Owner of grocery-anchored Baum Boulevard property faces court order in receivership

A prominent East End property faces an uncertain future as its ownership group grapples with financial challenges, including a multi-million dollar debt and recent court orders.

The ownership of a high-profile property in the East End is facing new financial repercussions in the Allegheny County Court of Common Pleas.
It's the ownership group affiliated with developer John Odell, whose Michigan-based Warner Pacific bought the former Day Baum Chevrolet car dealership real estate on Baum Boulevard about 15 years ago and redeveloped most of it into a mixed-use property comprising an Aldi store, office space and a Yinz Coffee shop, a focal commercial property totaling more than 150,000 square feet that's become a major East End draw.
Yet U.S. Bank filed a foreclosure action on the property's ownership - comprising of the affiliated firms Baum Boulevard Investors LP and Baum Boulevard Ground LLC - last June, and Odell's ownership group has been in receivership on the properties since September, when an affiliate of Newmark was appointed to the position of receiver.
Court records show the receiver filed exhibits in March arguing that "rather than obey the order of this court and deliver … diverted rent to Newmark as collected rent, defendants and John Odell, who managed those entities, directed those funds to other entities and persons, including Odell's family members, that had nothing to do" with overseeing the property.
On April 16, Judge Christine Ward ordered Odell and his affiliates to pay back more than $179,000 that Newmark argues was wrongfully diverted.
Odell didn't respond for comment.
Kirk Burkley, a lawyer who represents Baum Boulevard Investors LP and Baum Boulevard Ground LLC, declined to comment, as did Timothy Parker, a lawyer for Buchanan Ingersoll & Rooney PC, who represents U.S. Bank in the legal matter.
The new court order comes as the interests of Odell has already lost a portion of the larger real estate package to a lender, a long-deteriorating dealership building across Baum Boulevard once considered for a new parking garage that continues to be marketed by Jarbo Imperatore of the Pittsburgh office of JLL.
Imperatore reports he is marketing the property for sale or a ground lease and activity has "been extremely strong."
The foreclosure action filed last year detailed that the loan was not paid off in full by a maturity date of November 6, 2023, resulting in a default for an ownership group that also faced a host of liens from construction firms, the Pittsburgh Water & Sewer Authority and other vendors.
Court records indicate a debt balance at the time of $10.95 million.
Nobody who shops at the usually busy Aldi store or gets coffee at Yinz Coffee would be likely to notice any issues.
Ken Zeff, owner of the Yinz Coffee and a companion Fancypants Popcorn store, said he sees a lot of traffic going in and out of the neighboring Aldi store and views his Baum Boulevard location as one that continues to be a stable source of business.
"It was always a pretty solid store for us, and John was always a good landlord," said Zeff of Odell.
He expects the property would be in demand if it comes available again by its receivership.
"Something needs to happen there for sure," he said. "It's a pretty hot street right now."

When or if that might happen remains unclear. There's little indication in the court record to suggest the property might go to sheriff sale.
Judge Ward's order requires the $179,000-plus sum to be paid to the receiver in 10 days.
Andrea Geraghty, a real estate lawyer for Meyer, Unkovic & Scott, said it's likely up to the receiver to decide on whether to force a property into a sheriff sale, which doesn't necessarily require a court decision.
"If they don't turn over the money, then the receiver has a choice about what to do," she said.
She added that such legal requirements are a hassle for lenders.
"The banks don't want to own this property," she said. "They want the property to be managed correctly so the mortgage can be paid."

Trade tensions aren't stopping Chinese companies from pushing into the U.S.

