Booze for NYC outdoor dining gets green light after fears restaurants would be dry for summer

It's bottoms up after all.
New York restaurants with 'conditional approvals' for outdoor dining will be able to get liquor licenses, the city announced Wednesday — ending fears it would be a boozeless al fresco season for most Big Apple eateries.
The State Liquor Authority had required restaurants already have an outdoor dining permit before they could even apply for a liquor license — but a massive backlog of al fresco dining applications under a new city policy created chaos this year.
Only seven outdoor liquor licenses had been granted out of 3,000 restaurants hoping to offer outdoor dining this year, many of them with conditional approvals for al fresco while the city worked through the backlog
'We are pleased that the State Liquor Authority worked closely with us to also allow businesses that have received conditional approval to serve alcohol while their applications remain under review,' the DOT said in a statement shared with The Post.
'We applaud their decision, which benefits restaurants and all New Yorkers who love outdoor dining.'
The NYC Hospitality Alliance, which represents the city's restaurant and nightlife industry, also praised the decision, with executive director Andrew Rigie calling it a 'reasonable process that ensures outdoor dining remains uninterrupted for restaurants, workers, and New Yorkers and visitors.'
Since the DOT began reviewing applications in March 2024, it has fully approved just 47 restaurants.
The agency has blamed its hundreds of outdoor dining permits in limbo on the city's mew 'cumbersome' and convoluted process for outdoor dining approvals – which include approvals from the DOT, local community board and city comptroller's office.
For sidewalk dining, that process also requires a thumbs-up from a local council member.
The process became so drawn out that the DOT began doling out the 'conditional' licenses in February.
The estimated 600 roadway dining setups and nearly 1,850 sidewalk setups were operational by April 1 'thanks to NYC DOT's efforts to cut red tape by granting conditional approvals,' the agency said last month.
More conditional approvals are expected for restaurants in the coming weeks, the DOT added, though it's unclear when full approvals will be issued.

NEW YORK — A new poll shows the race for New York City comptroller tightening, with Justin Brannan narrowing the gap in a contest still led by Mark Levine. And with less than two weeks until the Democratic primary, nearly half of New Yorkers remain undecided in the race to be the city's top fiscal watchdog, according to the poll Brannan's team commissioned and shared in full with POLITICO. It was conducted by Public Policy Polling, and queried 573 likely primary voters between June 6 and 7, with a 4.1 percent margin of error. Levine, the Manhattan borough president, led Brannan — the City Council finance committee chair — 30 percent to 19 percent among likely Democratic voters, according to the poll. That same survey showed state Assemblymember Zohran Mamdani leapfrogging Andrew Cuomo in the Democratic mayoral primary. The 11-point gap was smaller than a May 27 survey from Honan Strategy Group that had Levine at 38 percent and Brannan at 13 percent, a shift that left the Brooklyn lawmaker's team feeling bullish. Both surveys found 44 percent of likely voters undecided. 'A race that was once considered locked up is now anything but,' Brannan campaign adviser Alyssa Cass wrote in a campaign memo shared with POLITICO. 'As nearly half the electorate remains undecided, Brannan is the candidate with the most room to grow and the clearest path to an upset.' Brannan's team believes the tides will continue to shift in his favor. They cited the smaller gap that came after 10 days of going on air with a television ad along with a niche stat from their poll: Of voters who had seen Brannan's ads, they preferred him 40 percent to 37 percent. Those viewers, however, made up a small slice of the electorate at 23 percent. And it was unclear how many of those people knew of Levine or his campaign. Levine's camp countered that the polls have consistently shown him ahead of Brannan by double digits. And they touted the endorsement Wednesday night of a major municipal labor group. 'Mark has all the momentum in this race. We just earned the endorsement of the United Federation of Teachers, representing hundreds of thousands of NYC public school educators — adding to the 180-plus elected officials, faith leaders, labor unions and community groups backing our campaign,' Campaign Manager Matt Rubin said in a statement. 'Right now, we're focused on connecting with New Yorkers where they are — on the streets, at subway stops and at their doors.' A person on Levine's team also took issue with the survey methodology, suggesting it over sampled Brannan's home borough of Brooklyn — especially with affluent voters — and under sampled Black voters Levine is doing better with. The Public Policy Polling showed few New Yorkers have barely tuned into the contest: More than half of those surveyed had no opinion about the favorability of the two candidates, and around half of the likely Democratic primary voters had not seen an ad for either. Brannan and Levine were the only two comptroller candidates to qualify for a pair of televised debates, which mainly showcased how little they differ on policy. During their first meeting, they engaged in several back-and-forths over President Donald Trump and New York City Mayor Eric Adams, but had a conspicuous aversion to talking about Andrew Cuomo, who at the time had been leading the mayoral Democratic primary in every poll.

Peter Oberacker on Wednesday called on the state Senate Investigations and Government Operations Committee to launch a full-scale investigation into the practices of utility companies such as New York State Electric & Gas. 'Families in my district are being hit with $3,000 bills and unauthorized withdrawals of nearly $1,000 without warning,' Oberacker said in a news release. 'This isn't just bad billing — it's borderline criminal and we need answers.' Oberacker cited the case of a constituent in Unadilla who, he said, received a $3,000 bill and another constituent whose monthly NYSEG auto-pay of $150 suddenly jumped to a $980 withdrawal with no notice. Oberacker specifically questioned the link between the dramatic cost increases and the rollout of so-called 'smart meters' and pushed for reforms to increase transparency and accountability, the release stated. Among Oberacker's proposed solutions were: • A full investigation by the Senate Investigations Committee • Mandatory, fully itemized utility bills showing supply, delivery, taxes and surcharges clearly • Clear labeling of estimated bills and procedures for correction • A ban on utility companies passing along lobbying and public relations costs to ratepayers 'New Yorkers aren't asking for favors. Bankrupt 23andMe is facing a lawsuit over its plans to sell customer genetic information. Twenty-seven states and the District of Columbia took legal action this week against 23andMe in the U.S. Bankruptcy Court for the Eastern District of Missouri, the court overseeing the Chapter 11 bankruptcy proceedings that the genetic testing company entered earlier in the year. 23Andme Files For Bankruptcy As California Ag Urges Customers To Delete Data The states contend 23andMe has "no right to sell their customers' genetic identities to the highest bidder" unless the company "first obtain[s] express informed consent to the proposed transaction/transfer by each consumer impacted." They want the bankruptcy court to rule on "whether and to what extent" the genetic testing company can "sell and transfer to a third party such intimate customer data without first obtaining the express informed consent of its customers," according to the filing. "The sale is permitted under 23andMe privacy policies and applicable law," the spokesperson said. "We required any bidder to adopt our policies and comply with applicable law as a condition to participating in our sales process. Customers will continue to have the same rights and protections in the hands of the winning bidder." The remaining bidders, Regeneron Pharmaceuticals and TTAM Research Institute, "have committed to abide by 23andMe privacy policies, and will continue to operate 23andMe as it has always been operated," according to the 23andMe spokesperson.
