
Commuters who appeal against penalty fares risk criminal record
Yet those who formally dispute an inspector's view of the notoriously complex web of British train ticketing rules could now find themselves with a criminal record if they stand up for what they believe is right.
Paul Goldspring, the Chief Magistrate, said in a written ruling dated February 21, which has not previously been published: 'I rule that criminal prosecutions can be brought following a penalty fare appeal being dismissed…'
The judge said he had been given 'an undertaking that all [Department for Transport Train Operating Companies] will follow the guidance given by the court'.
Fines of up to £1,000 and, for repeat offenders, prison sentences of up to three months can result from a conviction for failing to produce a ticket or travelling with intent to avoid payment.
A conviction under the Regulation of Railways Act 1889 will appear on DBS background checks, potentially affecting someone's job prospects.
Campaigners fear that Judge Goldspring's ruling has given train companies a green light to threaten honest but mistaken commuters with a criminal record as the price of challenging ticket inspectors.
'Sham of an appeal system'
Christian Waters, 47, of Leeds, who was targeted for prosecution in 2022 after having his penalty fare appeal rejected, said: 'Why was this ruling not published, given it affects the protection that hundreds of thousands of passengers would assume they had from the regulations?
Mr Waters, whose case was dropped after he realised that Northern, the government-owned rail company, had broken the rules by trying to haul him in front of a judge, said: 'I do feel like they are saying I got off on a technicality now. I still dispute that I did anything wrong; their machine was not working!'
'No one has any protection at all, a sham of an appeal system and then money [is] demanded backed up by criminal law,' he continued.
The unpublicised Westminster magistrates' court ruling came about after another government-owned train company, Southeastern, asked the court if a number of previous prosecutions it brought were lawful. The exact number was not revealed in the judgment.
'It is clearly irrational that a person who brought an unmeritorious appeal could not be prosecuted, whereas someone who did not appeal could be,' ruled Judge Goldspring.
While an out-of-court appeals process exists for penalty fares, Parliament never intended commuters to be criminalised when it created the scheme some 35 years ago.
Introducing the 1988 law that created penalty fares, Tory peer Lord Marshall of Leeds told Parliament: 'If, however, a passenger on a train is not in possession of a ticket, he is not to be treated as a criminal under this Bill. He is simply asked to pay a penalty fare, which is a civil penalty and not a criminal one.'
Today, Regulation 11(3) of the Railways (Penalty Fares) Regulations 2018 says that prosecution is only allowed where the penalty has been cancelled by the train company before the appeal panel has decided the outcome.
Yet in his February 2025 ruling, Judge Goldspring said: 'The prosecutor obviously should not bring a prosecution if it is excluded,' but added: 'There is no obligation on the court to investigate whether the defendant has a defence.'
'This must be dealt with in a balanced manner'
Penalty fare appeals are decided by a private company called Appeal Services, which is a contractor paid by train companies to decide penalty fare appeals.
According to Appeal Services' website, in the last 28 days, its assessors rejected 80 per cent of first-stage appeals.
A Department for Transport spokesperson said: 'Deliberate fare-dodging costs the taxpayer up to £400 million annually – money which could be better spent on improving passenger experience.
'This must be dealt with in a balanced manner, which is why Great British Railways will bring operators together to establish oversight and better standardise practices, putting an end to inconsistent prosecutions and making sure passengers are treated fairly.
'We're working at pace to simplify ticketing as part of our rail reforms, to alleviate confusion and make it easier for people to buy the right fare.'

An 18 year old man has died after a serious crash in Halifax. The teenager was driving a Citroen C1when it collided with a grey BMW 330 just after 20:00 BST on Yorkshire Police said the BMW had been travelling on Hopwood Lane towards Queens Road when it was in collision with the Citroen, which was coming out of the lane from Gibraltar women from the BMW, both aged 25, were treated in hospital and initially arrested on suspicion of drug driving. Ex-Tory donor's payments company hit by money-laundering crackdown
A payments business controlled by a former Tory donor has been hit by a crackdown by Britain's financial watchdog over anti-money laundering failures. Lycamoney, which is controlled by British-Sri Lankan entrepreneur Allirajah Subaskaran, was targeted by the Financial Conduct Authority (FCA) in 2024 over concerns it would not be able to spot fraud. The shortcomings led to the business being forced into a strict oversight regime with the FCA, while an audit of its anti-money laundering processes was also carried out. The company was forced to stop accepting new customers as a result of the probe, with the block still in place until earlier this year. Bosses addressed the issue in Lycamoney's latest accounts, as they admitted that the company was scrutinised for a 'serious regulatory matter'. The website for Lycamoney, which was set up to help people send money overseas to family and friends, remains offline. The FCA's inquiry into Lycamoney came as part of a broader crackdown on anti-money laundering, as the regulator warned many payment firms last year to tighten up their processes or risk penalties. Mr Subaskaran, who handed more than £2m to the Tories between 2011 and 2016, founded Lycamoney after setting up Lycamobile in 2006. Companies House filings show that he is also the ultimate owner of Lycamoney. However, his sprawling web of mobile, media and payments businesses has come under increasing scrutiny in recent years after a string of accounting and tax issues. Lycamobile, Mr Subaskaran's best-known brand, sells pay-as-you-go SIM cards to migrants making international calls. The company admitted last year that auditors had refused to sign off its accounts, as they warned that they had been unable to find sufficient evidence over loans totalling almost £150m. The majority of the company's staff were then sacked in December. Lycamobile also lost a case against HMRC last August after failing to argue that its call, text and data bundles were exempt from VAT. This left the company facing a potential bill of up to £51m. The company's latest accounts show that it had lost £2.2m in the year ending December 2023.

