[UPDATED] KL Tower tussle: Court dismisses contempt bid by ex-operator
KUALA LUMPUR: The High Court today dismissed a legal bid by Menara Kuala Lumpur Sdn Bhd (MKLSB) and former KL Tower operator Hydroshoppe Sdn Bhd to start contempt proceedings against Communication Minister Datuk Fahmi Fadzil and several others.
Judge Roz Mawar Rozain made the ruling after finding that the applicants had failed to establish a prima facie case of contempt against the respondents.
The two companies filed contempt proceedings against eight individuals for allegedly disrupting the administration of justice amid ongoing legal proceedings.
The eight are – Federal Land Commissioner Datuk Muhammad Azmi Mohd Zain; Dang Wangi police chief Assistant Commissioner Sulizmie Affendy Sulaiman; Lim Seong Hai Capital Berhad (LSH) chairman Tan Sri Lim Keng Cheng; LSH chief executive Khairil Faizal Othman; Communications Ministry secretary-general Datuk Mohamad Fauzi Md Isa; administrative services division secretary Harun Ali; and senior division secretary (management) Mazlan Abd Mutalib.
The court also found no merit in the plaintiff's claim that the authorities had wrongfully entered its property after the contract with the government ended on March 31, regardless of how forceful the actions were.
"This court is not satisfied that a prima facie case has been established to warrant leave for contempt proceedings to be granted," she said.
Roz Mawar awarded RM15,000 in cost to Fahmi and RM10,000 in cost to the other respondents.
Meanwhile, the court also dismissed the plaintiffs' application for an interim injunction to stop Fahmi and the government from granting the KL Tower concession to LSH Service Master Sdn Bhd, ruling that the matter had become academic.
On March 27, the plaintiffs filed a RM1 billion suit against Fahmi and the new KL Tower concessionaire following the termination of the management agreement.
In a statement, MKLSB managing director Datuk Abdul Hamid Shaikh said the injunction aims to maintain the current status quo until the dispute is fully resolved in court.
He said that in 2022, Hydroshoppe was invited by the Communications Ministry to become a strategic partner in revitalising MKLSB's operations and ensuring the tower's continued management and maintenance.
Abdul Hamid claimed that despite multiple attempts to resolve the matter amicably, the ministry and the new concessionaire have refused to acknowledge the 2022 agreement, leaving MKLSB and Hydroshoppe facing financial and operational uncertainty.
He claimed that outstanding payments amounting to RM25 million for maintenance and operational services remain unpaid, and have added further financial strain,
MKLSB has managed and maintained KL Tower for nearly 30 years.

KOTA KINABALU: Kim Teck Cheong Consolidated Bhd (KTC) has made heads turn with the acquisition of land worth RM40 million here. The six-hectare plot at the Kota Kinabalu Industrial Park (KKIP) will be for the development of KTC Industrial Park, the group's integrated hub for operations, logistics, and manufacturing. "The KTC Industrial Park is also set to become one of the largest FMCG distribution centers in the region, designed to efficiently serve markets in Sabah, Sarawak, Brunei, and Indonesia. "This investment is a strategic move that puts us on the path of sustainable growth and provides the space and infrastructure needed to meet growing demand while serving our business partners more effectively," he said, when announcing the acquisition here. Lau also said that KTC had surpassed RM1 billion in revenue as of June this year and continues to be on a strong growth trajectory. He added that KTC's total operational footprint currently covers 500,000 square feet. "We will commence construction of the KTC Industrial Park in KKIP as soon as possible, with a total investment of RM100 million. "The industrial park is expected to generate 500 new jobs, and we will prioritise hiring locals from underprivileged backgrounds to support the government's efforts in eradicating poverty," he said.

RM10,000 aid for families of UPSI bus crash victims
Government spokesman Fahmi Fadzil said Prime Minister Anwar Ibrahim has instructed the Attorney-General's Chambers to review insurance matters to assist the victims' families. KUALA LUMPUR : The families of the 15 Universiti Pendidikan Sultan Idris (UPSI) students who died in the bus crash in Gerik will receive an additional RM10,000 in aid, says government spokesman Fahmi Fadzil. The 15 were killed and 33 others injured when the bus they were on overturned after colliding with a car early Monday morning on the East-West Highway while returning from Jertih to the UPSI campus in Tanjung Malim. 'The Cabinet today agreed to provide an additional RM10,000 in aid to the families of those who lost their lives in this tragic accident. 'Those who were injured will receive RM5,000,' Fahmi, who is also the communications minister, said at his weekly press conference today. He said Prime Minister Anwar Ibrahim had instructed the Attorney-General's Chambers to review insurance matters to assist the victims' families. Fahmi also said higher education minister Zambry Abdul Kadir had confirmed that the National Higher Education Fund Corporation (PTPTN) loans of the deceased students would be waived. In a Facebook post earlier, Zambry said of the 15 students who died in the accident, 13 had been identified as PTPTN loan borrowers. All 13 would benefit from the full settlement of their education loan debts, he said, adding that each of their families would also receive death benefit of RM1,500. Previously, Zambry said the ministry's Yayasan Perkasa Siswa would channel RM2,000 in funeral aid to the families, and RM1,000 in disaster relief to each injured student. The women, family and community development ministry has said it would provide RM1,000 in aid to 10 students from UPSI warded at the intensive care units in two hospitals in Perak, while the Terengganu government would provide RM3,000 in aid to the families of the 15 students who died.
