Murshidabad violence: Calcutta High Court releases police overaction case by victim's family

A Division Bench of the Calcutta High Court on Thursday (May 15, 2025) released a petition alleging that police were hounding the family of a man and his son, who were killed in the communal violence that had rocked Murshidabad district in April.
The Bench presided by Justice Soumen Sen released the matter on the ground that there is a designated Bench for hearing issues related to police inaction and overaction.

A single Bench of the High Court had earlier released the petition since a Division Bench was already hearing issues related to the incidents in Murshidabad, and the present petitioners were alleged victims of violence in the district.
The matter will be sent back to the Chief Justice of the High Court for assignment to a new Bench for hearing.
Aggrieved by the alleged actions of the Bidhannagar police commissionerate, widows of victims Haragobinda Das and Chandan had moved the high court.
Haragobinda Das and his son Chandan were allegedly hacked to death by rioters at Samserganj in Murshidabad district on April 12 during protests over the Waqf (Amendment) Act.
It had been stated before the single bench of Justice Tirthankar Ghosh that their family members came to Salt Lake, and were staying at a house there with the purpose of filing a petition before the high court.
Their lawyer had stated before the court that the door of the house was broken, and abuses were hurled at the family members of the deceased father and son by personnel from Bidhannagar police commissionerate.

A division bench of Justices Debangsu Basak and Md. Shabbar Rashidi upheld the conviction of Susanta Chowdhury, who was found guilty by a fast-track court of murdering a 19-year-old college student in Behrampore, Murshidabad, in broad daylight on May 2, 2022. The trial court had sentenced him to death. The accused, enraged after the victim ended their relationship and began seeing another person, planned the crime meticulously. He purchased a knife and a toy gun from an online store and used the latter to deter bystanders during the attack. The murder took place outside the victim's rented accommodation and was captured on video by a journalist, who was among the eyewitnesses. During the trial, 34 witnesses were examined, including police officers, forensic experts, family members, and acquaintances of the victim. The post-mortem revealed 45 stab wounds, several of which were classified as defensive injuries. The CCTV footage and video recording from a mobile phone, accompanied by valid electronic evidence certificates, were accepted by the court. Biological evidence also confirmed the presence of the victim's blood on the knife, clothes, and shoes of the accused. The high court, while affirming the conviction, reconsidered the sentence. Referring to landmark decisions including Bachan Singh, Machi Singh, Santosh Bariyar, and Swamy Shraddananda, the court ruled that while the crime was undoubtedly heinous, it did not fall into the 'rarest of rare' category warranting the death penalty. The bench took note of mitigating factors, particularly the convict's age — 21 at the time of the offence — absence of a prior criminal record, and psychological assessments indicating the possibility of reformation. 'There is no material before us to suggest that the appellant is beyond reformation," the court observed, adding that 'death penalty must be imposed only when life imprisonment is unquestionably inadequate." However, the court found that a standard life sentence, which could allow for remission after 14 years, would be grossly disproportionate to the gravity of the crime. Instead, it imposed a sentence of life imprisonment without the possibility of remission for 40 years from the date of arrest, along with a fine of Rs 50,000. Failure to pay the fine would result in an additional five years of rigorous imprisonment. New Delhi: With an aim to enhance child protection systems in schools, Delhi govt has relaunched a comprehensive online training course for educators on the Protection of Children from Sexual Offences (Pocso) Act. According to officials, the initiative is designed to equip school staff with a deeper understanding of the legal framework and responsibilities under the Pocso Act . Open to teachers from a wide range of educational institutions—including those under the directorate of education, New Delhi Municipal Council, Municipal Corporation of Delhi, as well as private schools—it aims to build a more informed and vigilant educational community to safeguard children's rights and well-being. The training, developed by the State Council of Educational Research and Training, is available until June 30 on the Diksha-Lead platform. Educators participating in the programme will learn about the structure and provisions of the Pocso Act, gaining critical insights into their role in ensuring student safety. Guwahati/Shillong: The Meghalaya government today decided to revisit the Meghalaya Residents Safety and Security Act (MRSSA) in light of the recent murder of a businessman from Indore in the tourist hotspot Sohra. The aim is to further strengthen the law to better prevent criminal activities carried out under the guise of tourism. This decision reflects our commitment to ensuring the safety and security of residents, while continuing to welcome genuine tourists to our state, Chief Minister Conrad Sangma. The state government on Friday took stock of the situation and resolved to revisit the MRSSA, 2016 to tighten safety mechanisms and close existing gaps. "Yes, the cabinet today decided to revisit the MRSSA, which is already an existing state law, to add more teeth to it in view of what we have just experienced at Sohra and to ensure that we minimise the possibility of criminal elements entering Meghalaya in the guise of tourists," cabinet minister Paul Lyngdoh told reporters. While acknowledging the persistent demand for an inner line permit (ILP), Mr Lyngdoh said the matter now rests with the Union Home Ministry. "As far as the ILP is concerned, let me remind you that the state assembly has already adopted a resolution. The matter is pending before the MHA, which has a number of queries, which we as a state government are trying to address," he said. "Some of these queries relate to the fact that Meghalaya is not an endpoint. We are also connecting the rest of the northeast like Silchar, Mizoram and Tripura," he added. Despite ILP status being uncertain, Mr Lyngdoh emphasised that the state already has safeguards under the MRSSA framework. "If you go through the MRSSA, there is already a lot that is already in place, but we need to upscale and further improve upon what we already have in this law. So we will come up with a formal proposal," he said. On tourism surveillance measures already in place, Mr Lyngdoh said, "We already have a tourism app, which records all movements of tourists, including cars or whatever mode of transport they use, and also compulsory registration of all visitors at homestays, resorts, and hotels. Now, the use of this app is roughly around 50 per cent, but we will now make it compulsory that all homestays, resorts, and other places of accommodation should register all visitors, mandatorily," he said. He underlined the objective of revisiting the Act. "MRSSA is our version of what we would like to do in order to ensure the safety of all residents of Meghalaya. But as I mentioned, we would like now to revisit the act in order to plug whatever loopholes are currently in it, and give it more dynamism and more thrust with whatever has happened at Sohra so that we ensure that we have an atmosphere that is safe and we continue to be tourist friendly." Despite the recent episode, Mr Lyngdoh said tourism activity in Sohra has not been affected. "As we speak, the footfalls at Sohra itself are increasing. There are more and more visitors. Even when the case was still not solved, the footfall was still the same. Now with the name of Meghalaya being vindicated and cleared, we are only seeing a great attraction, more footfall. And we expect that this would touch 20 lakh by the Cherry Blossom Festival." The minister also spoke about improving infrastructure for tourist services. "They're all active. In fact, the one that we have in Shillong will be shifted to the MTC building in order for us to gain more space." To enhance engagement with visitors, the government is preparing to appoint young people under the Tourist Buddy scheme. "We have issued a notice calling for interested young people who are fluent in Khasi, Garo, English, and Hindi, to join the tourist buddy scheme and within the next two months, we should be able to clear the appointment of 100 tourist buddies," Mr Lyngdoh said.
