PIL filed in HC against A.P. govt. over private party's access to State's Consolidated Fund

YSR Congress Party (YSRCP) MLC Lella Appi Reddy has filed a Public Interest Litigation (PIL) in the Andhra Pradesh High Court, objecting to the State Government's move to permit a private party to approach the RBI and access the Consolidated Fund of the State.
This development is concerning the proposed NCD issuance by the APMDC. The MLC argued that this provision is unconstitutional as it bypasses legislative approval and violates Articles 203, 204, and 293 of the Constitution.
He urged the High Court to declare the move illegal and sought a stay on further proceedings, according to a press release.
Referring to the PIL, Mr. Appi Reddy expressed concern that private bondholders or debenture trustees could be allowed to withdraw funds directly from the State's consolidated fund, in violation of the Constitutional provisions providing for legislative oversight.
He stated that such access undermines the principles of financial accountability and violates the Constitution's framework for public finance. The PIL also questioned the government's decision to grant lease rights of over 436 minor mineral quarries to APMDC without any open bidding or competitive process, he said.
The YSRCP leader argued that this violates the Andhra Pradesh Minor Mineral Concession Rules and allows public resources to be used without transparency or oversight.

Further, the APMDC has been permitted to mortgage these mineral rights to private entities, who are empowered to transfer or sell them without government approval.
The petitioner termed it as a 'dangerous and unlawful handover of State-owned assets.
Mr. Appi Reddy requested the High Court to strike down the entire scheme by deeming it unconstitutional and arbitrary, and to halt the issuance of NCDs (bonds) backed by public assets. The PIL aims to safeguard the State's resources and financial integrity from being misused for private financial arrangements, he added.

The protest spearheaded by Karnatak Vidyavardhakh Sangha, a century-old representative body of Kannadigas, will be staged in front of the office of the Deputy Commissioner of Dharwad. The protest will begin at 11 a.m. Taking exception to Kamal Haasan's remark on the origin of Kannada, Karnatak Vidyavardhak Sangha held a consultative meeting on June 2 in which senior Kannada scholars, artistes and intellectuals took part. After due deliberations during the meeting, the sangha passed several resolutions. They are: Despite having stated that 'Tamil is the mother of Kannada and that Kannada originated from Tamil', actor Kamal Haasan has neither apologised to Kannadigas nor expressed regret. He has also not complied with the High Court's directive to tender an apology. The Karnatak Vidyavardhak Sangha has no opposition either towards Tamil language or Tamil-speaking people as it is known fact that languages originating from Proto-Dravidian language evolved into different languages. Despite this being the truth, Kamal Haasan has reportedly stated that he still intends to speak about Tamil supremacy. He has the right to speak about his language, but belittling or demeaning another language is strongly condemned by the sangha. 'By June 25, Kamal Haasan must withdraw his baseless statement about Kannada language, express regret and apologise to Kannadigas. If he fails to do so, the Karnatak Vidyavardhak Sangha will be compelled to launch a State-wide intense agitation,' says the resolution passed by the sangha. In pursuance of the decision taken during the consultative meeting, the sangha will stage a dharna on Monday and submit a memorandum registering its protest against the actor's remark.

Leader of Opposition in Karnataka Assembly R Ashoka on Sunday demanded that the government call a special session of the state legislature for three days, to discuss the June 4 stampede that killed 11 people, as he pointed out that people are seeking answers. The BJP leader, who reiterating the demand for resignation of Chief Minister Siddaramaiah and Deputy CM D K Shivakumar, also announced that all his party legislators will contribute a month's salary to the kin of those deceased, who are in need, while urging the government to enhance the compensation to ₹1 crore if it is not bankrupt. Eleven people died and 56 were injured in the incident. "People of the state are raising questions: who was at fault? So, call a special session of the legislature, let there be a discussion as to who was at fault, all the violations or flouting of laws need to be discussed, whether it was by police permission, DAPR, all of this should be discussed," Ashoka said. The DCP's letter clearly states that as the celebration event is being organised on the grand stairs of the Vidhana Soudha in a "hurry", he said, it warns that lakhs of people may gather, about the shortage of security staff, and that there will be a problem in providing bandobast. The officer further stated that, even if the event has to be held, the issuing of online or offline passes for visitors to Vidhana Soudha should be completely stopped. Also, as there are chances of the secretariat staff bringing their family members for the event, an order should be issued aimed at ensuring that this doesn't happen. It also seeks a holiday to be declared for secretariat staff to ensure that they too don't come, Ashoka pointed out. "The letter also calls for installation of more CCTV cameras in the vicinity of Vidhana Soudha and nearby places, given the large gathering expected, and highlights the need for an anti-drone system," he said and alleged that the government threw all these conditions into the "dustbin" and organised the event.
