Tribunal backs school's handling of teacher's expression of religious views

An Anglican school was 'entitled' to manage how Christian views were expressed by a teacher in line with its values, a tribunal judge ruled.
Teacher Ben Dybowski, a Christian with Catholic beliefs, was dismissed having shared his views about same-sex marriage, abortion and Sharia law during a training event.
Mr Dybowski also told the headteacher during a follow-up meeting that he often expressed these views on social media.
His claims of harassment and direct discrimination related to his religious and protected beliefs were dismissed by an employment tribunal, with the judge saying the school could exercise a degree of control over how beliefs 'manifested' in accordance with its values.
The tribunal also ruled that his criticisms of Sharia law were an opinion and therefore not a protected belief.
In October 2022, Mr Dybowski began working as a teaching assistant at The Bishop of Llandaff Church in Wales school, a co-educational comprehensive for 11-to-18-year-olds near Cardiff through an agency.
The school held a session delivered by Diverse Cymru Training on handling topics in March 2023, and Mr Dybowski asked the trainer about expressing personal beliefs and if they amounted to discrimination.
He said his view was that true marriage is a union between a man and a woman, that human life begins at conception and abortion is the taking of innocent human life and he was critical of some aspects of Sharia law, the tribunal heard.
The trainer said that the claimant was free to hold such views but that expressing them might be 'regarded as discrimination', the Cardiff tribunal was told.
Mr Dybowski had a meeting with headteacher Marc Belli the next day after other members of staff expressed concern about the views, the tribunal heard.
During the meeting, Mr Dybowski discussed his social media activity and how he often expresses his beliefs, including topics like same-sex marriage and Islam, the tribunal was told.
Mr Belli, reminded him of social media guidelines and the Education Workforce Council (EWC) regulations, explaining that expressing his views, when publicly expressed, could potentially harm students or staff, especially given the school's diverse community and values, the tribunal heard.

Judge
Mr Dybowski is a self-confessed campaigner and debater and the evidence shows he quietly took opportunities to discuss his views with pupils and staff on a number of occasions, the tribunal was told.
The complainant was removed from the school.
Judge Samantha Moore said Mr Dybowski's views on marriage, abortion and gender amounted to protected beliefs but that his critical aspects of Sharia law were deemed an opinion and are not protected.
The judge said it was clear that Mr Belli wanted the claimant not to manifest the views in any way he had during the training event and found that 'none of what subsequently ensued was because the claimant held his particular beliefs'.
She said it was 'reasonable' for Mr Belli to have become very concerned and reach a conclusion that he could not trust that Mr Dybowski would refrain from inappropriate discussions with pupils.
The judge added: 'The claimant has a right to hold his beliefs and to manifest them but he is under the same prohibitions as the rest of society to not discriminate or harass others.
'Every circumstance turns on the particular facts of the claim.
'(The Bishop of Llandaff Church In Wales school) was entitled to want to exercise a degree of control over how beliefs were manifested within the school environment in accordance with the school's values given the potential power imbalance between teachers and pupils and in the context of potentially vulnerable pupils.'

