‘Comedy of errors': NDIS reform leaves disabled Australians fearing what comes next

For people with disability, the end of 2024 was a rollercoaster.
New legislation for the National Disability Insurance Scheme started coming into effect in October, with new lists of what can and can't be funded, changes to early intervention requirements and more, already altering the way some 646,000 people receive support from the $35bn program.
The reforms are not yet complete, though, and March is shaping up to be crunch time: that's when consultation is expected on things like the support-needs assessment tool – a framework for determining a person's impairments and how much public money should be allocated to them. But the timelines are so tight, and the space for consultation so narrow, that advocates say the promised co-design on critical parts of the new system is all but impossible.
So-called 'foundational supports', to be provided by the states and territories and agreed upon by national cabinet more than a year ago, are supposed to be in place by 1 July. But despite the new legislation already restricting access and support to the NDIS, there is very little agreement on what those foundational supports actually are, let alone the architecture in place to provide them.
Throw in a new NDIS minister and a looming federal election, and anxieties in the sector are high.
Making it worse is the undercurrent of palpable fear from people with a disability that they will receive a letter from the National Disability Insurance Agency (NDIA) telling them they may no longer be eligible for the scheme that has been a salvation for many – and which they were told would be for life.
This is the context in which a decision by the Administrative Review Tribunal came this month, calling into question the legal basis for the NDIA's practice of reversing the onus of proof of eligibility and placing it on to participants.
Veronica Stephan-Miller, the woman at the centre of that case, says her recent engagement with the NDIA has been so stressful that at times she stopped eating.
Stephan-Miller, who has fibromyalgia, chronic fatigue syndrome, ischaemic heart disease and ankylosing spondylitis, received notice that her eligibility was under review in March last year. The NDIA mails these notices, giving participants 28 days from the letter's date-stamp to respond with more information or they will make a decision based on what they have.
'I have a PO box,' says Stephan-Miller. 'And at that time I wasn't getting my mail regularly, so it was 10 days before I actually picked the letter up. I went into panic mode.'
The rheumatologist Stephan-Miller needed to see was booked out for months and it was 'a comedy of errors' trying to secure an extension to the 28-day timeline. A disability pensioner, she had to crowdfund to pay for the new assessments. All the way through, she kept trying to find out precisely what information the NDIA was lacking.
'I asked 'What do I need to submit?' I asked the plan reviewer. I asked the assessor. I emailed the office of the CEO, and they would not give me a definite answer,' Stephan-Miller says.
The opaque and time-sensitive nature of the reassessments is not only alarming but can border on the absurd: one advocate told Guardian Australia of a person whose eligibility was reviewed not due to lack of evidence of their permanent disability, but because the agency didn't have a copy of their ID on file – a fact that only became clear after repeated inquiry.
People with disability say this practice of reversed onus of proof, which began before the new laws came into effect, has shades of the robodebt fiasco – in which welfare recipients were forced to prove they did not owe a debt to the commonwealth, rather than the commonwealth proving that they did – and it's just as distressing.
It's frustrating, too, for the allied health workers who provide the documentation, particularly functional capacity reports, that the NDIA uses to determine eligibility and funding levels.
Muriel Cummins, founding director of Occupational Therapy Society for Invisible and Hidden Disability, says 'the pace of reform is going at an absolute gallop' but allied health professionals have been left entirely out of the loop by the government and the agency, despite the critical place of their work in the system.
'We're seeing people who have conditions like [multiple sclerosis] and Parkinson's, which are lifelong, permanent and often degenerative conditions, receiving notices for eligibility reassessments. It's a real shock for the participants, and it's also a real challenge for us as therapists to understand what the NDIA is actually asking for,' Cummins says.
Anecdotal reports suggest eligibility reassessments are often triggered by plan review requests, and at a Senate Estimates hearing in November last year, NDIA acting chief executive Scott McNaughton seemed to confirm this. Not only was the agency prioritising 'unscheduled reassessments' of eligibility, he said, but they may be triggered by the planner. He also disclosed that 1,200 NDIS participants, mostly children, were being reassessed every week, with nearly half of them booted off the scheme.
