Court docs: Indiana DCS, police were warned about man jailed in 5-year-old daughter's death

Before she drew her last breath, 5-year-old Zara Arnold asked her father why he hurt her.
'After he stopped choking her the last time that night, Zara told him she was tired and climbed into bed,' her father told investigators, according to a probable cause affidavit for his arrest.
She told her father she loved him as her eyes closed for what police believe was the final time inside a house in the 200 block of North Lasalle Street on the east side of Indianapolis.
The morning of May 19, a 911 call claimed Zara had fallen down the stairs. First responders found the little girl cold, stiff and covered in bruises. The coroner would note abrasions and ligature marks on the girl's neck and chin.
Zachary Arnold, the girl's 41-year-old father, later told Indianapolis Metropolitan Police Department investigators that she never fell down the stairs. He admitted that he'd strangled her the night before after becoming enraged during an argument with his girlfriend.
He said he should have gone back to check on his daughter, as he 'always went back to check on her after choking her,' detectives wrote, quoting Arnold. But he didn't this time because he was "so upset" with his girlfriend.
"Zachary said (his girlfriend) did this to him and is making him out to be a monster," detectives wrote.
The father stands preliminarily charged with neglect of a dependent and murder. An official cause of death remains under investigation.
Arnold's girlfriend told police that while she wasn't home during the attack, the couple spent May 18 and May 19 arguing through social media, phone calls and text messages.
While she was out of the house, Arnold sent her photos of Zara foaming at the mouth. Arnold then called her on FaceTime while choking the girl. He said to call 911 because he was going to hurt the little girl, according to court documents. She told him to stop, but "thought he was just playing," she told police.
Later, she said she didn't call 911 because she feared Arnold.
Court documents and police reports filed during Zara's life suggest a childhood marked by instability and pain. Her mother told police at least three times that the girl was abused by her father. In November 2020, an officer 'observed visible bruising and what appeared to be red hand marks' on the then 9-month-old girl.
At least one of her mother's allegations resulted in an investigation by the Indiana Department of Children's Services, according to court documents filed in a stalking case. It's unclear what, if any, interventions were made by the state agency responsible for children's welfare. "We do not have statutory authority to release any records related to Zara Arnold, due to an ongoing police investigation or criminal prosecution," a DCS paralegal wrote.
Another report made to DCS claimed that Arnold used methamphetamines in front of his daughter and was violent with both Zara and his girlfriend. Zara denied the allegations in an interview with DCS. It's unclear who made this report and when it was investigated, though.
None of the child abuse allegations ever resulted in criminal charges – instead, only protective orders that were repeatedly broken, according to court documents.
Arnold's father faced three separate charges within a month in 2020 for continuing to contact her mother against her will. Once, on the day after he was released from jail, he threatened her in a recorded video call: 'I am coming to your house tonight. I will kill you.' That was one of several death threats, which the girl's mother believed were at least in part due to a custody disagreement.
The custody case, which began shortly after the girl's birth in 2020, remained open at the time of publication. Court records show that Arnold's legal advocate withdrew from the case in June 2024. The advocate's organization, Kids' Voice of Indiana, did not immediately respond to a request for comment.
Zara's mother told police she lost custody of her daughter and hadn't seen her in approximately a year, except for a chance encounter about a week before her death. It's unclear why custody was given to the father despite his violent criminal history, including a rape charge from 2020 that lead to a plea deal.
On May 11, eight days before Zara was found dead, her mother saw the little girl and Arnold at a Wendy's on North Shadeland Avenue. The girl tried to run to her mother, but Zara's father grabbed her by the neck and took off. The mother called police.
The officer who responded to that call tried to locate Zara and her father "with no success, including attempting to locate them at (Arnold's) residence on LaSalle," according to court documents. Video surveillance from the fast food restaurant showed Arnold grabbing the little girl by her neck and putting her in a Cadillac Escalade "in an aggressive quick manner" before driving off. It's unclear when police received this surveillance footage or if any further action was taken.
