NEW DELHI: The Delhi high court has held a woman leaving her job to take care of her child as a
single parent
wasn't voluntary desertion of work and she was entitled to alimony, news agency PTI reported.
In an order passed on May 13, Justice Swarana Kanta Sharma held that such a situation must be seen as a result of the parent's overriding responsibility towards the child.
The court accordingly dismissed a plea to set aside a trial court's order that had awarded interim maintenance to the woman and her minor son.
The husband had challenged the October 2023 order of the trial court, which directed him to pay Rs 7,500 per month each to his estranged wife and their child.
However, the high court upheld the order, directing the man to continue paying the same amount to the woman, and contribute an additional Rs 4,500 per month towards the child's maintenance.
'It is well settled that the responsibility of caregiving to a minor child falls disproportionately upon the parent with custody, often limiting their ability to pursue full-time employment, especially in cases where there is no family support to take care of the child while the mother is at work,' the court observed.

Therefore, the bench held that the woman's decision to stop working cannot be interpreted as 'voluntary abandonment of work, but as a consequence necessitated by the paramount duty of child care'.
The man argued that his wife was highly educated and had previously worked as a guest teacher at a Delhi government school, earning between Rs 40,000 and Rs 50,000 per month, including tuition fees. He contended she was capable of earning a livelihood for herself and their child and alleged that the maintenance case was filed merely to harass him.
He also claimed the woman had left their matrimonial home voluntarily and had not reconciled with him despite a court directive. He told the court he was willing to live with her and their child.
The man further submitted that he was practising as a lawyer in Haryana, earning only Rs 10,000 to Rs 15,000 per month, and was unable to comply with the interim maintenance order issued by the trial court.
The woman, in contrast, stated that she was unable to continue working due to her caregiving responsibilities.
She argued that her previous employment should not be used to deny her rightful claim to maintenance. Given her long commuting hours and lack of job opportunities near her residence, she said, she had no choice but to give up her teaching career.
The court found her explanation 'reasonable and justified'.
Noting that the man's income certificate was not placed on record, the high court directed the family court to re-examine the interim maintenance plea afresh. In the meantime, the current arrangement of payments would continue, it said.

Ltd., who were arrested on the wee hours of June 6 in connection with the June 4 stampede outside M. Chinnaswamy stadium in Bengaluru during the celebration of RCB's victory in IPL-2025 tournment. Justice S.R. Krishna Kumar passed the order while allowing the petitions filed by Nikhil Sosale, Head (Marketing and Revenue), RCSPL; Sunil Mathew, Director, and Kiran Kumar, Event Manager of DNA; and Shamant N.P. Mavinakere, a freelancer service provider for DNA. RCSPL is the owner of RCB cricket team and DNA is the event management firm for RCSPL. The Court has ordered their release on bail by imposing conditions. Copy of the order is yet to be released. 'Arrested on CM's orders' It was argued on behalf of the petitioners that they were arrested based solely on 'the orders of the Chief Minister [Siddaramaiah] to arrest the officials of RCB and others' and without conducting any investigation and collecting any material to point out that the petitioners were responsible for the stampede, which resulted in the death of 11 persons. They had also contended that they were arrested by the police, who had no jurisdiction either to investigate the cases registered in connection with the stampede or to arrest them. Meanwhile, the State government had defended their arrest claiming that the police adhered to all the procedures laid down in law and by the apex court while arresting the accused persons in a criminal case. However, the Government, either in its written statement or arguments, did not say anything on the court's query whether Chief Minister had stated at a media conference that he had ordered the arrest of officials of the RCB and others. The government, in its written statement, had merely stated that the contention of the petitioners, that their arrest was made solely on the Chief Minister's order, was not relevant for deciding the legality of their arrest.

Bollywood actor Dino Morea on Thursday appeared before the Enforcement Directorate (ED) here in connection with a money laundering probe linked to an alleged Rs 65 crore Mithi river desilting scam, officials said. Morea, who had been summoned by the ED for questioning, reached the federal agency's office at Ballard Estate in south Mumbai at around 10.30 am, an official said. The ED on June 6 conducted searches at more than 15 locations in Mumbai, and Kochi in Kerala, including the premises of Dino Morea in Bandra (West) area here, those linked to his brother Santino, some Brihanmumbai Municipal Corporation (BMC) officials, and contractors among others, official sources earlier said. The searches were conducted in Kochi as one of the companies that provided desilting equipment to the BMC -- Matprop Technical Services Pvt Ltd -- is based in this city, they said. The investigation is being conducted under the Prevention of Money Laundering Act (PMLA), the sources had said. The ED case stems from a Mumbai Police Economic Offences Wing (EOW) FIR filed in May against 13 persons, including contractors and civic officials, for an alleged Rs 65.54 crore scam in tenders awarded from 2017-2023 for desilting of the Mithi river which flows through Mumbai and acts as a stormwater drainage channel for the metro city. The Uddhav Thackeray-led undivided Shiv Sena controlled the cash-rich BMC from 1997 till the party's split in 2022. After the expiry of the general body in 2022, the civic body was controlled by the state government, which was then headed by Eknath Shinde. It was alleged by the police in its complaint that BMC officials tailored the tender for the desilting contract in such a way that it benefited a particular supplier of machinery, and the contractors reportedly generated fraudulent bills for transporting the sludge out of Mumbai. The 49-year-old actor and his brother were questioned by the Mumbai Police EOW in this case last month also. The Morea brothers, it is understood, were questioned by the police about their alleged links with alleged middleman Ketan Kadam, arrested in the case along with another accused, Jai Joshi, apart from some financial transactions made in a company linked to Santino. Kadam and Joshi, according to police, were involved in the renting out of 'silt pusher' machines and multi-purpose amphibious pontoon machines to contractors who were carrying out Mithi river desilting work. In 2021, the ED had attached Morea's assets as part of a money laundering investigation linked to an alleged bank fraud case against Gujarat-based pharmaceutical company Sterling Biotech and its promoters. The plan to desilt the river was planned by the Mumbai civic authorities following the 2005 floods, which brought the city to a grinding halt.

CUTTACK: In a high-value financial scam case, the Orissa High Court has granted regular bail to 23 persons accused of being involved in laundering defrauded funds through their bank accounts. The scam surfaced with a retired person lodging a complaint that he was duped of Rs 6.28 crore after being added to a WhatsApp group named as an Investment Club, administered by a person using a US number. Posing as investment advisors, the group lured him with daily stock discussions and fake IPO deals. Falling for the fictitious profits, he invested his retirement corpus into shares of a fake company and was shown massive gains. However, repeated demands for hefty service charges and withdrawal fees led to further losses. Finally, he was removed from the group, the app was deactivated, and no funds were returned. Acting on the complaint, the state CID-Crime Branch's cyber police station in Cuttack registered an FIR on August 24, 2024, and arrested 23 persons in connection with the fraud. The vacation court took up the bail petitions of the 23 accused on Monday following the Supreme Court's direction on May 30 to the high court to consider them on June 9 and decide them expeditiously. One of the accused had sought the SC's intervention against the delay in adjudication on the bail pleas f i led in December and thereafter.