Jeff Smith, chief executive of Disability Advocacy Network Australia (Dana), says without foundational supports in place to catch them, the sudden removal of NDIS access has profoundly negative consequences for people.
'The approach here might be OK under the letter of the law, but it certainly breaks the spirit of the legislation. It's certainly inconsistent with the idea that the changes that we make will take place in lockstep with the implementation of foundational supports, so that people are looked after under some system or another,' says Smith.

Dana wants the NDIA to 'slow things down' and extend all the timeframes to at least 90 days.
There are problems on the provider end, too. Rodney Jilek, founding director of Community Home Australia, says ongoing delays in plan reviews are leaving participants without funds and putting providers in the position of being forced to withdraw care.
Jilek's Canberra-based not for profit provides supported homes for people with neurocognitive disabilities, often progressive, who require round-the-clock care. But at Christmastime he had to make the decision to move a client with Huntington's chorea to a hospital after waiting for a plan review for around six months.
'His care needs were through the roof. He exhausted all his funding … and we were just told, 'Oh, well, you just have to provide care for free'. That's $11,000 a week,' Jilek says.
'We kept doing it for as long as we possibly could. In the end, I rang the NDIA and said, 'I can't keep doing this. I can't provide supports for free'. And they said to me, 'Well, why are you doing it?' They said, 'You need to make a business decision and withdraw care, withdraw supports'. So I did. I sent him to hospital, and he got a new plan within 24 hours.'
The experience was 'incredibly upsetting for everyone,' Jilek says.
In addition, Jilek says the agency's focus on possible provider fraud has caused such a bottleneck in payment of accounts at the NDIA that he found himself $540,000 short at the end of last year. While the NDIA has caught up on many of the payments, the delays have had ongoing implications for his tax affairs.
'I had to take out a cashflow loan just to actually pay people because we were owed so much money,' Jilek says. 'I kicked and screamed and I virtually cried on the phone … I had to put in $450,000 of my own money to keep the business afloat, because we were basically bankrupt.'
In response to questions from Guardian Australia, the new NDIS minister Amanda Rishworth said she was in the process of arranging meetings with representatives of the disability community to discuss matters related to the scheme.
'I take any allegations of misconduct or unlawful practices very seriously, and I have sought advice from the NDIA on their eligibility reassessment processes and evidentiary requirements to understand the issues raised,' Rishworth said.
A spokesperson from the NDIA said the additional 1300 frontline staff recruited in the last financial year had reduced delays, and that the investment was continuing.

" Dance Moms" star Abby Lee Miller sued a prominent Los Angeles hospital on Tuesday, alleging that doctors left a foreign object in her body after performing surgery. Miller, known for her starring role on the hit reality TV show, is suing Cedars-Sinai Medical Center and two doctors for medical malpractice, professional negligence and medical battery. The 59-year-old former reality star alleges that the physicians left a catheter inside of her abdomen after she had spinal surgery in 2020. She is seeking nearly $1.5 million in damages. "Abby Lee Miller suffered for years from an object left inside of her during spinal surgery; despite complaints to various physicians, not one ordered imaging of any kind to diagnose the source of her pain," Nadine Lewis, Miller's attorney, said in a statement. Since the surgery in 2020, Miller — who is paraplegic — said she repeatedly reported the discomfort to physicians who "systemically dismissed her chronic pain and let her suffer for years with a catheter inside of her abdomen," the suit reads. Miller's abdominal discomfort "had escalated into persistent and debilitating pain, impacting her quality of life on a daily basis" by March 2024, according to the suit. Later that year, while she was seeking care for an unrelated issue at a different hospital, she was referred to an emergency room for the pain. Two days later, in June 2024, a CT scan revealed that a foreign object was inside her abdomen, the suit says, and she had the bright blue catheter surgically removed. "This is not just medical battery, it reflects a larger, devastating truth: women's pain is too often ignored or dismissed by the very professionals sworn to care for them," Lewis said. "Abby's case is a chilling reminder: even when women are vocal and visibly in distress, their pain is still not believed." A spokesperson for Cedars-Sinai said in a statement that the hospital can't comment pending legal matters nor discuss any patient's medical treatment due to federal and state privacy laws. "However, the care and safety of our patients, staff and visitors are always Cedars-Sinai's top priorities," the hospital said. "We are dedicated to ensuring that we meet the highest standards of care for all those we serve." A receptionist for Dr. Hooman Melamed, one of the physicians Miller is suing, hung up the phone when asked if the doctor would like to comment. Dr. Paul Dwan, the other physician cited in the suit, declined to comment.

