Gerik Crash: JPJ Finalising Investigation For Legal Action Against Bus Company Operator

BUTTERWORTH, June 20 (Bernama) -- The Road Transport Department (JPJ) is finalising the investigation papers for action to be taken in court against the bus company operator involved in the accident that claimed the lives of 15 Universiti Pendidikan Sultan Idris (UPSI) students
Its director-general, Datuk Aedy Fadly Ramli said the investigation is now in the final stages before being handed over to the Deputy Public Prosecutor to decide on the charge recommendation.
"There are two investigation papers that we are preparing (to take action) against the company operator and also the company that leased the bus.
"The investigation papers are still at the JPJ level and we expect to hand them over to the prosecution soon," he said at a press conference after officiating the Penang-level MyLesen B2 Driving Licence Handover Ceremony here today.
Previously, Transport Minister Anthony Loke Siew Fook had said that the JPJ would open an investigation paper against the bus company involved in the accident that claimed the lives of 15 UPSI students due to the company's failure to operate according to the stipulated rules and regulations.
Regarding the allegation that the JPJ could not record the bus company's operator's statement because he suffered a heart attack, Aedy Fadly said his side was not informed about the matter.
"He (the bus operator) had a heart attack, it has nothing to do with the JPJ and I have not received any reports saying otherwise. We will still take action; if he goes to the hospital we will wait," he added.
In the incident on June 9, 15 UPSI students died when the bus they were in overturned in an accident at KM53 of the East-West Highway (JRTB), near Tasik Banding, Gerik.
The bus carrying 42 university students was travelling from Jertih, Terengganu to the university's main campus in Tanjung Malim, Perak when it collided with a Perodua Alza before overturning.

BUTTERWORTH: The Road Transport Department (RTD) will audit 500 public service vehicle (PSV) and goods commercial vehicle operators deemed high-risk under its special enforcement strategy, "RTD Inspection and Safety Audit" (JISA), starting Monday. RTD director-general Datuk Aedy Fadly Ramli said the identified high-risk operators include 300 lorries, 100 tour buses and 100 express buses. He said operators with outstanding summonses were identified through lists compiled by the RTD and the Land Public Transport Agency (Apad). He said the main focus of the special operation is to assess companies' compliance with safety aspects, vehicle maintenance, driver management, and records under the Road Transport Act 1987 and related regulations. "The enforcement of the JISA special operation involves inspection reports and safety audits focusing on compliance with the Industry Code of Practice (ICOP) concerning safety in the transport industry. "It also allows for the checking and resolution of outstanding summonses by vehicle owners and drivers, as well as compliance with vehicle technical specifications," he told reporters after the MyLesen B2 Driving Licence handover ceremony here today. Aedy Fadly said the audit was initiated following the bus crash that claimed the lives of 15 Universiti Pendidikan Sultan Idris (UPSI) students on June 9, along with several other recent accidents involving heavy vehicles. He said RTD would take strict action against any operators found violating regulations or neglecting safety, including issuing offence notices, suspending or revoking vocational driving licences (PSV/GDL), or operator licences. "This measure is part of RTD's ongoing efforts to enhance road safety and further strengthen the integrity of the national transport system," he added.

He said this was evident in the trust placed by the US in PDRM's expertise to carry out the rehabilitation of two Malaysian detainees previously held at Guantanamo Bay, Cuba. 'This shows that in this particular case, the PDRM's Special Branch possesses expertise and competence that convinced a major power like the United States. 'It means we can stand as equals in efforts to address terrorism threats so they do not pose a danger within our own country,' he said during the handover ceremony of the Inspector-General of Police (IGP) post at the Police Training Centre (Pulapol) here today. Media reports previously stated that the US had repatriated two Malaysian citizens in December 2024, after they had been detained at Guantanamo Bay for 18 years. The two individuals involved, Mohammed Farik Amin, 49, and Mohammed Nazir Lep, 48, are currently undergoing a comprehensive rehabilitation process that includes social support services, welfare assistance, and health screening before being reunited with their families. Saifuddin said it was crucial for the country to have a capable IGP, such as the 14th IGP Tan Sri Razarudin Husain, who played a key role in the repatriation of the two men. He praised Razarudin's composure when engaging with various US agencies, including the CIA and FBI, in resolving the matter. Meanwhile, Saifuddin stressed that the appointment of an IGP was not an award but a responsibility and burden that must be shouldered with full accountability.

"At the moment, the investigation is in its final phase, and the papers are expected to be handed over to the prosecution soon, likely within a month," he told reporters after the MyLesen B2 Driving Licence handover ceremony at the PICCA Convention Centre here today. He was responding to a question on whether the RTD would prosecute the owner of the bus company involved in the accident. When asked whether the investigation was affected by allegations that the operator had suffered a heart attack, Aedy Fadly denied the matter. He said action against the operator was being taken in accordance with existing regulations, and there was no issue related to health conditions. "However, if he (the owner) is hospitalised or otherwise indisposed, we will wait before taking further action. "But for now, we are proceeding with the investigation papers," he added. Transport Minister Anthony Loke was reported as saying that the RTD would take legal action against the bus company if it was found to have violated regulations or failed to ensure operational safety. Fifteen UPSI students were killed when the bus they were in collided with a multi-purpose vehicle along Jalan Jeli-Gerik near Tasik Banding, Perak.
