SOMERSET COUNTY, Pa. (WTAJ) — A Berlin man, who is not allowed to own a firearm, is facing charges after he was allegedly caught with four guns in Somerset County.
David Mitchell, 51, is facing charges after he was caught with guns, crystal meth and ammunition after police pulled over a vehicle, according to a criminal complaint. On Jan. 29, troopers noticed a red Toyota Corolla that Mitchell was a passenger in. They noted that Mitchell had outstanding warrants and initiated a traffic stop on the vehicle.
Mitchell was arrested by officers and they found on his person a revolver that had no serial number with five .32 bullets in a black holster, 3.4 grams of crystal meth, a black THC vape, 32 .22 caliber bullets, $1,963 in cash and a 6-inch knife.

According to the affidavit, Mitchell was not legally allowed to own a firearm due to a previous burglary conviction and his warrant was for receiving stolen property. Upon placing Mitchell under arrest an officer returned to the vehicle to speak with the driver, Danielle Overly, 38, of Addison.
Police noted that while speaking to Overly they could clearly see three other firearms in the vehicle. Overly allegedly admitted to officers that they would find additional drugs and guns in the vehicle and was also detained by officers. The vehicle was towed and entered in evidence.
Mitchell was interviewed by troopers and allegedly admitted to knowing that he could not possess a gun and had bought four from a male in the Confluence area. He claimed all of the guns, drugs and drug paraphernalia in the vehicle as his own, according to the affidavit.
Overly was also interviewed and told officers that she did not know that Mitchell was not allowed to own a gun.
Officers obtained a search warrant for the car and the following items were found:
1 gram of meth (noted to be in a purse belonging to Overly)
A metal canister containing marijuana
.22 caliber ammunition
.32 caliber ammunition
.45 ammunition
A green bottle containing a powder substance
.22 caliber long rifle
Pump shotgun
A loaded rifle
Overly is facing one misdemeanor charge of intent to possess a controlled substance. Mitchell is in the Somerset County Prison with bail set at $25,000. He's facing felony charges of possession of a firearm prohibited, firearms not to be carried without a license and misdemeanor charges of intent to possess a controlled substance.
Mitchell has a preliminary hearing scheduled for Feb. 13.
