.
The lawyer referred to the Constitution bench verdict which said, "We hold that while multiple sentences for imprisonment for life can be awarded for multiple murders or other offences punishable with imprisonment for life, the life sentences so awarded cannot be directed to run consecutively."
She said the high court's direction was now contrary to the law laid down by the apex court.
The lawyer said the convict was not able to apply for remission due to the high court's direction and urged the top court to at least consider setting aside that part of the verdict.

ED attaches ₹6.15 crore properties in Chhattisgarh liquor scam investigation

The Enforcement Directorate (ED), Raipur Zonal Office, has provisionally attached three immovable properties worth ₹6.15 crore under the provisions of the Prevention of Money Laundering Act (PMLA) in connection with the Chhattisgarh Liquor Scam case, according to the release. According to the ED, Congress Bhawan, Sukma, residential house at Raipur in the name of Kawasi Lakhma and residential house at Sukma in the name of Harish Kawasi (son of Kawasi Lakhma) have been attached. In a statement, ED initiated an investigation based on the FIR registered by the ACB/EOW Chhattisgarh under various sections of IPC, 1860 and Prevention of Corruption Act, 1988 in the matter of liquor scam in Chhattisgarh. ED investigation revealed that Kawasi Lakhma, the then Excise Minister of Chhattisgarh, was receiving ₹2 crore per month out of the liquor scam and thereby received POC ₹72 crore in 36 months. As per the official statement, the investigation conducted led to the seizure of crucial pieces of evidence, which demonstrated the utilisation of cash by Kawasi Lakhmain in the construction of properties mentioned above. ₹68 lakh was employed in the construction of Congress Bhawan, Sukma; ₹1.40 crore was utilised in the construction of the house of Harish Lakhma, and ₹2.24 crore was utilised in the construction of his own house at Raipur. Kawasi Lakhma is presently under judicial custody. ED investigation revealed that the corruption in the liquor scam, which ran between 2019 and 2022, resulted in a massive loss to the state exchequer and generation of more than ₹2161 crore worth of POC by commission of predicate offences, as per the release. It is pertinent to mention here that the said attachment continues the previous attachment of immovable properties having a value of nearly ₹205 crore. Further investigation is in progress.

The makers of Kamal Haasan's film Thug Life have alleged that the Karnataka government failed to protect the film from threats after it faced opposition following lead actor Kamal Haasan's controversial statement on the Kannada language. In their plea seeking protection from threats against the screening of the film in the state, the makers said no FIR was registered against threats to the film. The Supreme Court on Friday sought the Karnataka government's response to the plea. As per the petitioners' plea, there is an effective ban on the CBFC-certified film Thug Life in Karnataka, which is caused by violent threats from private groups, and the state authorities have failed to take action in this regard. Advocate A Velan said, 'A fringe group issued threats of large-scale violence, including the burning of theatres and attacks against members of the Tamil linguistic minority residing in Karnataka. Despite these open and public threats, not a single FIR was registered, nor was any prosecution initiated by the State Government. On the contrary, the government appeared to adopt the position of the very fringe elements that issued those threats. We are aggrieved by this inaction and are now before the Supreme Court, seeking enforcement of this Court's past directions.' The plea argued that such inaction violates the fundamental right to freedom of speech and expression under Article 19(1)(a) of the Constitution. This right applies not only to filmmakers but also to the public who want to view films. A bench of Justices Prashant Kumar Mishra and Manmohan issued notices to the Karnataka government, the State police, Raaj Kamal Films International Private Limited and the Karnataka Film Chamber of Commerce (KFCC) seeking their responses to the plea. Advocate Navpreet Kaur added, 'We approached the Supreme Court after fringe groups issued open threats on social media to burn down theatres screening Thug Life, targeting both cinema halls and the Tamil linguistic minority in Karnataka. Despite clear Supreme Court guidelines requiring immediate action against such hate speech, the State took no action -- no FIRs were filed, and no protection was offered.... Instead, under pressure, the Karnataka Film Chamber advised theatres not to release the movie, resulting in a de facto ban. This is a serious law and order failure and a threat to constitutional rights... Recognising the urgency, the Supreme Court has issued notice to the State, and the matter is listed for hearing next Tuesday.' The issue arose over an alleged statement recently made by actor Kamal Hassan, which said, 'Kannada was born out of Tamil'. The top court will hear the matter next week. Thug Life marks the reunion of Kamal Haasan and Mani Ratnam after 37 years. The action thriller also stars Silambarasan, Trisha Krishnan, Aishwarya Lekshmi, Abhirami, Ashok Selvan. Thug Life opened to bad reviews and lukewarm audience reactions in theatres on June 5. The film has earned only ₹92 crore worldwide in eight days. Some trade pundits argue that the box office collection has been affected due to its non-release in Karnataka and the controversy. (With ANI inputs)