On May 12, the day after the failed welfare check, Zara's father appeared in court. He pleaded guilty to one felony count of invasion of privacy after showing up at a custody exchange between his girlfriend and her ex-husband, who had a protective order against him.
He was sentenced to 360 days in jail with all 360 days suspended.

A former graphic designer for Sean 'Diddy' Combs testified in federal court on Wednesday (June 4) that Diddy once dangled her over the edge of a 17th-floor balcony during a violent outburst. Per NBC News, Bryana 'Bana' Bongolan told jurors that the 2016 incident occurred at the Los Angeles apartment of Diddy's' former girlfriend, and her longtime friend, Cassandra 'Cassie' Ventura. According to Bongolan, Diddy verbally abused her while holding her over the railing for '10 to 15 seconds,' before throwing her onto patio furniture. 'I was scared to fall,' she recalled on the stand, adding that she had no idea what prompted the outburst. 'You know what the f**k you did,' Diddy allegedly shouted, according to her testimony. She also recalled Diddy allegedly said 'something along the lines of, 'I am the devil and I can kill you,'' and he had taken cocaine at the time of the incident. Bongolan explained that she she was 5'1″ and weighed approximately 100 to 115 pounds at the time. She claimed she attempted to brace herself and push back off him, but ended up with a bruise the size of a softball on her leg and pain in her neck and back. Jurors were reportedly shown photos of her in a neck brace. 'I have nightmares and I have a lot of paranoia,' she testified. 'I used to scream a lot in my sleep, but it's dissipated a little bit.' Even years later, Bongolan said she still experiences symptoms of trauma, including paranoia when opening doors or walking into rooms. She added that while Cassie did not witness the incident directly, she was present in the apartment and emerged from her bedroom in disbelief after hearing the commotion. 'Cassie was in her bedroom but she came out. I heard her voice — her tone was in disbelief,' Bongolan claimed. Following the bizarre alleged incident, the witness said she received a FaceTime call from either Diddy or someone on his team and expressed that she 'did not want any trouble.' She testified that the music mogul remained mostly silent while looking at the camera with his hand on his head. Diddy's defense attempted to discredit Bongolan, alleging she was a heavy drug user and may have been under the influence at the time of the incident — an accusation she denies. However, she did state earlier in her testimony that she and Cassie were both 'regular' drug users while in Diddy's 'social world.' 'We had a problem,' she said. Bongolan's testimony comes after notable figures' including Kid Cudi, Cassie, Capricorn Clark and others. Diddy is facing serious federal charges including: Racketeering Conspiracy; Sex Trafficking by Force, Fraud, or Coercion, and Transportation to Engage in Prostitution. The 55-year-old has denied all criminal allegations. However, FOX News Digital reports that Diddy's legal team acknowledged he committed domestic violence — in an attempt to negotiate lesser state charges and avoid federal prison time. The father-of-seven was arrested in October 2024 at the Park Hyatt in Manhattan and remains in custody. If convicted, he faces a potential sentence of 15 years to life in prison. A man died days after being attacked in the street. On Sunday March 9, Merseyside Police received a report a man had a verbal altercation with a group who then assaulted him in the area of Brighton Street, near Egremont Promenade in New Brighton, at about 8.50pm that night. The victim, 34-year-old Michael Palin, is believed to have sustained injuries to his face and hand. He refused medical attention and returned home on a pedal bike. He was found dead at his home on Oxford Road in Liscard three days later, on March 12. Following a post mortem, the cause of his death has been withheld pending toxicology reports. Enquiries are ongoing to establish the full circumstances into the death. As part of police enquiries, detectives are appealing for the six people in these CCTV images to come forward. It is believed they were on or near a bus that would have passed the scene of the assault. Detective Inspector Andrew Schofield said: 'We know the six people pictured were on or near an Arriva bus that had travelled along Brighton Street