Madras HC Confirms Tamil Nadu's Night Ban and Aadhar Requirements for Online Gaming
CHENNAI: The Madras High Court on Tuesday upheld the age, money, and advertisement restrictions, as well as the night ban imposed by the
govt on playing online real money games like rummy and poker.

'In true essence, the online real money games is a trade activity, which if left unregulated has immediate implications on health of the public,' a division bench of Justice S M Subramaniam and Justice K Rajasekar said.
The bench made the observation while dismissing a batch of petitions moved by online gaming platforms challenging the validity of the restrictions.
Refusing to concur with the platforms which contended that a state govt lacks power to bring in such restrictions, the court said, 'Both the union and state govts have power to enact laws in their own respective subject matter apart from the common pool as enabled in List III (Concurrent list).'
This court cannot hold that state is barred from enacting laws regulating online real money games. It is covered under the subject matter of public health and sanitation which comes under List II (State list), the judges said.
The argument that Information Technology Rules, 2021 already prescribe a regulatory framework for intermediaries, including online gaming platforms, and hence the state cannot frame a subordinate legislation is unacceptable, the court said.
'This court views that the state is fully within its competence to enact laws pertaining to online real money games. This court on perusal of the provisions of the act (state legislation) finds no contradictions or provisions that run contrary to the central rules in force,' the bench said.
Moreover, the provisions related to online gaming under IT Rules, 2021 is yet to take effect and remains unenforceable as of today.

So there exists a vacuum in regulating online games, the court pointed out. The judges added that they are of the view that the state govt has rightfully taken adequate steps to fill in the vacuum by framing the legislation. Real money games do not seem to possess the level of discipline or professionalism followed while playing such games physically, they added.
Rejecting the argument that mandatory Aadhar verification violates the privacy of a player, the bench said, 'Right to privacy carries with it its own limitations and cannot be claimed in absolute. When put on a scale, a compelling public interest outweighs right to privacy.'

The federation checks with the department of health services, Municipal Corporation Rohtak, revealed his true DOB as 16/10/2006, with his home in Rainak Pura village, Rohtak. Similarly, national-level wrestler Rohit Gulia was found to have manipulated personal data repeatedly, including DOB changes and unauthorised Aadhar updates (seven times from 2013 to 2021). His official birth certificate from the Municipal Corporation of Rohtak documented his DOB as 17/10/1999, while he declared it as 17/10/2001 in national competitions. Both Dipanshu and Rohit have now been banned by WFI from all future tournaments. WFI president Sanjay Singh has written to Delhi chief minister Rekha Gupta to act against MCD officials. 'What is particularly alarming is the frequency of such (false) certificates being issued after a considerable lapse of time. This is contrary to the normal practice, wherein birth certificates are typically issued within one- or two-months following birth. The Narela zone, situated close to the Haryana border, has seen a disproportionately high number of such delayed issuances. I urge your office to kindly direct the concerned authorities in all MCD zones to exercise strict scrutiny and restraint in issuing birth certificates where the application is made after an unusually long delay,' he added. Ex-backward classes panel chief dies
CHENNAI: Condoling the demise of retired judge and former chairman of Tamil Nadu Backward Classes Commission SM Janardanam (89) due to illness on Friday, CM MK Stalin announced that his final rites would take place with police honours. In his message, Stalin recalled that as a judge of the Madras HC, Justice Janardanam gave several historical judgments between 1988 and 1998. He was appointed as chairman of the TBCC in 2006 and continued in the post till 2015. The CM said based on his recommendations, reservation for Muslims, Christians and Arunthathiyars were implemented in TN. 'Justice Janardanam made a deep impact in the history of social justice in TN, and his death is an irreparable loss,' Stalin added. Dakshina Kannada crackdown: Keep politics out
Two back-to-back murders in Dakshina Kannada, each laced with communal undertones, have finally jolted the government to action. Police officers are now cracking down on lumpen elements across communities – a much-needed move to restore order. The government has rightly overhauled the police top brass in Dakshina Kannada and neighbouring Udupi, signalling a firm resolve to address the escalating communal tensions. But even as law enforcement begins to act decisively, Union Minister of State for Labour and Employment Shobha Karandlaje has chosen a troubling path. She has written to Justice N K Sudhindra Rao, chairman of the Police Complaints Authority, alleging police harassment of 'innocent' Hindu activists. A copy of the letter has also been marked to the National Human Rights fact finding committee on DK murders to submit interim report next complaint is both misplaced and misleading. As a constitutional authority, she should stand by the law, not those who flout it. The police have been doing their duty in a district teetering on the edge. Her letter, devoid of specifics, amounts to a blatant interference in the enforcement of law and order. Karandlaje's portrayal of police action as one-sided is factually incorrect. The list of anti-social elements who the police propose to extern from the district includes those from both Hindu and Muslim communities. Such interference from a union minister not only undermines the police action to restore peace but also sends dangerous signals that political patronage can shield anti-social elements from the due process of law. They should act even against those occupying top positions if they engage in hate speech or incite violence. The state government must back the police not just with moral support, but with robust legal resources that ensure that these criminals don't get a reprieve from the court. The coastal districts need healing and that will happen only when politicians stop stoking fires, and allow the law to take its course.