BEIJING — Chinese companies are so intent on global expansion that even the biggest stock offering to date on Shanghai's tech-heavy STAR board counts the U.S. as one of its biggest markets, on par with China. Shenzhen-based camera company Insta360, a rival to GoPro, raised 1.938 billion yuan ($270 million) in a Shanghai listing Wednesday under the name Arashi Vision. Shares soared by 274%, giving the company a market value of 71 billion yuan ($9.88 billion). The United States, Europe and mainland China each accounted for just over 23% of revenue last year, according to Insta360, whose 360-degree cameras officially started Apple Store sales in 2018. The company sells a variety of cameras — priced at several hundred dollars — coupled with video-editing software. Co-founder Max Richter said in an interview Tuesday that he expects U.S. demand to remain strong and dismissed concerns about geopolitical risks. "We are staying ahead just by investing into user-centric research and development, and monitoring market trends that ultimately meet the consumer['s] needs," he told CNBC ahead of the STAR board listing. China launched the Shanghai STAR Market in July 2019 just months after Chinese President Xi Jinping announced plans for the board. The Nasdaq-style tech board was established to support high-growth tech companies while raising requirements for the investor base to limit speculative activity. In 2019, only 12% of companies on the STAR board said at least half of their revenue came from outside China, according to CNBC analysis of data accessed via Wind Information. In 2024, with hundreds more companies listed, that share had climbed to more than 14%, the data showed. "We are just seeing the tip of the iceberg. More and more capable Chinese firms are going global," said King Leung, global head of financial services, fintech and sustainability at InvestHK. Leung pointed to the growing global business of Chinese companies such as battery giant CATL, which listed in Hong Kong last month. "There are a lot of more tier-two and tier-three companies that are equally capable," he said. InvestHK is a Hong Kong government department that promotes investment in the region. It has organized trips to help connect mainland Chinese businesses with overseas opportunities, including one to the Middle East last month. Roborock, a robotic vacuum cleaner company also listed on the STAR board, announced this month it plans to list in Hong Kong. More than half of the company's revenue last year came from overseas markets. At the Consumer Electronics Show in Las Vegas this year, Roborock showed off a vacuum with a robotic arm for automatically removing obstacles while cleaning floors. The device was subsequently launched in the U.S. for $2,600. Other consumer-focused Chinese companies also remain unfazed by heighted tensions between China and the U.S. In November, Chinese home appliance company Hisense said it aimed to become the top seller of television sets in the U.S. in two years. And last month, China-based Bc Babycare announced its official expansion into the U.S. and touted its global supply chain as a way to offset tariff risks. Chinese companies have been pushing overseas in the last several years, partly because growth at home has slowed. Consumer demand has remained lackluster since the Covid-19 pandemic. But the expansion trend is now evolving into a third stage in which the businesses look to build international brands on their own with offices in different regions hiring local employees, said Charlie Chen, managing director and head of Asia research at China Renaissance Securities. He said that's a change from the earliest years when Chinese companies primarily manufactured products for foreign brands to sell, and a subsequent phase in which Chinese companies had joint ventures with foreign companies. Insta360 primarily manufactures out of Shenzhen, but has offices in Berlin, Tokyo and Los Angeles, Richter said. He said the Los Angeles office focuses on services and marketing — the company held its first big offline product launch in New York's Grand Central Terminal in April. Chen also expects the next phase of Chinese companies going global will sell different kinds of products. He pointed out that those that had gone global primarily sold home appliances and electronics, but are now likely to expand significantly into toys. Already, Beijing-based Pop Mart has become a global toy player, with its Labubu figurine series gaining popularity worldwide. Pop Mart's total sales, primarily domestic, were 4.49 billion yuan in 2021. In 2024, overseas sales alone surpassed that to hit 5.1 billion yuan, up 373% from a year ago, while mainland China sales climbed to 7.97 billion yuan. "It established another Pop Mart versus domestic sales in 2021," said Chris Gao, head of China discretionary consumer at CLSA. The Hong Kong-listed retailer doesn't publicly share much about its global store expansion plans or existing locations, but an independent blogger compiled a list of at least 17 U.S. store locations as of mid-May, most of which opened in the last two years. The toy company has been "very good" at developing or acquiring the rights to characters, Gao said. She expects its global growth to continue as Pop Mart plans to open more stores worldwide, and as consumers turn more to such character-driven products during times of stress and macroeconomic uncertainty.

Local breweries are often a meeting place for friends and family in their communities. After years of a brewery being part of a local area, that place becomes a go-to for people to meet with friends, have parties or just grab a drink after work. It's always great to see a local brewery thrive, but there's also a lot that goes into running a brewery, and sometimes, it's just time to close that chapter. Plus, the brewery business is a crowded one. According to the Brewers Association, the number of operating craft breweries in the U.S. reached a high in 2022 of 9,552, including 2,035 microbreweries, 3,418 brewpubs, 3,838 taproom breweries and 261 regional craft breweries. Now, one locally-owned brewery is making a very difficult decision and closing its doors. Eternity Brewing Company announced on June 4 that they'll be closing their doors at the end of the month. The brewery is located in Howell, MI, which is about 55 miles outside of Detroit. The owner, Ethan Whitesell, stated on social media, "After much reflection, I've made the personal decision to close Eternity Brewing Company at the end of this month." In a heartfelt note, Whitesell says, "Running this place has been one of the greatest joys and challenges of my life, but in my current circumstances, I no longer have the ability to keep up the fight. This was not an easy choice, and it's one that comes with a lot of mixed emotions." He added, "I want to invite you all to come in and help us clear out inventory over these final weeks. Let's share a few more beers, some laughs, and some great memories together before we close our doors." Whitesell also said that anyone interested in running their own brewery should get in touch with him, because his place "is ready and waiting for a new chapter."
