Ex-KL Tower operator loses bid to cite minister for contempt

The Kuala Lumpur High Court dismissed Hydroshoppe Sdn Bhd's bid to bring contempt proceedings and secure an injunction against the government and LSH Service Master Sdn Bhd with costs of RM65,000. (Envato Elements pic) KUALA LUMPUR : The High Court here has dismissed an attempt by the former operator of KL Tower to initiate contempt proceedings against communications minister Fahmi Fadzil and seven others, including federal territories land and mines director general Azmi Mohd Zain. Justice Roz Mawar Rozain ruled that the plaintiffs – Hydroshoppe Sdn Bhd and Menara KL Sdn Bhd – failed to establish the commission of acts by the defendants that disrupted the administration of justice or court proceedings. 'The plaintiffs' lease expired on May 31 and (the government, named as a defendant in the proceedings) is entitled to retake possession,' the judge said when handing down her decision. Roz Mawar added that LSH Service Master Sdn Bhd, LSH Best Builders Sdn Bhd, and Service Master (M) Sdn Bhd, also named as defendants, came in subsequently under a new concession agreement. She ordered Hydroshoppe and Menara KL to pay a total of RM25,000 in costs to the government and LSH Service Master. The court also dismissed an injunction application filed by Hydroshoppe against the government and LSH Service Master, holding that it had been rendered academic. The judge ordered Hydroshoppe to pay the government and LSH Service Master an additional sum of RM40,000 as costs over the dismissal of the injunction. The court will hear the bids by the government and LSH Service Master to strike out Hydroshoppe's lawsuit on July 14. Hydroshoppe and Menara KL filed the suit claiming that the LSH group had induced the commission by the government of a breach of contract. They asked the court to declare the award of the KL Tower concession to LSH Service Master void and unlawful. They also sought an estimated RM1 billion in damages, and for the concession to be transferred back to them. Lawyer Vinayak Sri Ram appeared for Hydroshoppe while senior federal counsel appeared for Fahmi and lawyer Malik Imtiaz Sarwar represented LSH Service Master.

Telcos reassure public no personal data shared with MCMC

CelcomDigi, U Mobile, Telekom Malaysia and Maxis stress that only anonymised data — without any personally identifiable information — will be shared with MCMC. (Freepik pic) PETALING JAYA : Telco companies have reaffirmed their commitment to protecting customer data following the sharing of mobile phone data (MPD) for official statistical purposes with the Malaysian Communications and Multimedia Commission (MCMC). In separate statements, CelcomDigi, U Mobile, Telekom Malaysia and Maxis stressed that only anonymised data — without any personally identifiable information — will be shared with MCMC. CelcomDigi emphasised its strict adherence to existing data protection laws, including the Communications and Multimedia Act and the Personal Data Protection Act, adding that customer trust remains at the core of its operations. The telco acknowledged the ongoing discussions and concerns raised by the public over the MCMC initiative and said it is working closely with the commission to support the government's efforts without compromising the integrity of customer data. 'At all times, we operate under tight security protocols and in compliance with the relevant data protection laws and regulations, with stringent limitations on any personal identifiable information,' it said. U Mobile, meanwhile, affirmed that customer data and privacy are its top priority, with policies and processes in place to ensure any shared data is anonymised, aggregated and fully compliant with applicable data protection laws and regulations. 'We are aware of the objectives of the initiative and are committed to working with MCMC in a manner that upholds the highest standards of data governance,' it said. It noted that when the company does share its mobile phone data, at no point will personally identifiable information be revealed or processed. U Mobile remains committed to safeguarding customer privacy and ensuring full regulatory compliance in all aspects of data management, it added. TM also clarified that the mobile phone data submitted to MCMC is fully anonymised and does not contain any personally identifiable information. Data submission is carried out under strict governance and security protocols, with full compliance to applicable company policies as well as national laws and regulatory requirements, it said in a statement. 'TM remains fully committed to safeguarding the safety and privacy of customer data with responsibility and integrity,' it noted. Meanwhile, Maxis also said MCMC will have no access to personally identifiable information at any stage. It added that controls and processes are in place to ensure customers' personal data will not be compromised. 'All data is anonymised by Maxis and processed in an aggregated manner within a secure environment, in full compliance with the Personal Data Protection Act 2010,' it said in a statement. 'Maxis remains fully committed to protecting the data of all our customers.' On Friday, MCMC clarified that its collection of mobile phone data from mobile network operators does not involve the access, processing or disclosure of any personally identifiable information. MCMC said the mobile phone data will be used strictly to generate official statistics to support evidence-based policymaking in the information and communications technology (ICT) sector and the tourism sector. Earlier today, communications minister Fahmi Fadzil assured the public that MCMC is not collecting any personal information from telecommunications companies. He said MCMC's request for phone companies to hand over data on all mobile phone calls, made from January to March, is a Cabinet decision aimed at collecting data for the statistics department, with the goal of creating better policies and plans.

Cabinet to decide on cannabis-linked vape production by US firm, says Dzulkefly

According to an investor presentation in Las Vegas in April, Ispire Technology Inc produces 'mainly cannabis-related products' in its Malaysian manufacturing facility. (LinkedIn pic) KUALA LUMPUR : The fate of a US-based vape manufacturer producing cannabis-related products in Malaysia will be decided by the Cabinet, says health minister Dzulkefly Ahmad. Speaking on the sidelines of the APHM International Healthcare Conference & Exhibition 2025, Dzulkefly said the issue involving Ispire Technology Inc would require the input of several ministries and government agencies. 'I will have to present (the matter) to the Cabinet. From there, we will decide on a stance. 'Several bodies are involved in this issue such as the investment, trade and industry ministry, the Malaysian Investment Development Authority, and the domestic trade and cost of living ministry,' he told reporters. Health think tank CodeBlue recently reported that Ispire, which produces nicotine and cannabis-related vaping products, had said that its devices were used by clients to fill cartridges with cannabis oils in global markets. According to an investor presentation in Las Vegas in April published on YouTube on May 6, Ispire produces 'mainly cannabis-related products' in its Malaysian manufacturing facility, which has up to seven production lines. In a statement last week, the health ministry confirmed that the government had issued Ispire an interim nicotine manufacturing licence to produce e-cigarettes with nicotine in its plant in Johor, together with local council approval. However, CodeBlue noted that the ministry's June 2 statement did not mention the plant's production of cannabis vaporisers, which reportedly began in February 2024. On June 5, Kuala Langat MP Dr Ahmad Yunus Hairi called for a police investigation into the vape factory's operations. GP consultation fee revision Separately, Dzulkefly said his ministry had submitted its plans to the National Action Council on Cost of Living to address the long-standing issue of revising general practitioner (GP) consultation fees. 'The council has requested that the matter be brought to its executive committee, which is chaired by deputy prime minister Ahmad Zahid Hamidi. 'There is no fixed date for discussions yet, but it will be soon,' he added. Yesterday, the Medical Practitioners Coalition Association of Malaysia (MPCAM) warned the government against deregulating GP consultation fees without setting a minimum rate. MPCAM president Dr Soo Tai Kang said such a move would lead to unhealthy competition in the industry, particularly in urban areas where 80% of GP clinics operate and depend heavily on panel patients. Soo said MPCAM supported setting consultation fees at between RM50 and RM80, with reviews every three years. On June 5, the Malaysian Medical Association called on the government to approve a long-pending increase in GP consultation fees, warning that delays threatened the survival of primary care clinics nationwide. Dzulkefly said on May 3 that the matter would be resolved 'within one month', and that a Cabinet memorandum and circular had already been prepared.
