A Sri Lankan anti-terror law that needs repeal

In the many cycles of violence in Sri Lanka's troubled history, 'terror' has been a running theme. While the state — that has repeatedly demonstrated a majoritarian tendency — has never held a mirror to itself to acknowledge the violence that it has unleashed on civilians, it has often sought to justify using draconian measures to 'counter' or 'crush' anything that it deems 'terror'.
If there is one law in Sri Lanka that has received constant attention over the last half century in this regard, it is the Prevention of Terrorism Act (PTA) passed in 1979, during the presidency of J.R. Jayawardene. It was modelled on South African legislation from the Apartheid era and British laws against Irish militancy, and replaced another law titled Proscribing of Liberation Tigers of Tamil Eelam and Other Similar Organizations Law of 1978.
The intention was very clear: to eradicate the Liberation Tigers of Tamil Eelam and other organisations that sought to create a separate Tamil state on the island. Originally envisaged as a temporary provisions law for a period of three years, it became a permanent fixture in Sri Lanka's statute books in 1982.
Applied with impunity
The provisions of this law include administrative detention for long periods without judicial oversight; confessions made to police officers being admissible evidence, and failure to give information to the police being made an offence. Needless to say, these provisions are abused widely, with obvious impunity. Impunity, because even in cases where it was established that false and fabricated evidence was presented to court, law enforcement authorities faced no consequence. The cases merely failed, but errant police officers who fabricated evidence and worse, who tortured to elicit confessions, went scot-free.
There was yet another outcome, which was actually a security nightmare. When police officers found an easy way to 'solve terrorist crimes', they did not investigate to find the actual culprits. Confessions were obtained from even those who were not actually involved in the offence. They were convicted while the real culprits remained at large. We have also seen several cases where innocent persons have been charged for 'not giving information' to the police. All you require is a forced confession from them to that effect and they would be sentenced.
For decades now, rights defenders in Sri Lanka have fiercely opposed the PTA. Lawyers have highlighted the availability of provisions in ordinary law to deal with serious threats and offences to the country's peace and security. Many countries committed to democracy have raised concerns over the piece of legislation and its impact on human rights and democratic freedoms. The European Union suspended the Generalized System of Preferences (GSP)+ preferential status for Sri Lanka in 2010 on account of it not being repealed as promised.
As is common with draconian legislation anywhere, the PTA, too, is also used selectively against the government's political opponents, dissidents, and minority groups. Many human rights activists and journalists have been targeted. In 2009, well-known journalist J.S. Tissainayagam was sentenced to 20 years in prison for publishing an article in an obscure journal accusing the government of starving the Tamil population during the war. (He was pardoned and released subsequently after intense international pressure.) The charge against him was that the article could have caused communal disharmony.
A continuance with minor amendments
Successive governments in Colombo have promised to repeal the PTA — at least after the end of the war in 2009 — but the law still remains, with some cosmetic amendments. There was a moratorium announced on its use, but even a few weeks ago, arrests were made under this law.
Sri Lankan President Anura Kumara Dissanayake's ruling National People's Power (NPP) government has repeatedly vowed to repeal the PTA, both during its election campaign and since coming to power. Its pledge was taken more seriously, given that its own party, the Janatha Vimukthi Peramuna (chief political constituent of the NPP) suffered immensely around its second armed uprising in 1987-1990. Although the PTA was initially brought to suppress Tamil militants, the state did not hesitate to use it against the Sinhalese, especially JVP cadre challenging it. More recently, the law has been used to target Muslims after the Easter Sunday Attacks in 2019.
Campaign for a repeal
In 2021, this writer led an island-wide signature campaign to repeal the PTA, along with colleagues in Parliament and rights activists. It was reassuring to see people from all ethnic communities supporting the call to repeal the piece of legislation. NPP members too participated in all districts, emphatically backing the call for its repeal. Yet, when it has fallen into its own hands to repeal it fully, the NPP too appears reluctant, perhaps because the security sector that has (ab)used the legislation for so long is not willing to part with it.
Apart from constituting a committee to look into the possible repeal of the PTA, the government is yet to take any significant step towards it.
