Same-sex couples can form families, says Madras High Court

The Madras High Court held that while the Supreme Court had not legalised same-sex marriage, queer couples can 'very well form a family'.
In a May 22 order, the bench of Justices GR Swaminiathan and V Lakshminarayanan noted that: 'The expression 'family' has to be understood in an expanded sense.'
'Marriage is not the sole mode to found a family,' the High Court said. 'The concept of 'chosen family' is now well settled and acknowledged in LGBTQIA+ jurisprudence. The petitioner and the detenue can very well constitute a family.'
Delivering its verdict on petitions seeking legal recognition for same-sex marriages, a five-judge Constitution bench had ruled in October 2023 that the issue must be decided by Parliament and that there was no fundamental right to marriage.
In January, the Supreme Court dismissed review petitions against its October 2023 judgement.
The observations by the High Court came while it restrained a lesbian woman's family from interfering in her personal life and unlawfully detaining her.
The court was hearing a habeas corpus petition filed by the partner of a 25-year-old detenue, after the couple was separated. The couple was separated when the detenue was allegedly forcibly restrained by her family.
The petitioner had moved the High Court after she alleged that the police refused to help the couple.
In court, the detenue's mother accused the petitioner of leading her daughter astray and alleged that her child was now a drug addict. The mother thus claimed that her daughter required counselling and rehabilitation.
The court rejected the contention.
'It would be unfair to accuse her [detenue] of any kind of addiction,' the court said. 'She made it clear that she wants to go with the petitioner. She confirmed the allegation that she is being detained against her will by her natal family. It appeared that she was forcibly taken to her home and beaten.'
The court also noted that it was told that the detenue's 'natal family members forced her to undergo certain rituals so that she will become normal'.
The bench criticised the police for their 'rank inaction' and 'insensitivity' despite receiving a complaint from the petitioner.

The National Green Tribunal (NGT) has raised serious objections to the Uttar Pradesh government's report on the status of Sewage Treatment Plants (STPs) and Sewage Waste Management (SWM) submitted to the tribunal. Directing the government to fill the gaps, a three-member bench of NGT comprising chairperson Justice Prakash Shrivastava, Justice Sudhir Agarwal and expert member A. Senthil Vel passed the order on May 26. The tribunal also handed over a prescribed format to the state government in which details have to be submitted before the next hearing on July 28. 'Report dated 16.04.2025 filed on 24.5.2025 disclosing the status of solid and liquid waste management does not point out gaps plugged thereby not complying with SWM Rules, Water Act and order of the Supreme Court,' the tribunal said. Anomalies pointed out by tribunal Against disclosure of 95% waste processing facilities (19,014 TDP or tons per day), the quantity of segregated waste is 74% (14,884 TPD). This anomaly needs to be clarified. No clarification was given on the operation of waste processing plants without authorisation under the SWM Rules. The report discloses figures of waste generation in 762 local bodies, but does not reveal the actual waste processed by urban local bodies. The report says there has been 100% remediation of legacy waste at 60 sites but no material has been placed on record in support of this claim. Figures disclosed indicate 60 sites remediated and only 26 sites are left with legacy waste. Since, in other ULBs, waste processing facilities do not exist, specific disclosure of legacy waste in such ULBs should be pointed out. No disclosure has been made on the operational status of waste-to-energy plants. Legacy waste Legacy waste refers to accumulated solid waste that has been improperly collected and stored for an extended period, often in landfills or dumpsites. It is essentially a backlog of waste that was not managed effectively and has created a significant environmental problem. Sewage management In view of sewage generation of 5,500 MLD (million litres per day) and installed treatment capacity of 4,651 MLD (but treating only 3,122 MLD), the gap in treatment comes to 2,378 MLD. Untreated sewage is being discharged into the environment, which is evidenced by the disclosure that only 21.08 lakh households (HH) are connected to the sewerage system out of 52.17 lakh houses in 17 municipal corporations. STPs have been designed in excessive capacities compared to sewage generation in Agra, Bijnor, Anupshahar, Chirakoot Karwi, Pilkhuva, Kannauj, Bela, Pratapgarh and other cities. But many urban local bodies do not have STPs, including Bahraich, Banda, Deoria, Fatehpur, Gonda, Hathras, Sambhal and Bhadohi. THE CASE In 2018, the Supreme Court in the 'Paryavaran Suraksha Samiti & Anr. vs. Union of India & Ors' case issued key directions regarding environmental protection, particularly river pollution and industrial waste treatment. The top court made it compulsory for industries to install and maintain functional primary effluent treatment plants (PETPs) within a specific timeframe. SC directed the municipalities to operate existing STPs and established timelines for setting up of common effluent treatment plants (CETPs) and STPs. The apex court also emphasized on the responsibility of municipalities to ensure public health, sanitation, and solid waste management. The Supreme Court permitted Uttar Pradesh to approach NGT with an application regarding the feasibility of the time lines set by the top court. The NGT was tasked with monitoring compliance with the Supreme Court's directions.

Vice president Jagdeep Dhankhar on Friday asserted that in the backdrop of the indictment of justice Yashwant Varma by a panel appointed by the Supreme Court in the 'cash' seizure case, the judiciary should have given permission for launching criminal proceedings against him. Dhankhar, during a meeting with the executive committee members of Punjab and Haryana High Court Bar Association led by president, Sartej Narula at Punjab Raj Bhawan in Chandigarh on Friday morning, also said that the present government at the Centre is 'handicapped' in the given scenario and can't register an FIR due to a Supreme Court judgment, passed three decades ago. 'It (judgment) provides virtually impregnable cover. Unless permission is accorded by a functionary at the highest level in the judiciary, an FIR can't be registered,' Dhankhar remarked. 'The permission (to register FIR) should have been given on the very first day. …A compulsive, expedient situation should have been there because the mechanism evolved is the same. Second, it could have been given at least after the report,' added Dhankhar, who arrived in Chandigarh on Thursday. After spending a day at the Punjab Raj Bhawan, he headed to Himachal Pradesh. Dhankhar emphasised that judges need protection because they make 'tough decisions and cannot be subjected to investigation in a routine way. 'But the facts of this case warranted a proper probe,' he stated. While referring to the panel of three judges set up by the Supreme Court, Dhankhar, questioned the sanctity of the committee and said, whether the report submitted is 'actionable' and whether this committee can substitute for an FIR investigation. Dhankhar equated those indulging in corruption with 'sharks' and said that they must not be spared. He underlined that no other constitutional office has immunity from facing criminal action while in office. The President and the governors have immunity from prosecution only till they are in office, he further remarked. Dhankhar appreciated the role of Bar associations in the country in picking up this issue and said that lawyers are 'watchdogs' of democracy. On May 5, a three-member in-house enquiry committee submitted its report to the then CJI confirming that cash was indeed found at the residence of justice Varma in March, then a sitting Delhi high court judge. Acting on the same, then CJI Sanjiv Khanna initiated the process for the removal of justice Varma by writing to the government. Reports suggest that the government might move an impeachment motion against justice Varma in the Monsoon session.

He also mentioned that nodal officers have been instructed to promptly respond to complaints and enforce the Andhra Pradesh Prohibition of Cow Slaughter and Animal Preservation Act-1977, Animal Transport Rules-1978, The Animal Transport (Amendment) Rules-2001 and Slaughter House Rules-2001. Citizens are encouraged to report any information related to cow slaughter or illegal transport of cattle by calling 112. The identity of informants will be kept strictly confidential, the SP assured.
