It is deeply concerning that Judge Ratha Mokgoatlheng, presiding over the high-profile Senzo Meyiwa murder trial, made a racially charged remark broadcast live, says the writer.
In a country still navigating the painful legacy of racial division, those entrusted with upholding the Constitution must be held to the highest standards of impartiality, professionalism, and respect.
It is deeply concerning that Judge Ratha Mokgoatlheng, presiding over the high-profile Senzo Meyiwa murder trial, made a racially charged remark broadcast live.
The frustrated judge said 'This is what happens in a South Africa run by Blacks. A White advocate will never have the gall to ask me that,' in response to a formal request by Advocate Charles Mnisi, who had advised the court that he would be unavailable on Monday due to participation in Sunday's Comrades Marathon.
While the judge's frustration over delays in this long-running and emotionally charged trial may be understandable, resorting to racially divisive language is entirely unacceptable. It undermines the integrity of the judiciary and risks inflaming already fragile race relations in South Africa. Decorum in court is not just about the behaviour of lawyers and attendees, it begins with the conduct of the bench.
Judges must embody the fairness and dignity they expect from others. These comments fall far short of that standard.
The trial of those accused of murdering Orlando Pirates and Bafana Bafana captain Senzo Meyiwa, a national tragedy, must be conducted with the utmost seriousness and integrity.
We call on the Judicial Service Commission to urgently review these remarks and reaffirm the principle that justice must be administered without fear, favour, or prejudice.

Proceedings resumed in the Pretoria High Court, following the conclusion of cross-examination of lead investigator Brigadier Bongani Gininda. State seeks to introduce new evidence in Senzo Meyiwa murder trial During proceedings, state prosecutor George Baloyi sought to re-examine Gininda regarding additional photographs retrieved from the cellphones of accused number two, Bongani Ntanzi, and accused number three, Mthobisi Mncube. 'The role purpose of such re-examination is to put a full and fair picture before the court to enable the court to adjudicate on the issues that are in dispute namely the identity of the perpetrators who invaded the Khumalo home on the 26th of October 2014 and killed the deceased. 'It is, therefore, our submission that the evidence is relevant,' he said. Baloyi explained that the defence opposed this move on the grounds that it constituted new evidence not previously addressed. 'Even if the re-examination of Brigadier Gininda on these additional photos can be regarded as new matters that do not arise out of cross examination, we submit the new evidence can still be canvassed with the leave of the court and may allow further cross examination on the new evidence.' He also pointed out that legislation governing hearsay evidence permits its provisional admission, provided the individuals who obtained the data are recalled to testify. The court previously heard that Mncube, also had photos of guns, ammunition, an axe and a panga on his phone. One image with a firearm was saved under the name 'my killing machine'. Furthermore, Baloyi revealed that the state is awaiting a two-minute video clip from broadcaster eNCA. The footage relates to a claim previously made by late defence lawyer Thulani Mngomezulu during Gininda's testimony that Meyiwa was shot by Longwe Twala, the son of renowned music producer Sello 'Chicco' Twala. Mngomezulu had also alleged that Longwe accidentally shot himself in the foot during the incident. 'There is footage available that we want to show the court. Baloyi explained that a Section 205 application, authorised by the National Director of Public Prosecutions (NDPP), Shamila Batohi, was granted to gain access to the footage. 'A section 205 subpoena was issued for the footage but there has been toing and froing with the legal representative from eNCA, but two days ago they undertook to furnish the state with the footage.' Defence pushes back as Senzo Meyiwa murder trial postponed The defence insisted that the state was introducing new evidence. Advocate Charles Mnisi, representing Mncube and accused number one, Muzikawukhulelwa Sibiya, argued that the state must make a formal application to reopen its case. 'As much as we realise that there is nothing stopping the state from adducing that evidence, but that evidence cannot be introduced through re-examination. 'Procedurally, the state needs to finalise its re-examination, make an application to lead this new evidence which needs to be contexualised in its case.' Other defence lawyers echoed similar sentiments. Advocate Zandile Mshololo, representing accused number five, Fisokuhle Ntuli, warned that bypassing proper procedure could compromise the accused's right to a fair trial. She added that Sergeant Moses Mabasa and Warrant Officer Thando Ndlovu – both of whom previously testified on data downloaded from the accused's phones – would need to be recalled. 'The new evidence cannot be introduced through this witness [Gininda],' Mshololo told the court. Judge Ratha Mokgoatlheng ultimately ruled in favour of the defence. Defence advocate in the Senzo Meyiwa trial Charles Mnisi has been criticised for asking to be excused from court on Monday to allow him to participate in the Comrades Marathon on Sunday. On Thursday, Pretoria high court judge Ratha Mokgoatlheng was furious after Mnisi sent an email explaining why he wanted to be excused. Mnisi said he would be unavailable on Monday when the trial is set to resume as he would be driving back to Johannesburg. 'In this case, people are talking justice delayed, justice denied,' Mokgoatlheng said. 'Ten years, no justice, the case is just dragging on. The family is distraught, the brothers, the relatives, even the accused, they've been in custody for two to three years. And here's this stupid judge called Ratha Mokgoatlheng, you think, who must allow a person who's representing two of the accused [time off] to go and run a marathon? 'I don't think a white advocate can have the gall to ask me that. Never.' The trial has experienced significant delays since 2014, when Meyiwa was killed, due to various reasons including disputes over evidence, witness availability and procedural issues. In April, the trial stalled again when the same advocate requested more time to prepare, citing the complexity of the case and the need for additional evidence.

Bloem teenager allegedly taken by unknown men in SAPS uniform
Police in Bloemfontein are searching for 19-year-old Kamogelo Baukudi, who was allegedly kidnapped by two men impersonating officers on Thursday afternoon. He was immediately reported missing. 'The complainant, Daniel Malebatso, arrived at Marti Du Plessis School in Fitchardpark as usual, to fetch Baukudi who is a Grade 11 learner at the school,' said SAPS national spokesperson, Brigadier Athlenda Mathe. According to Mathe, Malebatso left the school with the teenager and they were driving in a Suzuki Ertiga. Malebatso said while driving on Vereeniging Drive near Erlichpark Extension, they suddenly heard a siren going off behind them. He said they were pulled over by a White Toyota Hilux GD-6 Double Cab. He alleges that he saw two male persons inside the vehicle and insists that their identities are unknown to him. However he said that one of the men was wearing a police uniform while the other wore blue tracksuits. 'According to the complainant, the suspects bakkie was fitted with blue lights on the grill and what looked like a police radio inside,' said Mathe. According to Malebatso, the suspect who was wearing a police uniform confronted him and informed him that the vehicle they were driving in was suspected of drug trafficking. He alleges the two 'officers' then separated him from Baukudi. Malebatso claims he was instructed to drive in front of the 'police vehicle', while they followed behind him en route to Park Road Police Station. 'Both vehicles turned back and drove in westerly direction in Vereeniging Drive. Malebatso alleges that a truck went in-between the Suzuki he was driving and the Toyota Hilux and he never saw it again,' said Mathe. 'Malebatso recalls that one of the suspects was speaking Sesotho fluently and even mentioned the name 'Thipe',' said Mathe She said the cellphones belonging to both Malebatso and Baukudi were found under the bridge on Ferrera Road. A case of kidnapping and impersonating the police has since been opened at Parkweg Police Station.