Next to the bed Steven Rieger spends most his life in is a framed print that says: 'This is my happy place.' For him, it is – his small room on the eastern outskirts of Melbourne is covered in Collingwood paraphernalia and basked in warm light. Steven, 37, needs round-the-clock care. He lives with cerebral palsy, is nonverbal and suffers from seizures – natural light can trigger them so he spends almost all of his time in his room. His parents are both in their 70s – his father Rodger has had several strokes and is partly deaf. His mother, Kathy, who has cared for him most of his life, is dying – her breast cancer has metastasised, spreading to her bones and brain. In March, the family lost their national disability insurance scheme (NDIS) funding, and Steven's paid carers felt obliged to work for free – the family could not cope by themselves. They had been overspending on their plan, but the family say they were underfunded for their care needs. When the money ran out they panicked. Steven's sister Kylie started a GoFundMe and Kathy rang their local member of parliament, Julian Hill. They have now been put on a plan that provides 10 hours of care a day, but they need more. 'It was almost three weeks where there was no funding,' Kathy says. 'The carers that do look after Steven were nice enough to still come in here, but they weren't getting paid. They were doing their normal shifts but without pay.' Sign up for Guardian Australia's breaking news email Advocates say participants have become collateral damage as the NDIS goes through massive changes, with many plans expiring and reviews dragging on. They say crucial funding is not getting where it needs to go. In January, Kathy had started preparing everything for the annual review of Steven's plan. As she was getting sicker she knew they needed to be funded for 15 hours of care a day. 'It was very stressful for me,' she says. 'I was getting things organised … and hoping the funding wouldn't run out, but it did. 'We started calling NDIS a few weeks before this funding was going to run out, and they said it wouldn't run out. They said they would escalate [the case] every time.' The family say they now owe around $15,000 to carers for the three weeks of work. Twice a day, Steven is lifted into a chair and fed through a drip. El Gibbs, CEO of the Disability Advocates Network Australia, says the NDIS is delaying plan renewals for so long, people run out of personal funds. 'We had a meeting a few weeks ago, and all our members reported a 50% or more increase in their waiting list for help with AAT [administrative appeals tribunal] appeals, where people with disability and their families are fighting for the support that they need,' Gibbs says. Under the changes, NDIS plans are meant to automatically continue if the review has not taken place yet. Because the Riegers were asking to increase Steven's care hours, their plan ran out. The last quarterly reports show an increase in participants taking their review decision to the AAT, with the number of new cases as a proportion of active participants increasing from 0.66% in the March 2023 quarter to 1.05% in the March 2025 quarter. Gibbs says the delays mean people in crisis are falling through the cracks, as is the case for the Riegers – Steven's funding running out while Kathy is dying worsens the family's situation. 'If a family goes through a crisis, and informal supports aren't there any more then, of course, the NDIS needs to step in and do it quickly and make sure a terrible situation isn't made harder.' Gibbs says vulnerable families should not be accruing debt to get the right care and the massive reforms to the NDIS need to be more clearly communicated. 'At the moment, the changes are often rushed and harsh, and the communication about them isn't clear to people with disability, to families, to support coordinators,' she says. 'So it is really hard for everyone to understand what is happening and to have a clear pathway about what comes next.' A spokesperson for the National Disability Insurance Agency said its priority was 'ensuring every participant, like Steven, has access to the disability-related supports they require'. 'The agency continues to work with Steven and his parents regarding his future needs. 'When a participant's circumstances change a request for an early plan reassessment can be requested. The agency cannot make decisions to change a participant's plan without being provided appropriate evidence.' Jenny McAllister, the minister for the NDIS, was contacted for comment. An occupational therapist report to possibly increase Steven's care to 15 hours a day is set for three weeks' time, but Kathy is struggling. 'I physically can't care for Steven any more,' she says. 'With extremely high needs like Steven's, there shouldn't be a review in their plan. They're not going to get better. There's no change. 'They're not going to wake up one day and go, 'Oh, hi Mum, I'm all good. I'm going to work now.''

