Officials defend use of National Defense Areas along New Mexico's southern border
NEW MEXICO (KRQE) – The feds have made new military zones along the southern border a core piece of their strategy, cracking down on immigration, now New Mexico's top federal prosecutor is explaining and defending how the areas are being used.

Despite saying they've faced criticism about the 'National Defense Areas' being a waste of time and having little effect on illegal immigration, prosecutors said it's still an important tool they're not walking away from. 'Border security is National security, it is every nation's fundamental right and indeed it's responsibility to know exactly who and what is coming across our borders,' said District of New Mexico U.S. Attorney Ryan Ellison.
'The message is: regardless, you're still getting removed. We're going to still bring them. We may win on them, we may not, but regardless, at the end of the day, you are not going to be allowed to stay, if you enter the country illegally,' said Justin Simmons, Assistant U.S. Attorney, West Texas.
There are now two National Defense Areas covering a 170-mile stretch of New Mexico and Texas along the southern border. The areas allow US military personnel to work alongside border patrol to prevent illegal border crossings, meaning anyone caught trespassing could face military prosecution, in addition to illegal immigration charges.
Prosecutors emphasized Wednesday that these areas and the increase in charges will take power away from Mexican cartels. 'Our goal, to be clear, is not just about illegal immigration. It is total eradication of drug cartels. And like it or not, illegal immigration feeds the wolf, that are Mexican drug cartels,' said Simmons.
Ellison also noted Wednesday the high number of repeat crossers and that moving forward, they should have an easier time convicting people who keep trying to cross the border. That's because anyone caught in the newer NDA's has to sign paperwork acknowledging what they did.
US Attorney Ellison also said around 500 people have already been charged in New Mexico under the newer National Defense Areas, about five times the number of people they'd charged in early May.

Riverdale man charged with sexually assaulting, giving alcohol to underage teen, documents say
Charges are allegations only. All arrested persons are presumed innocent unless and until proven guilty beyond a reasonable doubt. RIVERDALE, Utah () — A 28-year-old man has been charged with sexually assaulting an underage teenage girl after giving her alcohol. Kyle Anthony Hird, 28, has been charged with two felony counts of unlawful sexual conduct with a 16/17-year-old and one misdemeanor charge of knowingly offering alcohol to a minor. According to documents, a juvenile victim contacted police on Feb. 3, 2025. She told officials that someone she knew from work, Hird, had invited her to his residence the night before. There, he gave her alcohol and sexually assaulted her, and she did not consent but 'was too intoxicated to stop' him. Daycare employee charged with sexually abusing children, documents say Using the victim's Snapchat, a Riverdale City Police officer contacted Hird and asked what had happened the night before. Hird allegedly responded that he would only speak about the incident in person, saying, 'Please understand I cannot get in trouble for anything, my kids can't [lose] their dads and s–.' Police located and interviewed Hird regarding what happened. He allegedly denied providing the minor victim with alcohol and said that no sexual contact had happened. However, Hird did acknowledge that he was aware of her age. A search warrant for Hird's DNA was filed and approved. On June 11, 2025, the forensic report from a Code R Kit (used to test for sexual assault) performed on the victim provided 'very strong support' that Hird's DNA was a match. Hird has been booked into the Weber County Jail and is currently being held without bail. Former officer in DWI scheme relinquishes certification
ALBUQUERQUE, N.M. (KRQE) – On Thursday, a former Albuquerque Police Officer at the center of the DWI corruption scheme was officially stripped of his certification. KRQE Investigates sat in on the meeting with the Law Enforcement Certification Board. They voted unanimously to accept Montaño relinquishing his law enforcement certification, rather than revoking it. The LECB went into a closed session for three hours during the meeting to discuss officer discipline matters, including Montaño's. Neither KRQE nor members of the public could hear that part of the meeting. When the board members returned to the open meeting, it was a short vote with neither Montaño nor his attorney there for the formality. Montaño started working for the City of Albuquerque as a Police Service Aide in 2005 before becoming a sworn officer in 2007. He worked in APD's DWI unit from 2015 through 2024. The former officer was also highlighted in a case KRQE Investigates reported on last year, where Montaño was shown using a DWI suspect's bracelet to connect the driver with a defense attorney's office — who then offered a guaranteed case dismissal for a price. Montaño is the first officer connected to the scheme to be officially stripped of his certification.
