Supreme Court stays ED probe in TASMAC liquor ‘scam' in Tamil Nadu

The Enforcement Directorate is crossing "all the limits" and violating the federal concept of governance, the Supreme Court on Thursday (May 22, 2025) said while staying the money laundering probe against Tamil Nadu-run liquor retailer TASMAC over alleged corruption in grant of wine shop licences.
Issuing notice to the ED on pleas filed by the Tamil Nadu government and the Tamil Nadu State Marketing Corporation (TASMAC), a bench comprising Chief Justice B R Gavai and Justice Augustine George Masih told Additional Solicitor General S V Raju, appearing for the anti-money laundering probe agency, that 'Your ED is crossing all the limits.' 'The Enforcement Directorate is violating the federal concept (of governance),' the bench observed, adding that the ED's probe against the state-run TASMAC will not proceed in the meantime.
The law officer opposed the order, saying the issue involved corruption over ₹1,000 crore and the ED is not crossing the limits 'at least in this case.' The bench took note of the submissions of senior advocates Kapil Sibal and Amit nand Tiwari that the state itself has lodged over 40 FIRs in cases related to allotment of liquor shop licences from 2014 and now the ED jumps in the picture and raids the TASMAC.
'How can you raid the state-run TASMAC,' the bench asked.
The DMK-run state government and TASMAC moved the top court against the raids conducted by the ED at the premises of TASMAC.
The pleas challenged an April 23 order of the Madras High Court dismissing its pleas giving the go ahead for the ED action.
The ED was allowed to proceed with its action under the Prevention of Money Laundering Act (PMLA).

New Delhi: The Supreme Court on Thursday refused to grant interim bail on medical grounds to the founder of a Noida tech firm, Arif Nisar, who is a key accused in a money laundering case linked to Vuenow Marketing Services over rotating money between old and new investors in the guise of sub-leasing cloud particles. Counsel appearing for Nisar told the bench of Justice PK Mishra and Justice Manmohan that he needs an injection and a surgery to save the eyesight of his right eye. However, the top court noted that there were no such recommendations by the doctors on the need for his hospitalisation. At this point, Nisar asked for a fresh examination by doctors, but the court refused his request. The top court granted him the liberty to approach the high court if the doctor recommended hospitalisation. The Enforcement Directorate (ED) arrested Nisar, a key figure in Vuenow Marketing Services Ltd, as part of a money laundering investigation linked to the company and its associated entities. The probe agency in its investigation said that Zebyte Infotech Private Limited (ZIPL) and Zebyte Rental Planet Private Limited, affiliates of Vuenow Group, were rotating the money of new investors to the old ones in the guise of sub-lease rent of cloud particles. As such, no rental income was generated from any clients who purported to have taken cloud particles on rent, the Enforcement Directorate said. According to the Enforcement Directorate, Nisar, who holds 75 per cent shareholding in ZIPL, is a mentor and founder of VMSL group and a close associate of Sukhvinder Singh Kharour. Kahrour is said to be the mastermind behind this alleged scam. The ED had also arrested Vuenow Group chief executive officer Sukhvinder Singh Kharour and his wife Dimple Kharour, who are allegedly involved in cheating people on the pretext of selling to them "cloud particles (servers)" and leasing them back on the assurance of providing monthly rental income to the investors. The probe agency said that funds to the tune of Rs 3,558 crore were raised through the alleged scam. What is the scam The case stems from an allegation that promoters and directors of these firms were running a scheme in which they lured people into investing in cloud particles or servers, for which they offered guaranteed rental returns of 48 percent per annum. They allegedly told the investors they would rent out these cloud particles to clients, and the rental income would go to them. But, it is alleged by the probe agency that there were no clients. Instead, new investors were brought in to pay the old investors, using the bank accounts of sister firms Zebyte Rental Planet Pvt Ltd (ZRPPL) and Zebyte Infotech Pvt Ltd (ZIPL).

