SC rejects plea to review Allahabad HC decision that ended toll collection on DND flyway
The Supreme Court on Friday rejected a plea to review its decision upholding the Allahabad High Court order, which had ended toll collection by Noida Toll Bridge Company Limited (NTBCL) on the DND (Delhi-Noida Direct) flyway connecting Delhi to Noida.
A bench of Justices Surya Kant and N Kotiswar Singh dismissed NTBCL's plea seeking review of its December 20, 2024 judgment. The company sought a relook at the decision, stating that the report of the CAG – which was relied upon by the court – had some positive remarks, too, about it, but the order did not reflect the same.
The origin of the flyway dates back to April 1992, when Noida and the Delhi administration entered into an MoU with IL&FS, intending to construct the bridge. The concession agreement was executed on November 12, 1997.
The HC's October 26, 2016, ruling came on a plea filed by the Federation of Noida Residents' Welfare Association, which had moved the HC nearly 15 years after the execution of the concession agreement. It sought a direction to discontinue toll charges from those who used the DND flyway, saying NTBCL had already recovered the project costs.
The NTBCL had then approached the SC. On December 20, 2024, the SC had dismissed the appeal, saying, 'NTBCL has recovered the project costs and substantial profits, eliminating any justification for the continued imposition or collection of user fees or tolls.'
It added that there was no infirmity in the HC judgment and that it found no reason to interfere with it.
The SC also said that the contract awarded to NTBCL through the concession agreement by state authorities and New Okhla Industrial Development Authority (NOIDA) was 'unfair, unjust and inconsistent with Constitutional norms'.
It added that NOIDA 'exceeded its authority by delegating the power to levy fees or impose tolls to NTBCL, rendering such delegation invalid'.

Have issued norms to monitor use of loan money by builders: RBI to SC
NEW DELHI: As many banks and financial institutions have come under scanner for harassing homebuyers in connivance with real estate companies particularly in case of subvention plan and facing Central Bureau of Investigation (CBI) probe on direction of the Supreme Court, banking regulator RBI has virtually shrugged off its responsibility and told SC that it has over the years issued various guidelines and circulars to monitor use of loan amount by developers to prevent misuse and siphoning of funds. It also said that it had directed banks not to resort to intimidation or harassment of any kind for recovery of loan amounts from buyers. Under the subvention scheme, banks disburse the sanctioned amount directly to the the builders, who then have to pay EMIs on the sanctioned loan amount, until possession of the flats is handed over to homebuyers. As many builders did not complete construction and started defaulting in paying the EMIs to the banks as per the Tripartite Agreement, the banks started action against the buyers to recover the EMIs and it is the SC which came to their rescue by ordering a probe into the alleged 'unholy' nexus of builders and banks. In an affidavit filed in the apex court, RBI referred to various directions and guidelines issued by it from time to time and said, "RBI has performed its duty in discharge of its statutory obligations under the various statutes, including those under the BR (Banking Regulation) Act." The regulator said it had way back in 2015 taken cognisance of the practices such as Subvention Schemes and had issued guidelines as per which disbursal of housing loans sanctioned to individuals should be closely linked to the stages of construction of the housing project and upfront disbursal should not be made in cases of incomplete or under-construction housing projects. In a relief to many homebuyers who booked flats under subvention plan and have not got possession of their flats because of inordinate delay by developers, SC had in July last year directed that no coercive action could be taken against them by banks or builders regarding payment of EMI and no complaint shall be entertained against them for cheque bounce cases. Seeking intervention, hundreds of homebuyers had moved the SC against banks and builders.

Reviving tourism: Travel agents from across India to converge in Kashmir this weekend
Reviving tourism: Travel agents from across India to converge in Kashmir this weekend NEW DELHI: Travel agents from across the country will converge in Kashmir this weekend in a bid to revive tourism there following this once-thriving industry's near-total collapse after the deadly April 22 terror attack in Pahalgam. The Travel Agents Federation of India (TAFI), which is one of the country's biggest umbrella organisations for agents with over 1,600 members, is holding its meeting in Srinagar and Pahalgam from June 13-16 to instill confidence among the fraternity. 'Our members from all over the country will go to Kashmir and assess the situation for themselves. Once and if they feel confident about the place and about the safety & security of tourists, they will again start presenting Kashmir as a destination,' said TAFI VP Anil Kalsi, adding, 'We will be staying across hotels, including houseboats, and have meetings with govt representatives. Airlines will also be a part of this meeting we are having in Kashmir. ' Srinagar hotels and flights commanded a big premium before the Pahalgam attack as Kashmir was seeing unprecedented tourist footfalls post Covid. But after the April 22 attack, tourists already there left Kashmir in droves and those who had plans to visit cancelled the same. 'What happened in Pahalgam was tragic and shocking beyond words. Authorities there need to regain confidence and trust of tourists for the latter to return there,' said a Delhi-based travel agent. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Giao dịch CFD với công nghệ và tốc độ tốt hơn IC Markets Đăng ký Undo If the agents' meet finds the situation safe enough for that to happen, what incentives will the local hotels and airlines offer for tourists to return? 'The near complete collapse of demand has left airfares and hotel tariffs at near bottom levels, so prices are very low. Gulmarg's Khyber, for instance, used to have daily tariffs of about Rs 75,000 which are now down to Rs 21-22,000 and the hotel is offering packages,' said Kalsi. J & K is currently focussed on ensuring a safe Amarnath Yatra as they hope that will send out a message that tourists can return to Kashmir. The yatra duration has been curtailed to 38 days, instead of 52 days in 2024, and will be on between July 3 and Aug 9, 2025. A total of 581 companies from various Central Armed Police Forces, along with personnel from the Jammu and Kashmir Police, will be deployed along the pilgrimage routes to ensure safety of the lakhs of pilgrims.
