
Former NY gov David Paterson sues brother for stealing $7 m

Ex-New York Gov. David Paterson is accusing his brother of cheating him out of his inheritance — by allegedly tricking their elderly mother into giving him over $7 million before her death.
A bombshell lawsuit filed by the former governor claims his younger brother Daniel Paterson, 67, duped mom Portia into transferring the massive sum from her estate to his account through 'undue influence, coercion and excessive persuasion.'
The sneaky move allowed Daniel and his attorney wife Eloise to bypass a long-standing will ordering the brothers to split their mom's estate 50-50 — cheating David, 71, out of some $3.5 million, the Manhattan Supreme Court suit alleges.
'She divested herself of assets in excess of $7 million by transferring [the] same to defendants prior to her death in contradiction and contravention of her long-standing last will and testament,' the court documents, filed Monday, state.

Then, after 94-year-old Portia Paterson's death in July, Daniel allegedly tried to claim that their mom died with less than $30,000 to her name in a checking account and an 'inoperable' BMW, the suit alleges.
The 55th Governor — a Democrat who was in office between 2008-2010 — is suing his brother, sister-in-law and two nephews for his alleged at least $3.5 million share of Portia's estate.
'There was a conspiracy to conceal that Portia's assets were transferred before her death,' said the former gov's attorney, Paul W. Siegert. 'She had a huge estate.

'Everybody kept it a secret,' Siegert said, 'then we found out about it.'
Daniel, who has worked for the state court system's office of diversity and inclusion, told a reporter that 'this must be a scam call' when reached by phone Tuesday, and quickly hung up. He did not return repeated messages asking for comment.
Portia Paterson was married for 61 years to Basil Paterson, who was the first black vice chair of the National Democratic Party, and the first black secretary of state of New York.

She was a longtime school teacher at P.S. 116 in Jamaica, a guidance counselor at Queens College, and was a known advocate for disabled students like her son David, who is legally blind.
The ex-gov claims he only learned about the alleged 'unjust enrichment' last month after Daniel filed an affidavit to settle his mother's estate in surrogate's court.
David's attorney then said he got a notice from the court, leading to the shocking discovery that his brother was claiming their late mother only had a $27,000 bank account and an 'inoperable' 2011 BMW 5-series valued at $2,000.
On top of that, the affidavit claimed $8,500 in funeral expenses to be subtracted from the estate.
That means the former governor's share of what was once his mother's sizable estate would be a mere $10,250.

'Even Portia's lawyer of 30 years – who wrote her will – did not know that Portia had transferred $7,000,000 in assets,' Siegert said.
Daniel, the executor of Portia's estate, allegedly never even notified her estate lawyers of her death, Siegert claimed.
'How could she die in July of 2024, and we only find out almost a year later that her will was not being probated and then out of the blue, we get a notice from the surrogate's court that her net estate is $21,500,' the attorney said.

Norfolk Commonwealth's Attorney's race: Fatehi holds off strong challenge from Butler
NORFOLK — Incumbent Ramin Fatehi held off a spirited challenge Tuesday from John Butler to win the Democratic nomination for the city's commonwealth's attorney. Late Tuesday night, Fatehi had a decisive lead over Butler of 52% to 48% of the vote. Butler called Fatehi to concede. Butler, a former federal prosecutor, had the support of several of Norfolk's top Democratic leaders, including Mayor Kenny Alexander, Sheriff Joe Baron, Treasurer Daun Hester, Commissioner of the Revenue Blythe Scott, and City Council members Courtney Doyle, Jeremy McGee and Tommy Smigiel. Among those endorsing Fatehi were U.S. Rep. Bobby Scott, Virginia House Speaker Don Scott, former state Attorney General Mark Herring, former school board members Rodney Jordan and Yvonne Wagner, and former councilmen Andy Protygou and Paul Riddick. Both candidates raked in record amounts in donations and in-kind contributions. As of the latest campaign finance filing deadline, Butler reported $742,000 in contributions, while Fatehi collected around $870,000 in cash and in-kind contributions since he took office in 2022. Butler's top contributors were some of the city's most powerful lawyers and business leaders, while Fatehi's main source of campaign income came from three liberal super PACs largely funded by billionaire George Soros, as well as loans from himself. Butler said he was encouraged to run by city leaders who were unhappy with the job Fatehi had been doing. He pointed to multiple instances of plea deals being rejected by judges for being too lenient, murder cases ending in acquittals or dismissals, and dozens of prosecutors resigning after Fatehi took over as reasons for needing a new leader. Fatehi said he stood by his record and the work of his staff. Violent crime in the city is down 40%, property crime down 27%, and the jail's population has been cut in half, he said. New York Dem accused of ‘staged' arrest after being released by federal authorities within hours
New York City Comptroller Brad Lander, a Democrat, has been released after being held for only a few hours for allegedly assaulting an immigration official on Tuesday. While Lander, who is running for mayor of New York City, is now being held up as a hero by many progressives, some say his arrest was more political theater than activism. Joe Borelli, a former New York City councilman and GOP political operative, told Fox News Digital that he believes Lander's arrest was a "staged event." "Election day is a week from today, and early voting has begun. Make no mistake, the purpose was to get the headlines that he's getting," said Borelli. "It's instant name recognition and establishing even stronger liberal bona fides." "I will let go when you show me the judicial warrant," Lander said in the video. "Where is it? Where is the warrant?" Hours later, Lander walked out of the federal courthouse where he was being held. New York Gov. Kathy Hochul said during a news conference outside the courthouse that the charges against Lander had been dropped, though the U.S. Attorney's Office for the Southern District of New York said it is "continuing to investigate" Lander's actions. In response to the incident, a DHS spokesperson said, "Our heroic ICE law enforcement officers face a 413% increase in assaults against them—it is wrong that politicians seeking higher office undermine law enforcement safety to get a viral moment." "No one is above the law, and if you lay a hand on a law enforcement officer, you will face consequences," said the spokesperson.