The Enforcement Directorate (ED) on Thursday conducted a large-scale search operation at 24 locations across Rajasthan and Gujarat in connection with a money laundering case worth ₹2,700 crore linked to the Nexa Evergreen project. 'ED has recorded an ECIR (Enforcement Case Information Report) on the basis of FIRs filed by Rajasthan Police against Nexa Evergreen. They duped investors to the tune of ₹2,700 crore by luring them with promises of high returns and land plots in Dholera city, Gujarat. Searches were conducted at 24 locations in Sikar, Jaipur, Jodhpur, Jhunjhunu, and Ahmedabad,' sources said. The company is accused of defrauding nearly 62,000 individuals, primarily by offering affordable flats and land parcels in Dholera, Gujarat. In cases where land could not be allotted, investors were promised high-interest returns. Although some received possession initially, the scheme was later exposed as fraudulent, leaving most investors without recourse. A senior official told Business Standard that the company had raised around ₹2,700 crore from investors through misleading assurances. The company's promoters, Subhash Bijarniya and Ranveer Bijarniya—both from Sikar in Rajasthan—allegedly targeted both civilians and government employees, including members of the police and armed forces. The duo marketed a scheme that promised to double investments within 14 months. Nexa Evergreen's background Nexa Evergreen Private Limited is a Gujarat-based real estate firm incorporated on 17 April 2021 and registered in Ahmedabad. The company claims to be engaged in buying, selling, and developing residential and commercial land. Separate ED action in Jaypee Group case last month Last month, the ED said it had seized ₹1.7 crore in cash and documents related to immovable assets during raids against Jaypee Infratech Ltd (JIL), Jaiprakash Associates Ltd (JAL), and associated entities in a separate money laundering investigation linked to alleged fraud involving homebuyers. The searches were carried out on 23 May at 15 premises in Delhi, Noida, Ghaziabad, and Mumbai under the Prevention of Money Laundering Act (PMLA). "The search covered offices and premises of JAL, its related entities, and its promoter directors," the agency stated. Searches were also conducted at premises associated with key business partners of JAL, including Gaursons India Pvt Ltd, Gulshan Homz Pvt Ltd, and Mahagun Real Estate Pvt Ltd, the statement added.

SALEM: Tamil Nadu cheif minister M.K. Stalin said during a government event in Salem on Thursday that proud Tamils will never let New Delhi rule the state. 'The people endorse a Dravidian model government that can uplift Tamil Nadu despite obstacles and steer through difficulties. This support will persist in 2026, just as it is currently,' CM Stalin said. He was responding to Union Home Minister Amit Shah 's recent remarks during his Madurai visit, where Shah accused the DMK government of altering Union government schemes and preventing the public from receiving benefits. Stalin countered the claims by saying, 'However, the reality is that the state government is allocating additional funds, contending that the drinking water and housing construction initiatives cannot advance with the budget provided by the Union government.' He added that the state government is funding over 50 percent of the cost for projects that are named after the Prime Minister. Quoting a line from the film Padayappa, Stalin remarked that just as the groom in the film wears a shirt that belongs to someone else, the state is also financing Union government projects. He further accused the Union government of trying to suppress and undermine Tamil Nadu's heritage. Stalin also criticised AIADMK general secretary Edappadi K. Palaniswami (EPS), stating that the Leader of the Opposition has aligned himself with Delhi and lacks the courage to question them. 'The public is rejecting their coalition because they are marginalising Tamil Nadu with anti-Tamil Nadu sentiments and ideologies,' Stalin asserted, adding that the AIADMK and its allies are forming alliances just to safeguard their positions. He went on to say that when the rights of Tamil Nadu were taken away, the AIADMK and its allies remained silent and did not object to what he termed as the BJP's indirect rule in the state. 'Even now, Amit Shah is openly declaring that the BJP will form a coalition, yet he (EPS) stays silent, putting his own selfish interests first,' Stalin claimed, adding that EPS has betrayed his own party. He concluded by saying the public is well aware and will not be misled into accepting EPS again.