While in the opposition, the NPP steadfastly refused to join any discussion on replacing this law with another 'humanitarian law' on the basis that the PTA must be repealed in toto. But now in the seat of power, it too has started talking about another law that will be drafted to replace the PTA. Previously, two 'replacement' drafts were put out by two successive governments. Both drew widespread criticism from human rights activists who contended that they were, in fact, worse than the PTA itself.
We are watching the NPP's moves on its own promise to repeal this dangerous piece of legislation that, without doubt, must go. Repealing the PTA is the best test one can put to the government to see whether it can translate its pre-poll rhetoric into action.

Elusive global unity against terrorism

The 'Operation Sindoor' has shown us how deeply fragmented the fight against terror has become. There is a widely held conviction among all major powers that Pakistan is indeed harbouring terrorists and terror groups on its soil and using them as strategic assets against India, just as it had once used the earlier avatar of Taliban. They do not need more convincing. However, while there was widespread condemnation of the terror attack in Pahalgam, no country has called out Pakistan or even asked it to cooperate with apprehending the perpetrators. This is where facts diverge from reality. Before 'Operation Sindoor' was launched, all that the European Union (EU) did was to call the 'rising tensions between India and Pakistan' 'alarming' and advise India that 'escalation helps no one.' It was obvious that rather than taking a stand of zero tolerance to the menace, the EU continued to see terror attacks through a politically frosted glass – the frost that set in due to India's stand on the Ukraine war. The EU, which was peeved over India's abstentions on the UN votes on Ukraine, saw this as an opportunity to pay back in the same coin. However, what they have conveniently forgotten is that when China aggressed our borders in Galwan, all the European Council President could say in front of Prime Minister Narendra Modi was: 'The relationship between the EU and China is complex. We need to tackle different issues and support all the efforts to maintain a channel of dialogue to find peaceful solutions.' Thank you, EU, for this candid admission.. In fact, when an important member of the EU called India in February 2021 to express its indignation at India's stand in the UN Security Council on the Ukraine vote, India asked them politely to send us a copy of their statement issued when the Galwan clashes happened. There was silence at the other end, since it had issued none. Sometimes it is easy for the EU to forget that international relations did not start with the Ukraine war. The United States have, however, been more forthright on terrorism, though all their actions have to meet the touchstone of domestic acclaim in the US. President Donald Trump's administration has jettisoned the narrow internal focus of Joe Biden's administration on REMVE, or racially and ethnically motivated violent extremism. The recent post of FBI Director Kash Patel on X, calling out a 'Pakistani citizen' being extradited to the US for 'support to ISIS and attempting to commit acts of terrorism', signalled a robust anti-terror policy. The extradition of 26/11 plotter Tahawwur Rana from the US to India is a welcome development. However, the US has also found a sudden bonhomie with Pakistan, calling them 'a phenomenal partner' in combating terror. Consequently, while pursuing zero tolerance to terror, the US does not discriminate between whom it is willing to work with as long as its ends are met. This explains its embrace of former Al-Qaeda leader and current President of Syria, Al Shaara, and a separate deal with the Houthis for stopping attacks on American shipping. The Organisation of Islamic Cooperation (OIC), on the other hand, are now focusing narrowly on terror since the main ambition of most of its members, especially of the Gulf countries, is to break the shackles of their history of support to Islamic radicalism, spawning terrorists and terror groups around the world. Their desire for regional stability and integration with the 'outside' world has made them lukewarm to the Palestine issue and developments in Gaza, the West Bank and the Middle East. India should not expect much from them vis-a-vis Pakistan's terrorist misadventures either. The Saudi minister's shuttle diplomacy immediately after the Pahalgam attack was similar to the one it undertook after the Pulwama attack, ironically by the same minister, and yielded the same results – nothing. The litmus test will come next month when Pakistan takes over the presidency of the UN Security Council. We will see how the OIC countries in the Council – and there are five of them – treat the issue of terrorism and whether they will use Islamophobia to dilute the