Gisele Pelicot settles privacy case with Paris Match magazine over photos

PARIS - Gisele Pelicot, the French woman who became a symbol of courage and resilience during the trial of her ex-husband and 50 other men for repeatedly raping her, has settled with magazine Paris Match after it published photos of her without her consent.
The magazine, owned by French luxury group LVMH, has agreed to make two 20,000-euro ($22,900) payments to associations that support victims of sexual violence, her lawyer Stephane Babonneau said. Pelicot had taken Paris Match to court alleging invasion of privacy, but withdrew her case ahead of a court hearing on Wednesday.
Pelicot's case against Paris Match raised interesting questions about the right to privacy in France, which has strong laws to protect against intrusions.
Pelicot waived her right to anonymity during the rape trial, becoming an internationally recognized figure. The court's ruling would have likely hinged on whether or not there was a public interest in her private life now the trial was over, experts said.
"She became a public figure unwillingly," Babonneau told Reuters. "It didn't mean that because she waived her right to anonymity for the trial, she was giving up her right to privacy."
The pictures of Pelicot and her partner were taken on the Île de Ré, an island off western France where she now lives.
"We had warned Paris Match not to publish these photos ten days before," Babonneau added.
A lawyer for Paris Match didn't immediately respond to a request for comment.
Pelicot has said she "never regretted" going public during the trial, which ended last December. Her ex-husband was found guilty of repeatedly drugging and raping her for almost a decade, and inviting dozens of strangers to their home to rape her while unconscious. The other 50 co-defendants were also found guilty of rape, attempted rape or sexual assault.
Her lawyer said the publication of the pictures shocked her greatly.
Sophie Barre, a member of women's rights organisation #NousToutes, told Reuters the pictures represented another act of violence after the abuse she had endured.
"Her former husband filmed the rapes," she said. "With these pictures, her image is again captured without her consent." REUTERS

Federal prosecutors in Boston had argued that Aleksei Andriunin, the founder and CEO of cryptocurrency "market maker" Gotbit, deserved a 15-month prison sentence after he pleaded guilty in March to charges that he conspired to commit market manipulation and engaged in wire fraud. Instead, U.S. District Judge Angel Kelley sentenced him to just eight months in prison, which he was deemed to have already served based on the time he spent in jail following his arrest in October in Portugal, prosecutors said. Portugal extradited him in February. He now faces deportation. His company Gotbit was meanwhile ordered to forfeit $23 million worth of cryptocurrency as part of a separate plea deal. "We're incredibly gratified by the sentence, and he's looking forward to getting home to his wife and family," Roger Burlingame, his lawyer at Dechert, said. Andriunin and Gotbit were among 15 people and three firms charged last year following a novel investigation dubbed "Operation Token Mirrors," in which the FBI for the first time directed the creation of its own digital token to help catch fraudsters in the crypto market. Before the charges were filed, Gotbit was a premier "market maker" in the cryptocurrency industry, making tens of millions of dollars in annual revenue and employing over 200 people, prosecutors said. Prosecutors said that from 2018 to 2024, Gotbit engaged in "wash trading," a form of sham trading, and market manipulation on behalf of several cryptocurrency clients to help artificially inflate trading volume for their tokens. Prosecutors cited a 2019 interview published online in which Andriunin described developing a code to wash trade cryptocurrencies to artificially inflate trading volume so they could become listed on larger cryptocurrency exchanges. The taxi driver is a repeat offender with five previous speeding offences. The sentencing of five months and two weeks is hardly a deterrent. Just a day before, an elderly pedestrian died after an accident involving another taxi driver near Kallang MRT station. (Woman dies after accident near Kallang MRT station; taxi driver arrested, June 11). I believe more can be done by taxi operators to keep such dangerous drivers off our roads. Pre-emptive measures can be taken. Operators should have a system to monitor cabbies' bad driving habits. Drivers with repeat offences can be temporarily suspended or required to attend safety courses to improve their driving. The Government can consider suspending operators with too many cabbies who are repeat traffic offenders. It could act as a good 'wake-up call' for the operators.
