Ex-solicitor jailed for being ‘key component' in scheme to change ownership of two Dublin properties with fake deeds
A FORMER solicitor who helped to change the ownership of two Dublin properties with fake deeds has been jailed.
Herbert Kilcline, 64, was convicted of eight charges following a trial last November.
He was convicted of two counts of using a false instrument, two counts of failing to keep records, and two counts of the fraudulent procurement of an entry into the Property Registration Authority's registry.
He was also convicted on two counts of failing to apply the required measures as a designated person.
The offending relates to two properties: one on Phibsborough Road, Dublin, and the other on St Mary's Road, Dublin 4.

Today Judge Sinead Ni Chulachain said Kilcline was a 'key component' in the scheme and abused his position of trust with the Property Registration Authority (PRA).
She said Kilcline's role was in 'no sense peripheral'.
She added that his actions contributed to the losses suffered by the injured parties and had also put the integrity of the land registry system at risk.
Judge Ni Chulachain also said that this may not have been a 'deliberate or calculated fraud' on Kilcline's part, but his actions were reckless and went further than professional negligence.

The judge noted that Kilcline does not accept his actions were criminal and characterises them as professional negligence.
Imposing a two-and-half-year sentence, Judge Ni Chulachain said she had taken into account that custody would be more challenging for Kilcline due to his medical and mental health issues.

Second man arrested in follow-up operation after 3D-printed gun seized
Gardaí have arrested a second man in connection with the seizure of a firearm in Dublin on Tuesday night. While on routine patrol along Turvey Avenue, Inchicore, Dublin 8 at around 8pm on Tuesday night uniform Gardaí from Kilmainham (Community Engagement) Garda Station observed two males of interest entering a taxi. On stopping the taxi the Gardaí were met by a strong smell of cannabis. Both males were informed they were going to be searched under the provisions of the Misuse of Drugs Act 1977. One of the males was found to be wearing a ballistic vest and in possession of a substantial sum of money. As he was being searched, a .22 calibre pistol fell from being concealed in the ballistic vest. The firearm seized is now subject to full technical examination. Gardaí arrested the man in his 20s in connection with the seizure and detained him under Section 30 of the Offences Against the State Act, 1939 at a Garda Station in Dublin. He has been charged in connection with the case and is scheduled to appear before the Criminal Courts of Justice (Court No. 4) on Thursday, June 26 at 10:30am. In the course of a follow-up operation on Wednesday, June 25, investigating Gardaí conducted a search of a residential property in Dublin's inner city. A second male, aged in his 20s, was arrested during the operation. He is currently detained under Section 30 of the Offences Against the State Act, 1939, at a Garda station in the Dublin Region. Speaking about last night's seizure Assistant Commissioner Paul Cleary said, "I want to acknowledge and commend the work of two uniform members of An Garda Síochána yesterday evening going about their duties diligently and proactively. "This was a timely intervention likely to have saved lives or prevented serious injury and is another dangerous firearm which has been taken off the streets of Dublin. Balbriggan hit and run victim allegedly run after by gang with hurley and knives
The young man ran over and killed in what is suspected to have been a 'targeted' fatal hit and run was allegedly run after by a gang with hurley and knives beforehand, we can reveal. Tragic Mircea Rostas, who was in his 30s, was run over twice by a BMW on Railway Street in Balbriggan just after 9pm on Monday night. Gardaí are set to consider a murder investigation as they continue to question a man known to Mr Rostas tonight, Wednesday, following a night of chaos in the town on Monday. It is now alleged several suspects 'arrived at Railway Street with a hurley and knives' and Mr Rostas ran from the scene 'because of an alleged incident over a female'. It's then alleged a person ran after Mr Rostas on foot before he was allegedly struck by a car which 'went into reverse and then drove back over him', sources say. 'It is believed at this stage it was targeted,' sources say. Sources also say there was a 'war of words' on social media over the past few weeks where a number of people 'started abusing each other; over an alleged assault of a female.' Following the incident a car fled the scene and was subsequently struck by another vehicle driven by associates of the victim. The shocking second collision occurred right outside Balbriggan Garda Station. A fight then broke out outside the station which had to be broken up. The suspect in the case was known to Mr Rostas and subsequently handed himself into Gardaí and was arrested on appointment. Tonight, Wednesday he remained in garda custody. Gardaí continue to appeal for witnesses. A garda spokesman said in a statement: 'Gardaí are appealing to anyone who may have witnessed the incident to come forward. Any road users or pedestrians who may have camera footage (including dash-cam) from the area at the time are asked to make it available to Gardaí.