fight against terror. How the US and the UK react will be the other litmus test. the fight against terror in Africa has been orphaned. The Global Terrorism Index 2025 points out that the Sahel is now the epicentre of terrorism, accounting for over half of all terrorism deaths in the world. But the outside world has no time since it is not affecting them directly. It is a dismal commentary on our collective fight against terror. The inference is simple and, of course, has been self-evident for a long time. Each state will react as per its own geopolitical and other compulsions, especially when it affects it directly. This was how it was before 9/11 happened – the era of 'your terrorist' and 'my terrorist'. That era is returning. The fragmentation of this fight against terror is worse than ever before. In this scenario, Pakistan is not going to stop with the Pahalgam attack unless it knows that the price it will have to pay for sponsoring terrorism will be unacceptably high. It should be India's endeavour to ensure that this happens, if Pakistan is to be deterred. That is why it is even more necessary now for India to take the lead and sustain the high level of engagement to put forward our narrative and call out those responsible. This engagement should also extend to our neighbours. If sending multi-party delegations to neighbours proves to be sensitive, the foreign secretary can visit our neighbours, who are equally susceptible to being influenced by the Pakistani narrative, with Islamic radicals raising their heads again in some neighbouring countries. This will adversely impact our 'Neighbourhood First' policy. (The writer is a former Ambassador and Permanent Representative of India to the UN in New York. 19 charge-sheeted for last year's 1,200kg drug bust in Delhi

The Special Cell of the Delhi Police has filed a 10,000-page chargesheet against 19 individuals, including a former Congress party worker, a Dubai-based fugitive, a British national, for allegedly running an international drug trafficking network that led to the seizure of 1,289kg of cocaine and over 40kg of marijuana in Delhi-NCR during a sweeping three-month-long crackdown last year. The chargesheet, submitted at the Patiala House court on Thursday, estimated that the drugs were worth ₹13,000 crore. Of the 19 people accused, 14 were arrested during raids conducted last year. The chargesheet mentions that five people are 'proclaimed offenders', but currently at large. This includes the alleged kingpin of the racket — Virender Basoiya, who is believed to be in Dubai, and his son Rishab. Police arrested Basoiya's younger brother Ravinder Basoiya from a hotel in east Delhi in December last year. One of the first major busts came in October 2024, when the Special Cell raided a godown in Mahipalpur, south Delhi, seizing 562kg of cocaine and 40kg of Thai marijuana. The storage facility was owned by Tushar Goyal, a former Congress worker, who was arrested along with three others. Goyal's interrogation led police to UK national Jitendra Pal Singh Gill, who was apprehended at the Amritsar airport. Gill, police said, had been dispatched to India by Basoiya to manage the consignment. Several consecutive raids included one at the manufacturing unit of Gujarat-based company Aavkar Drugs in Ankleshwar. The company makes precursors for cough syrups. The chargesheet states the drugs were made in Gujarat and Delhi. 'The raw materials were procured from five pharma companies in south India and Gujarat which have been sent notices. The drugs were smuggled by three shell companies created by Basoiya on forged identities. These firms were used for transactions and for buying raw materials and then selling them,' a senior police officer explained. Police said the five pharma companies are not accused but witnesses in the case. 'Once the raw chemicals were procured fraudulently from the pharma companies, they were processed in Aavkar and then sent to Delhi in trucks and other vehicles via Uttar Pradesh. Goyal further mixed the chemicals with the cocaine mixture. This cocaine mixture came from South American countries via Dubai,' added the senior officer. Police said Basoiya's family members have been named accused for 'handling the coordination' between key players in the nexus. The Special Cell stated in the chargesheet that the drug ring has been running since February last year. Basoiya has also been accused in the Meow Meow drug case in which 1,700kg of cocaine, worth over ₹3,000 crore was traced to Delhi and Pune. The seizure was made by Mumbai Police. Additionally, the chargesheet has shown technical evidence — mobile data records, CCTV footage, transaction records, digital footprints apart from the seizures. 'It is believed that Basoiya left India after the February drug hauls. There are some other key associates of Virender Basoiya who are also involved in the syndicate. Further investigation is on,' said another officer.
