U.S. Supreme Court rules Wisconsin law makes Catholic Charities exempt from unemployment system

In a unanimous decision, the U.S. Supreme Court ruled Thursday that a Catholic Charities organization in Wisconsin doesn't have to take part in the Wisconsin unemployment insurance (UI) system.
The ruling overturns a 4-3 Wisconsin Supreme Court decision issued in March 2024 that declared the work of Catholic Charities Bureau Inc. of the Superior Diocese of the Catholic Church doesn't get a pass from Wisconsin's UI law on religious grounds.
The Wisconsin ruling, written by Justice Anne Walsh Bradley, declared that the Catholic Charities work is 'secular in nature' and that the agency and its subsidiary organizations that took part in the case 'are not operated primarily for religious purposes' as defined in the UI law's religious exemption.
In Thursday's ruling, Justice Sonya Sotomayor wrote for the Court that arguments the Wisconsin high court majority made amounted to making preferences of one religious denomination over another.
Her ruling noted that the church offers its own unemployment compensation program for laid-off workers and dismissed the suggestion that the organizations were 'more likely to leave their employees without unemployment benefits.'
The Wisconsin ruling held that the agencies' work was not religious in nature because they didn't attempt to preach the Catholic faith to participants and did not serve only Catholics.
'Petitioners' Catholic faith, however, bars them from satisfying those criteria,' Sotomayor wrote. The ruling quoted from the dissent by Justice Rebecca Bradley in the Wisconsin decision.
'Wisconsin's exemption,' Sotomayor wrote, 'as interpreted by its Supreme Court, thus grants a denominational preference by explicitly differentiating between religions based on theological practices. Indeed, petitioners' eligibility for the exemption ultimately turns on inherently religious choices (namely, whether to proselytize or serve only co-religionists).'
The Wisconsin UI law exempts all churches, church conventions or church associations 'without differentiating between employees actually involved in religious works' and those who are not, Sotomayor wrote.
Justice Clarence Thomas, while joining in the unanimous opinion, wrote a separate concurrence stating that because the Wisconsin ruling did not defer to the Bishop of Superior's assertion that Catholic Charities and its affiliates are 'an arm of the Diocese, the Wisconsin Supreme Court violated the church autonomy doctrine.'
In a separate concurrence Justice Ketanji Brown Jackson signaled how states could ensure that nonprofit employees of religiously associated organizations are covered by UI — by focusing on the work involved rather than its underlying motivations to determine who is and who is not exempt.
When the federal law was revised in 1970 to include nonprofit employees in state UI programs, Congress exempted certain church-affiliated employees. The goal, Jackson wrote, was to avoid the state getting involved in a dispute 'over the sufficiency of a fired employee's prayers or the accuracy of their scriptural teaching.'
The intent of Congress was to exempt 'a narrow category of church-affiliated entities' that could produce such an entanglement 'precisely because their work involves preparing individuals for religious life,' Jackson wrote.
She concluded: 'It is perfectly consistent with the opinion the Court hands down today for States to align their [federally-based] religious-purposes exemptions with Congress's true focus.'

ALBANY – Assembly Speaker Carl Heastie torpedoed a bipartisan bill that would have commemorated the horrific Oct. 7, 2023 attack on Israel. The Bronx pol went to extraordinary lengths Friday to ensure that the measure would not make it to the Assembly floor for a vote, stacking a committee with compliant Democratic allies who'd vote to scuttle it, sources said. The bill, sponsored by Republican Assemblyman Lester Chang, would have enshrined Oct. 7 alongside other days of commemoration in the Empire State, such as 'Rosa Parks Day' and 'Susan B. Anthony Day.' Advertisement 4 Heastie took extraordinary measures to make sure the bill wouldn't pass the Assembly floor for a vote. Getty Images Sources suggested that Heastie, the most powerful Democrat in the Assembly, likely didn't want a bill with a Republican as its primary sponsor reach the floor for a vote — even though a number of Dems co-sponsored it. The four members included one Jewish lawmaker and another who res a district with a significant Jewish population, as well as Assemblywoman Rodneyse Bichotte Hermelyn (D-Brooklyn), would've voted against killing it, her spokesperson said. But the spokesperson noted that Bichotte Hermelyn would've preferred the bill had a Democratic sponsor. Advertisement Chang said that he'd be willing to let a Democrat take over as the bill's sponsor if it meant passing it. Substitutions on committees aren't unheard of, but the maneuver is usually made to spare a member from making a tough vote or when leadership expects some of its members to vote out of line, as happened Friday. Several Democrats – Assemblymembers Ed Braunstein, William Colton, Jeffrey Dinowitz, Nily Rozic, Rebecca Seawright, and Amanda Septimo and David Weprin, who are all from New York City – broke from their party to support the commemoration bill. Advertisement 'No one should use Oct. 7th as a political pawn. We owe the 56 hostages and their families more than that,' Rozic said. The sudden switcheroo on the commemoration bill committee came after Heastie also put the kibosh on a resolution honoring Palestinian Americans, sponsored by lefty Assemblywoman Emily Gallagher (D-Brooklyn), earlier this week. Tens of thousands of such resolutions are passed by the Assembly every year, and are usually not controversial. 4 The bill would've made Oct. 7 enshrined alongside other days of commemoration in the Empire State, such as 'Rosa Parks Day' and 'Susan B. New York State Assembly Advertisement A copy of the draft resolution obtained by The Post indicates it would have read that 'Palestinian Americans in New York are increasingly involved in advocacy, activism, and civil rights work, particularly related to Middle Eastern issues, anti-racism, and immigrants.' Sources said Heastie allowed the resolution onto the floor with strict instructions for Gallagher to keep her remarks specific to it, meaning he didn't want her to opine on the Israel-Gaza war. But Heastie caught wind that that Republicans were going to call for a roll call vote — meaning every member would have to be recorded as voting in support or against her resolution — a highly unusual, if not totally unheard of move, sources familiar with the backroom dealings said. WASHINGTON (AP) — The Supreme Court will consider making it harder for convicted murderers to show their lives should be spared because they are intellectually disabled, according an order released early on Friday after an apparent technological glitch. The justices' action comes in an appeal from Alabama, which is seeking to execute Joseph Clifton Smith. He was sentenced to death for killing a man in 1997. Lower federal courts found Smith is intellectually disabled and thus can't be executed. When it's argued in the fall, the case could be the first in which the Supreme Court cuts back on its 23-year-old landmark ruling that barred the death penalty for people who are intellectually disabled. At issue is what happens in borderline cases, when scores on IQ tests are slightly above 70, which is widely accepted as a marker of intellectual disability. In 2014 and 2017, the court somewhat eased the burden of showing intellectual disability in those cases. It's the second time in about a year that an online error resulted in an early release from the high court. An opinion in an abortion case was accidently posted on its website a day early in June 2024. The court's landmark opinion overturning abortion as a constitutional right also went out early, though those circumstances were different because the case was leaked. This time, the court released a set of orders set for Monday after an 'apparent software malfunction' sent out early notifications.