Article continues below Addressing the court as he faced a life sentence behind bars Dighton said in a matter of fact tone: "I don't care about myself being noticed. Fame is not important to me. What I think is important is having a conversation about where Britain is right now. Whether violence against the state is justified. "Has the state got to a point where violence is justified? You have grooming gangs and Boris Johnson having parties in lockdown. Open corruption. You have the Tavistock Clinic mutilating children. 'I have been watching this for 15 years…this is years of build up. People have such a short memory. ‌ 'I will be done. It doesn't bother me." Dighton was armed with a knife, sharpened poles and Molotov cocktails when he attacked Talbot Green police station on January 31 this year. Today he was jailed for life with a minimum of 22 years in prison for the attack. The loner, who lived in Pontyclun, previously admitted 10 charges relating to the attack, including attempting to murder of a police officer. ‌ Dighton, who the court hard has been of good behaviour in custody and had no previous convictions, was considered to have been motivated by terrorism, the judge said. He had shown no remorse for the attack which left police officers needing hospital treatment and still held "rigid" and extremist views. The former prize winning student, who won a Wales-wide competition in advanced mechanical engineering for his computer-aided design of a wobbler engine aged 18, told the court his unhappiness with the system had begun at school. Diagnosed with Asperger's aged seven he spent two years at a special educational needs primary before going on to mainstream secondary and university. The court heard he had had some mental health problems and a "difficult" family upbringing. When I saw images of the homes of immigrant families in Ballymena with loyalist flags placed in their windows to ward off racist mobs, and fearful handmade posters reading 'I work in a care home', I felt as if I was back there. It was all so horribly, desperately, familiar. I grew up about ten miles from the epicentre of the anti-immigrant rioting, in my hometown Antrim. Ballymena and Antrim are like twins. Same people, same problems, same hate. Loyalism runs strong here, as it does in other towns where violence spread: Larne, Portadown, Newtownabbey, Carrickfergus. As a young reporter, I covered crime and terrorism in these places. Read more from Neil Mackay: Back then, the towns of County Antrim were dominated by loyalist paramilitaries. Other areas had Republican gunmen and the IRA. Where I grew up, the UVF and UDA were in charge. Though there's always exceptions to the rule. Republican areas had loyalist pockets, and vice versa. Nothing is ever simple in the north of Ireland. My own family history was far from simple. On my maternal side, it was all Irish, Republican and Catholic. On the paternal side, all British, Loyalist and Protestant. Only in a place like Northern Ireland could the term 'mixed marriage' exist into the 21st century. So I got to know what makes both sides tick. I learned to understand – not accept, just understand – their hatreds. When I learned enough, I'd had enough. That's why I left and have lived in Scotland these last 30 years. I couldn't bear the place anymore. Though, in my heart, I still love its beauty, and its people. When my people are good – on both sides – they're very, very good. When they're bad, they're monsters. There's a terrible truth about what has happened in Northern Ireland, which might help folk in Scotland, bewildered by the labyrinthine history and tribal complexity of my country, understand the deep roots of recent events. Read more: The truth lies in what's called the 'siege mentality' of Ulster's loyalists. I deliberately differentiate between loyalism and unionism. Unionism is a perfectly respectable, mainstream political position. Loyalism has much darker shades to it. Everything is on a spectrum in Northern Ireland. There is, after all, a world of difference between an Irish nationalist who believes in gaining a United Ireland through democratic means, and an advocate of the IRA and armed republicanism. Loyalism's siege mentality has deep roots in the past. It goes back to the Plantation of Ulster in the 1600s, when mostly Scottish Protestants settled lands once owned by Irish Catholics. In effect, Ireland became the first 'British' colony, and Ulster was ground zero. To take someone's land you must fight them, and that means you must kill them and they'll kill you back. To kill people, you must learn to hate them. Therein lies the source of loyalism's siege mentality. Loyalists just never felt safe on the land they took. Why would someone from Ireland, like me, have a name like 'Mackay'? The plantation is your answer. Sometime, long ago, my paternal Scottish ancestors colonised the land which my maternal Irish ancestors owned. Siege mentality requires a sense of your own supremacy. You must think: this is my land, nobody else deserves it. Wars and bloodshed have come and gone, but such ancestral traits are hard to shake. All of us carry some burden inherited from our grandfathers and grandmothers. The Troubles are over. Such a ghastly euphemism for what it was: an ethnic civil war of neighbour against neighbour. But grievance and supremacy linger on. To many hardline loyalists, this land is still their land and nobody can claim any right to it; others do not belong, just as Catholics once didn't belong. You can see how such deep psychological currents can easily wash up against the shores of present-day racism and anti-immigrant hate. Thus, all those loyalist flags placed in immigrant windows; thus, all those signs saying 'we're local, we work in care homes'. It was an attempt to say 'we don't threaten you', 'we aren't here to take what you believe is yours'. Even after the riots began, politicians from the hardline Traditional Unionist Voice party talked of 'the influx of Roma' and 'very real grievances' among the people of Ballymena. So far, it appears that loyalist paramilitaries are not orchestrating the violence. Yet. Though the burning of homes has called to mind images of loyalist mobs burning Catholics out of Belfast at the start of the Troubles: the trigger for the arrival of the British army. Aaron Edwards, a Northern Irish security analyst and author who I know and whose work on loyalism I respect, says the absence of loyalist paramilitaries 'may not last for long'. The areas where rioting happened are poor. It is easy for violent men to exploit marginalisation and deprivation. Evidently, supremacy and poverty are a combustible mix. Nor can we forget the long links between loyalist terrorists and the British far-right. That truth came roaring into sight during last summer's far-right riots, which spread from England to Ulster. These are dangerous times in Northern Ireland, where violence and hatred are never far from the surface. What we're seeing may look very new – very 21st century – but the tragedy is that this is a very old toxin still poisoning the country that I both love and loathe.

Several schools, children who attend them and their parents, previously brought legal action against the Treasury, claiming the policy of applying VAT to fees is discriminatory and incompatible with human rights law. This includes children and families at faith schools, and families who have sent their children with special educational needs (Sen) to private school. The Treasury defended the challenges over the policy, which was introduced on January 1, with HM Revenue and Customs and the Department for Education (DfE) also taking part. Nearly 20 families and several faith schools brought the legal challenge (Aaron Chown/PA) Three judges at the High Court dismissed the three challenges in a decision given on Friday. Dame Victoria Sharp, Lord Justice Newey and Mr Justice Chamberlain said in a 94-page decision that while the legislation does interfere with some of the group's human rights, there is a 'broad margin of discretion in deciding how to balance the interests of those adversely affected by the policy against the interests of others who may gain from public provision funded by the money it will raise'. During a hearing in April, Lord David Pannick KC, representing one group of children and their parents, previously told the court in London that for some children currently in private schools their needs are not met by state schools, but the new law applies 'irrespective' of a family's need. The High Court was told that as well as religious beliefs and SEN, some children are privately educated because of a need for a single-sex environment because of previous abuse, or because they are only temporarily in the UK and need to be educated in line with their home national curriculum. Bruno Quintavalle, representing four small Christian schools and parents who have sent their children to them, also previously said the 'ill-thought-out proposal introduced in haste' placed parents in 'impossible positions'. However, Sir James Eadie KC, representing the Treasury, HMRC and the DfE, said abolishing the VAT exemption for private school fees was a prominent feature of Labour's manifesto at the last general election and is expected to yield between £1.5 and £1.7 billion per year.
