Lab tests connect black bear killed by Florida wildlife officers to fatal attack on man and his dog

JEROME, Fla. (AP) — Lab results have connected one of three black bears killed by wildlife officers in southwest Florida to a fatal attack on a man and his dog a day earlier, officials said Friday.
Necropsy results revealed that a 263-pound (119-kilogram) male bear contained the partial remains of 89-year-old Robert Markel, the Florida Fish and Wildlife Conservation Commission said in a statement. Testing showed that same bear's DNA was present on Markel's body, inside his home and on the dog's body.
Wildlife officials have not explicitly said that bear is the one that killed Markel, but a preliminary autopsy by the Collier County Medical Examiner found that Markel's cause of death is consistent with a bear attack.
Markel was attacked early Monday near his home in a rural area east of Naples, just south of Big Cypress Wildlife Management Area.
Wildlife officers set several traps and cameras. They killed three black bears in the area and sent their remains to a Gainesville lab. None of the animals tested positive for rabies, officials said.
Wildlife officials are still investigating the events that led to the attack.
Florida's black bears, which were once threatened, have increasingly wandered into neighborhoods and private property in recent years, especially in more rural areas of north and central Florida.

Orange deputy shoots attacker who punched him in face more than 20 times in Pine Hills, sheriff says

An Orange County deputy sheriff shot a man who attacked him Saturday morning while he was checking on a suspicious person behind a Pine Hills discount store, according to Sheriff John Mina. Mina, who declined to identify the man or the deputy who shot him, said he will be charged with aggravated battery on a law enforcement officer plus additional charges related to the firearms he had. First aid was provided on scene for the man's gunshot wounds until paramedics arrived to transport him to a hospital where he was last reported in stable condition, the sheriff said during a news conference a few hours after the altercation. The deputy was also taken to a hospital to be checked for a head injury and is currently in good condition. 'This case just illustrates how dangerous it is for our deputies, Mina said. 'One minute our deputy's helping this guy over the fence to find out what he's doing and within seconds he's being punched in the face … in a fight for his life. 'I'm extremely proud of the deputy and the training that we put our deputies through because it showed in this fight. The sheriff said the incident began around 8 a.m. when the deputy approached a man in a fenced-in area behind the Save Discount store on North Hiawassee Road to ask what he was doing there. The man jumped the fence as if he was going to speak to the deputy but instead grabbed a bag off the ground and tried to flee. The deputy grabbed the man to detain him but he started punching him in the face repeatedly. 'He punched him in the face probably 10 times. Our deputy was in this struggle (and) fight with this man for a minute and 16 seconds,' he said. 'This is an extremely long time to be in a fight, especially when you're being punched in the face.' During the altercation the deputy fell onto his back and the man punched him in the head at least 10 more times, Mina said. As the struggle continued two objects, later determined to be handguns, fell out of the man's bag. 'The man ran toward those firearms, picked those firearms up, and that's when our deputy used his service weapon and struck the man several times.' he said. Mina said the man has an extensive criminal history of 'just doing bad guy stuff from robbery to larceny to a slew of other charges.' Video of the altercation obtained from the deputy's body-worn cameras will be released as soon as possible, he said, adding there is also footage from the store's surveillance camera. The Florida Department of Law Enforcement will investigate the incident, as is standard in officer-involved shootings, and turn its findings over to the State Attorney's Office. Once that review is complete the Sheriff's Office will do an internal investigation. The deputy is being put on paid administrative leave — also standard procedure.

Former Proud Boys leader Enrique Tarrio, 4 other members sue U.S. government over Jan. 6 prosecutions

Five members of the Proud Boys, a far-right militant group, claim their constitutional rights were violated when they were prosecuted for their participation in the Jan. 6, 2021, attack on the U.S. Capitol, according to a lawsuit filed Friday. The lawsuit was filed in Orlando federal court by former Proud Boys chairman Enrique Tarrio, Joseph Biggs, Zachary Rehl, Ethan Nordean and Dominic Pezzola. It seeks unspecified compensatory damages plus 6% interest and $100 million plus interest in punitive damages. FILE - Proud Boys leader Henry "Enrique" Tarrio is seen during a rally organized by the Proud Boys in Portland, Ore., on Sept. 26, 2020. Allison Dinner / AP "There was hostages in this country," Tarrio said during a news conference Friday afternoon. "It's not about any other country today, and that's why this lawsuit is so important to bring back law and order into our system." The lawsuit claims the men were arrested with insufficient probable cause and that government agents later "found" fake incriminating evidence. They also claim they were held for years in pretrial detention, often in solitary confinement. "The Plaintiffs themselves did not obstruct the proceedings at the Capitol, destroy government property, resist arrest, conspire to impede the police, or participate in civil disorder, nor did they plan for or order anyone else to do so," the lawsuit said. Tarrio, Biggs, Rehl and Nordean were all convicted of seditious conspiracy and other crimes for their participation in the Capitol riot that sought to stop Congress from certifying former U.S. President Joe Biden's win over President Donald Trump in the 2020 presidential election. Pezzola was acquitted on the conspiracy charge but convicted of stealing a police officer's riot shield and using it to smash a window. After returning to office earlier this year, Trump granted pardons to almost all of the more than 1,500 people who stormed the Capitol. While Tarrio received a pardon, the other four plaintiffs had their sentences commuted. The lawsuit said all four applied for pardons on May 13. The U.S. Justice Department didn't immediately respond to a message seeking comment.
