Judge stops Trump from tying DOT funds to immigration enforcement

June 20 (UPI) -- A federal judge has blocked President Donald Trump's attempt to make federal transportation funding contingent on state compliance with his immigration policies.
In his ruling Thursday, Chief U.S. District Judge John McConnell of Providence, R.I., said not only does the Department of Transportation lack the authority to tie grant funding to immigration enforcement, but the directive also usurps Congress' power of the purse while being "arbitrary and capricious."
"Congress did not authorize or grant authority to the Secretary of Transportation to impose immigration enforcement conditions on federal dollars specifically appropriated for transportation purposes," the President Barack Obama appointee said in his brief ruling.
The ruling came in response to a lawsuit filed by 20 state attorneys general challenging an April 24 directive sent to all Department of Transportation funding receipts, stating they must comply with an Immigration Enforcement Condition when applying for future grants.
The letter specifies that as recipients, they have "entered into legally enforceable agreements with the United States Government and are obligated to comply fully with all applicable Federal laws and regulations," particularly those relating to immigration enforcement and diversity, equity and inclusion policies.
"Adherence to your legal obligations is a prerequisite for receipt of DOT financial assistance," Transportation Secretary Sean Duffy's letter states.
"Noncompliance with applicable Federal laws, or failure to cooperate generally with Federal authorities in the enforcement of Federal law, will jeopardize your continued receipt of Federal financial assistance from DOT and could lead to a loss of Federal funding from DOT."
The 20 Democrat-led states filed their lawsuit against the directive in May, arguing the Department of Transportation has no authority to tie grants to federal civil immigration enforcement, as the two are unrelated.
In his ruling, McConnell agreed with the plaintiffs.
"The IEC, backed by the Duffy Directive, is arbitrary and capricious in its scope and lacks specificity in how the States are to cooperate on immigration enforcement in exchange for Congressionally appropriated transportation dollars -- grant money that the States rely on to keep their residents safely and efficiently on the road, in the sky and on the rails," he said.
"[T]he IEC is not at all reasonably related to the transportation funding program grants."
California Attorney General Rob Bonta applauded the ruling while chastising Trump for "threatening to withhold critical transportation funds unless states agree to carry out his inhumane and illogical immigration agenda.
"It's immoral -- and more importantly, illegal," the Democrat said. "I'm glad the District Court agrees, blocking the President's latest attempt to circumvent the Constitution and coerce state and local governments into doing his bidding while we continue to make our case in court."
Since returning to the White House, Trump has led a crackdown on immigration, with many of his policies being challenged in court.
Late Thursday, an appeals court handed Trump a victory in the battle, permitting California National Guard troops to remain deployed on Los Angeles streets amid protests against his immigration policies.
California Gov. Gavin Newsom has vowed to continue to fight what he called "President Trump's authoritarian use of U.S. military soldiers."

Twenty states sued after they said Transportation Secretary Sean Duffy threatened to cut off funding to states that refused to comply with President Donald Trump's immigration agenda. U.S. District Judge John McConnell Jr. barred federal transportation officials from carrying out that threat before the lawsuit is fully resolved. 'The Court finds that the States have demonstrated they will face irreparable and continuing harm if forced to agree to Defendants' unlawful and unconstitutional immigration conditions imposed in order to receive federal transportation grant funds,' wrote McConnell, the chief judge for the federal district of Rhode island. 'The States face losing billions of dollars in federal funding, are being put in a position of relinquishing their sovereign right to decide how to use their own police officers, are at risk of losing the trust built between local law enforcement and immigrant communities, and will have to scale back, reconsider, or cancel ongoing transportation projects.' On April 24, states received letters from the Department of Transportation stating that they must cooperate on immigration efforts or risk losing the congressionally appropriated funds. No funding was immediately withheld, but some of the states feared the move was imminent. Attorneys general from California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, Oregon, Rhode Island, Washington, Wisconsin and Vermont filed the lawsuit in May, saying the new so-called 'Duffy Directive' put them in an impossible position. 'The States can either attempt to comply with an unlawful and unconstitutional condition that would surrender their sovereign control over their own law enforcement officers and reduce immigrants' willingness to report crimes and participate in public health programs — or they can forfeit tens of billions of dollars of funds they rely on regularly to support the roads, highways, railways, airways, ferries, and bridges that connect their communities and homes,' the attorneys general wrote in court documents. But acting Rhode Island U.S. Attorney Sara Miron Bloom told the judge that Congress has given the Department of Transportation the legal right to set conditions for the grant money it administers to states, and that requiring compliance and cooperation with federal law enforcement is a reasonable exercise of that discretion. Allowing the federal government to withhold the funds while the lawsuit moves forward doesn't cause any lasting harm, Bloom wrote in court documents, because that money can always be disbursed later if needed. But requiring the federal government to release the money to uncooperative states will likely make it impossible to recoup later, if the Department of Transportation wins the case, Bloom said.

Rep. Al Green (D-Texas) is urging senators to rename the Russell Senate Office Building on Capitol Hill because of former Sen. Richard Russell's history of opposing civil rights and avowing white supremacy. 'Throughout his career, Senator Russell engaged in constant lobbying on behalf ofopponents to Civil Rights,' Green wrote in a letter to senators Thursday about the Georgia Democrat who died in 1971. 'Perhaps most telling of his beliefs, during a lengthy filibuster against anti-lynching legislation, Senator Russell professed a willingness to uphold 'white supremacy in the social, economic, and political life of our state.'' 'His public assertions, including ones that declared America 'a white man's country' and his outspoken opposition to 'political and social equality with the Negro,' further underscored his divisive ideology,' Green added. Russell, who was Georgia's governor for two years in the 1930s, held his Senate seat for nearly four decades until his death. Green asked senators to revert to using the name 'Old Senate Office Building' for the structure built in the early 1900s that 33 senators and five committees currently occupy. It was named in honor of Russell the year after he died. 'It has long past time to remove this insult to people of goodwill from a building paid for and maintained with public funds,' Green wrote. 'The notion that the Senate cannot agree on a new permanent name does not prevent the Senate from reverting to the previous name, which was 'The Old Senate Office Building,' until a new permanent name is approved.' Green sponsored a House resolution in 2020 urging senators to change the name, but the effort was opposed by the then-Republican senators from Georgia. 'Renaming the Russell Senate Office Building is a powerful step in rejecting Russell's legacy rooted in racial division and oppression,' Green said in a statement on his renewed push. Georgia Democratic Sens. Jon Ossoff and Raphael Warnock both took office in 2021. Warnock is the state's first Black senator, and Ossoff is the first Jewish senator from Georgia. Ossoff and Warnock's offices didn't immediately respond to The Hill's request for comment on whether they support the change.