A former binge-drinking DJ who weighed over 22 stone (140kg) has revealed he shed a colossal amount weight in just one year by ditching ultra processed foods. Liam Miller, 35, from Cheshire, lost a mammoth 7st 8lb (48kg) after realising he had 'no control' over his eating and drinking habits. The former DJ said he used to only eat unhealthy processed meals, starting the day with croissants before snacking on sweets and crisps and ending on a takeaway. 'I just couldn't look after myself - I was drinking very heavily and had no control over my eating habits as well', he said. 'I'd be staying up until 3am, whether that was trying to make beats or smoking. I was waking up and not liking the person that I was looking at in the mirror. 'To put on a white t-shirt, a double XL and look at myself, that was really hard', he told his brother, Sean, on his podcast. But, after hitting rock bottom — regularly spending up to £350 a week on drugs and alcohol — he knew it was time to change his destructive habits. Mr Miller put his weight and low mood down to his lifestyle, which often saw him begin partying on a Wednesday and continue for the rest of the week. He said that admitting he had a problem was the hardest part of the journey. Mr Miller began to turn things around with the help of his brother, Sean, 37, a personal trainer and fellow former DJ who gave up the career in pursuit of a healthier lifestyle. 'He gave me the power to take that first step, and sometimes that is all it takes to completely transform your life, Mr Miller said. He started with a 'benchmark' of two 5-kilometer-long runs a week and completely changed his diet - swapping the takeaways for whole foods. These are foods that like that are not or minimally processed like fresh fruit and vegetables and whole grains. Mr Miller said changing his diet made the biggest difference in his transformation. 'Nutrition is the most important thing. Just changing from an ultra-processed diet to a whole foods diet will make a massive impact,' he said. Mr Miller now has a protein packed breakfast of eggs and sourdough bread, snacks on fruit and oats to boost his fibre intake and has protein paired with either rice or potatoes for dinner. 'It wasn't long before my body began thanking me' he said. 'I found it easier to get up in the morning, after previously sleeping until midday. 'I was losing around a kilo a week, so the results weren't massive to start with. But I had a lot more energy and it aggressively snowballed from there,' he added. He then began to train more with his brother, starting with three at-home full-body sessions a week, using resistance bands, alongside his running and diet. This combination of healthy eating and exercise completely changed his life, providing him with the discipline and stamina to run this year's London Marathon. 'The resistance band training led to me joining the gym and starting a weight training routine, and the 5k built to 10k, which built to a half marathon and then a marathon.' 'I now have quite the routine with a lot of discipline', he added. He added that the mental transformation he experienced has had a much more profound impact on his life than his physical one, enabling him to reconnect with his family. 'My productivity levels almost ten-folded over night because I went from somebody that couldn't get up in the morning to waking up at 5am every single day,' he said. The Nova system, developed by scientists in Brazil more than a decade ago, splits food into four groups based on the amount of processing it has gone through. Unprocessed foods include fruit, vegetables, nuts, eggs and meat. Processed culinary ingredients — which are usually not eaten alone — include oils, butter, sugar and salt 'When I was deep in the DJing and drinking, I neglected all my family. I've now spent time rebuilding those relationships' he added. Mr Miller now hopes to inspire other people looking to make a similar transformation but warns there are no shortcuts. 'You have to do the work, there are no shortcuts, but don't be afraid of making a start. 'A lot of people don't originally start this journey because they're scared on failure', he said. 'Nutrition is the most important thing. Just changing from an ultra-processed diet to a whole foods diet will make a massive impact. 'I also recommend resistance training, which is the bread and butter foundation of my training. 'But at the end of the day, it's important to find something you enjoy and lean into that. For me, it was running,' he added. Despite having a tendon injury, Mr Miller completed the London Marathon last month, putting his incredible transformation down to a better diet.