Fly-tipper is fined £4,600 after he was caught on camera dumping a bed at a roadside
A brazen fly-tipper who dumped a bed at the side of a road has been fined thousands of pounds after being caught red-handed. Litterbug Naiffisa Abba was snapped leaving the bedroom fixture and other trash at a notorious fly-tipping spot in Queensbury Park, north-west London. In the images, released by Brent Council, Abba can be seen struggling to haul the single divan base across the road before lobbing it next to bags of rubbish. The litter lout's actions, captured on camera in March 2024, have now seen him hit with a £4,600 fine. Abbas, of Wembley, was convicted at Willesden Magistrates' Court, where a judge slapped him with a further £2,000 to the initial penalty because he failed to attend his hearing. The prosecution is part of a major clampdown by Brent Council on fly-tippers, who have been blighting the streets in recent years. It comes as London continues to be gripped with a fly-tipping epidemic - while England faces its biggest illegal dumping crisis in 20 years. Bosses at Brent say they 'won't accept' fly-tippers, with council chiefs insisting they have 'ramped up' efforts to bring 'selfish' crooks to justice. Its campaign, dubbed 'Don't Mess With Brent', has seen a number of secret cameras installed at known hotspots, which are being used to catch litterbugs. So far, the effort has led to the council issuing 30 per cent more fines as a result. As well as installing covert surveillance, more enforcement officers have been deployed to patrol the streets. Offenders are hit with £1,000 fines if officers uncover evidence of them being behind the fly-tipping, with the council warning crooks: 'We will catch you.' The crackdown was launched in 2024, with Brent declaring it would wage war on 'selfish litter louts' who had blighted the borough - which saw 35,000 reported cases between 2022-2023. The local authority added the crime costs it in the region of £1.5million to deal with each year. Councillor Krupa Sheth, the council's environment boss, said: 'We are taking a zero-tolerance approach to fly-tipping, which means you will see more enforcement officers on the streets catching people like we have done here. 'Well done to them and let this be a lesson to anyone considering fly-tipping our streets, we won't accept it.' The news comes as shocking figures revealed England's fly-tipping crisis had hit a 20-year high this year. Environment Secretary Steve Reed vowed to toughen up enforcement after reported cases of illegal dumping passed 1.15million in 2023/24. The figure is an increase of six per cent from the 1.08 million the previous year and the highest level in the six years since the current method for reporting was brought in. It was also the fourth year in row that councils have dealt with more than a million cases. However, the figures also revealed a year-on-year fall in the number of fixed penalty notices issued for fly-tipping, and a decline in the number of court-issued fines. Analysis of the data reveals that London is a major hotspot, with eight boroughs in the top 10 local authorities, in terms of overall dumping and the highest proportion by population. Nottingham and Liverpool made up the top 10, with other places at the top including Birmingham and Bradford. Mr Reed said: 'Fly-tipping is a disgraceful act which trashes communities and its increase is unacceptable. Communities and businesses shouldn't have to put up with these crimes. 'This Government will crack down on fly tipping and punish rubbish dumpers, forcing them to clean up their mess. Countryside leaders warned the problem was even greater than the figures suggest as they only include rubbish dumped on public land, while farmers and rural businesses face stress, disruption and 'staggering' costs to clear up waste illegally left on private land. Last year, some 60 per cent of cases involved household waste, with 688,000 incidents of illegally dumped rubbish from homes, ranging from black bags of waste to the contents of shed clearances, furniture, carpets and DIY. The most common place for fly-tipping to occur was on pavements and roads, accounting for 37 per cent of incidents. Nearly a third (31 per cent) of incidents were the size of a small van load, while 28 per cent were the equivalent of a car boot or less of rubbish. But four per cent were the size of a tipper lorry load or larger, with large fly-tipping incidents costing £13.1 million for councils to clean up, the figures show. The figures also reveal a slight drop in the number of enforcement actions, with fixed-penalty notices and court fines both down on the previous year.