at around the time of the assault, in the direction of Seacombe Ferry/Birkenhead. Graphic designer Bryana Bongolan testified that Sean "Diddy" Combs once dangled her off a 17th floor apartment balcony, and that she saw him throw a knife at her friend Casandra Ventura. On Wednesday, prosecutors displayed photos taken by Ms Bongolan and her then-girlfriend of Ms Bongolan's bruises, which she claimed she sustained during the alleged 2016 incident. Combs' attorneys worked to cast doubt on Ms Bongolan's credibility before the jury under intense cross-examination, during which she responded that she could not recall past statements she gave the government. Combs faces charges of racketeering, conspiracy and sex trafficking. He has pleaded not guilty. The federal case, now in its fourth week of testimony, followed dozens of civil lawsuits filed against him by men and women accusing him of abuse, including both Ms Ventura, who is Combs' ex-girlfriend, and Ms Bongolan. Ms Bongolan said she met Ms Ventura in 2014 when she worked for the brand, Young and Reckless. Later, as the head women's designer at Diamond Supply Co., she was assigned to work with Ms Ventura on creating a collection and the two became close. Ms Bongolan testified they often took drugs like cocaine, ketamine and marijuana together. She later alleged that she procured drugs for Ms Ventura, and that the R&B singer paid her for them. She also acknowledged that she and Ms Ventura had a "problem" with drug use, but that she was currently sober. Ms Bongolan testified that during the friendship, she saw signs of Combs' alleged violence. She said once saw Ms Ventura on FaceTime with a black eye, and that the rapper would often pound on Ms Ventura's apartment door at night. In September 2016, Ms Bongolan testified that she heard banging on Ms Ventura's front door when she and her girlfriend were sleeping on the couch. She hid her girlfriend in a bathroom and went to the balcony, then Mr Combs entered the apartment, and allegedly picked her up and lifted her onto the ledge, she told the court. She said he repeatedly yelled, "You know what the (expletive) you did", and then threw her into the balcony furniture. Prosecutors showed the jury photos of a puncture and bruise on Ms Bongolan's leg, along with accompanying metadata displaying the date they were taken. She also testified she suffered night terrors and paranoia as a result of the evening. In another incident she described, Combs burst into Ms Ventura's apartment and allegedly threw a knife at the R&B singer. Ms Bongolan said Ms Ventura picked the knife up and threw it back. Neither of them was injured, she said. Once during a photoshoot in Malibu with Ms Ventura, Ms Bongolan alleged that Mr Combs got in her face and told her, "I'm the devil and I could kill you". "I was terrified," she told the court. During cross examination, Mr Combs' defence attorney sought to undercut Ms Bongolan, who struggled to answer questions about her statements in previous meetings with prosecutors. Nicole Westmoreland repeatedly asked Ms Bongolan about what she told government prosecutors when she first met with them in January 2024. Several times, she asked her about the alleged balcony incident, but the witness struggled to recall details she described at the initial meeting. During her testimony two weeks ago, Ms Ventura, the prosecution's key witness told the court, "I saw him bring her back over the railing of the balcony and then throw her onto the patio furniture." Ms Westmoreland also asked Ms Bongolan about her initial account of the incident in Malibu. The defence attorney said Ms Bongolan originally told government prosecutors that Combs made that threat at a party, and Ms Bongolan testified she could not recall that conversation. As the afternoon wore on, Ms Bongolan increasingly repeated that she could not recall details of previous conversations with prosecutors. At one point, Ms Westmoreland asked Ms Bongolan to recall her conversations with prosecutors two days prior. Asked about specifics, Ms Bongolan answered that she could not remember. The court also heard on Wednesday from forensic video editor Frank Piazza, who took the jury through recordings of the "Cassie video", which shows Mr Combs beating Ms Ventura in a hotel hallway in 2016. He explained that the recordings were untampered with and were an accurate depiction. Ms Bongolan is expected to return to the stand Thursday.
