Calls to end major $250 million loophole amid destructive trend on Australia's roads
There are growing calls for Australian state governments to rethink their approach to how much drivers pay to use the roads and for the federal government to end a perverse incentive pushing Aussies to embrace oversized utes and trucks. As bigger and bigger cars proliferate on our roads, the massively accelerating trend is costing taxpayers, worsening congestion and polluting the environment, critics say.
The luxury car tax means Aussies who are buying a car worth more than $80,576 (this financial year) will pay an extra tax on the cost of the vehicle above that amount. However a loopholes means most utes and SUVs are exempt because they are classified as light commercial vehicles regardless of whether they are bought for private or commercial use.
Associate Professor Milad Haghani, an expert in urban resilience at the University of Melbourne, is among those who continue to question why the exemption is still in place.
"The luxury car tax exception has been one of the biggest incentives for people to go big and buy big cars," he told Yahoo News Australia.
"Because if somebody is looking at a price range of $80,000 and above, there's really an incentive to buy a pick-up truck or big car because then they get exempted from the whopping 30 per cent luxury tax and it becomes quite attractive to the buyer.
"And a lot of the buyers don't use it for commercial purposes," he added.

The status quo means every tax payer is "effectively subsidising" the purchase of such mega utes Prof Haghani said. The Australian Institute recently calculated that comes at a cost of about $250 million a year.
And that's before other externalities that impose a cost on society are considered with research showing the larger vehicles have an outsized impact on worsening congestion, polluting the environment and degrading our roads.
According to Prof Haghani, a large ute that is twice the size of a smaller car will have 16 times the impact when it comes to road damage. That's because of something called the fourth powered law "which is a very known thing in pavement engineering that says the amount of damage is proportional to the fourth power of its axle weight. So if the axle weight is doubled, the impact is 16 times bigger."
New road charge for certain drivers foreshadowed by federal government
Less than 25 years ago, Australian buyers overwhelmingly bought small passenger vehicles like sedans and hatchbacks. But according to Prof Haghani, their percentage of new sales has plummeted in recent years, now making up just 17 per cent of new car sales. Instead, 80 per cent of cars bought in Australia are either an SUV, ute, van or light truck.
While Aussie consumers appear to be embracing them, certain local politicians, like city councillors in Melbourne, have been pushing back against their adoption. Last year the Yarra City Council unanimously voted to investigate the potential to raise parking fees for large vehicles — following a policy adopted in Paris which has seen larger SUVs slugged a $30 per hour rate to park in the inner city.
Greens Councillor Sophie Wade who led the push told Yahoo News the city's streets simply "weren't designed for this kind of vehicle." Such a reality is clearly evidenced by the fact Standards Australia has been mulling whether to increase the size of standard carpark spaces due to the trend.
Prof Haghani would also like to see state registrations overhauled to put emphasise on the size of the vehicle and make the owners of American style large utes and trucks pay more.
Currently, only NSW and WA consider the weight of the vehicle when charing for registration. Queensland and Tasmania use the number of engine cylinders, which is a proxy while Victoria set fees based on location.
"What would a truly equitable registration fee model look like? Based on the evidence, it would not only account for vehicle size and weight, but also how often the vehicle is driven," he wrote this week in The Conversation.
As it stands in most jurisdictions, "the registration fee system is just not a fair and equitable one," he told Yahoo.

Workplace surveillance of employers at Australian businesses exposed: 'Utterly insane'
Victoria is calling for a major overhaul in workplace surveillance legislation after a large-scale investigation revealed just how much workers are being watched. The Legislative Assembly Economy and Infrastructure Committee found this type of surveillance had "accelerated" in recent years, thanks to huge technological advancements. Workers have been monitored through their telephone calls, computer cameras, keystrokes, and biometrics. But the Committee determined current legislation hadn't kept pace with these "dramatic" advancements, and workers have very little to defend themselves against being spied on. Peter Leonard from UNSW Business School told Yahoo Finance the problem of surveillance at the workplace "will only get bigger" and more intrusive if the law doesn't catch up. The adjunct professor from UNSW's School of Private and Commercial Law said workplace surveillance mainly started out from a safety point of view. Cameras might have been installed to track a truck driver's eyes to ensure they're alert when they're on the road, or to ensure warehouse workers are wearing the proper protective gear. However, this quickly changed when the Covid pandemic forced everyone to work from weren't able to keep a close eye on their staff like they would have in an office, so they turned to systems and technologies that allowed them to do that from afar. "Whenever you install technologies like this without controls or safeguards, there's a real danger and probably a likelihood of mission creep," he told Yahoo Finance. "There is a real risk that they will be used in ways that are unreasonable, or that the data collected from the technology for reasonable purposes suddenly starts getting used for quite unreasonable purposes. "That is, until regulators step in and put some requirements and controls on this." The Committee's report found work devices like computers, webcams, mobile phones and handheld scanners gathered a raft of data on a person's work activities. This data can then be processed and used to determine a worker's location and task speed, and assess their performance, sentiment and concentration level. But the University of Melbourne's Jake Goldenfein said this creates problems for workers when they know they're being watched. "I'm working in a coolroom. I have a little iPad with a countdown clock telling me how much time I have left to finish packing this box, and when it hits zero it goes red, right, and I know I'm in trouble," he said. "At the same time, I'm a smaller person and I need to grab things off the shelf, but the stairs, the ladders, are all the way down the other end of the room. So I just climb the shelf." The investigation put a call out to businesses like Amazon, Australia Post, Coles Group, DoorDash, Optus, Qantas, Telstra, Uber, Virgin Australia, Woolworths Group and the Big Four banks. None of them responded, except for Commonwealth Bank (CBA). The Committee heard how CBA staff had to download an app called Navigate onto their personal devices to access buildings, book a workstation, register visitors and report faults. But the app also collected data on a person's location and "some workers have been asked to apply for leave when they are away from their desk or appear unproductive". There is plenty of software on the market that can do far more than that. Some can monitor login times, your search history, and the amount of time a worker spends on a certain app. These platforms can take screenshots of your computer at regular intervals to determine if a staffer is distracted or on the ball. CallMiner can record and transcribe telephone calls and uses AI to scan for certain words and phrases or to analyse how well a worker handled a call. Finance Sector Union national assistant secretary Nicole McPherson told the inquiry that one of their members had been flagged for a disciplinary process after an AI monitoring system picked up the person saying "unfortunately it's been really rainy lately" while on the phone with a client. That member was hauled into a disciplinary hearing because of the negativity. Fujitsu has also developed an AI model that can monitor a worker's facial expressions and can latch onto the tiniest changes to determine whether they're concentrating or not. The report highlighted how neuro-surveillance could be adopted en masse in the next five years. This uses neurotechnology to measure electrical activity in a person's brain to work out their cognitive state, such as their level of attention and effort. It can even decode mental images and intended speech, which could be used to understand a worker's mind and their outlook on their job. They're already being used in the mines to monitor fatigue, but it could be installed in workplaces in the not-too-distant future. The Committee flagged this "has the potential to be problematic and in some cases discriminatory" because these systems overlook other relevant factors like "empathy and creativity". One of the recommendations from the inquiry was introducing new legislation in Victoria to crack down on workplace surveillance before it gets too much. Under this proposed change, employers would be forced to notify and consult with workers about workplace surveillance practices and disclose how workers' data would be collected, used and stored. "Victoria has the opportunity to lead the way with dedicated laws requiring workplace surveillance to be necessary and reasonable," Committee chair Alison Marchant said. Leonard told Yahoo Finance surveillance should only be used for "reasonable and necessary" circumstances that are "proportionate to achieving a lawful purpose". But there might have to be a national law handed out to ensure workers across the country are protected. If you live in one state and work remotely in a business based in a different jurisdiction with different workplace surveillance rules, what protections do you have? Australian workers backed the proposal to change the law after hearing about the raft of technologies being used to watch them. "This is utterly insane and draconian as f**k WTF," wrote one person. "This is absolute insanity," added another. "My workplace has well-documented 'surveillance' policies, but nothing to this extent (yet??). I often worry the place is bugged and the bosses will be listening to conversations." "I work at this big firm and I've slowly realised we're living in a full-blown corporate Black Mirror episode," said a third. New South Wales and the ACT have the clearest definitions on what is and isn't allowed when it comes to workplace surveillance. However, the rest of the country is a bit murkier. The Workplace Surveillance Act 2005 states: Employers have to give 14 days' written notice before surveillance (CCTV, computer, tracking) begins Covert surveillance requires a magistrate's approval and is limited to certain investigations like theft Employees must be notified where and when they are being monitored Employers cannot use surveillance in private areas like toilets or changing areas The Workplace Privacy Act 2011 is similar to NSW's rules, but also stipulates that employers have to have consultation with employees before installing surveillance on them. The state is governed by the Surveillance Devices Act 1999, which prohibits the use of listening, optical, tracking and data devices without consent. There isn't a specific rule around workplace surveillance, but any attempt to surveil a staffer has to comply with the Charter of Human Rights and Responsibilities Act 2006. The Invasion of Privacy Act 1971 (QLD) and Listening Devices Act 1991 (TAS) cover audio surveillance, however, don't touch on visual or other types of tracking devices. Workers can rely on general principles from the federal Privacy Act 1988, but its lack of clear definitions for modern surveillance could leave them with limited protections. That Act also only applies to businesses making more than $3 million annually. WA's Surveillance Devices Act 1998 and the NT's Surveillance Devices Act 2007 regulate the use of listening, optical, tracking, and data surveillance. However, there is no obligation for employers to notify workers of surveillance and no workplace-specific regulations. The Listening and Surveillance Devices Act 1972 prohibits the installation and use of surveillance devices without consent. Last minute data disappointment lowers GDP growth hopes
Forecasters have revised down their predictions for Australia's economic growth, which could show the weakest start to a year in decades, outside of COVID. Partial indicators released in recent days have diminished optimism of the economy's vitality before the Australian Bureau of Statistics releases national accounts figures on Wednesday. The anticipated economic recovery driven by falling interest rates, moderating inflation and recovering disposable income has not materialised as expected. New public demand declined 0.4 per cent over the quarter and will shave 0.1 percentage points off GDP growth in March, the ABS reported on Tuesday. Alongside weaker than expected household spending, business investment and mining exploration, Westpac pared back its prediction for GDP growth to 0.1 per cent - the slowest March quarter result, outside of COVID, since the 1990/91 recession. That would put the annual growth rate at 1.2 per cent. Westpac economists said there was even a small risk for a minor decline in output over the quarter. Negative effects from Tropical Cyclone Alfred and flooding in Queensland as well as a slowdown in public demand highlighted the downside risks to growth. "While some of the weakness reflects the direct and indirect (or 'confidence'-related) impacts of the bad weather events, it is undoubtedly the case that underlying growth remains sluggish," they said. "Without a pickup in private demand, the shaky handover from the public sector could result in a period of below par economic growth." While the figures won't show the worst effects of global uncertainty on consumer demand, given Donald Trump's main tariff announcement wasn't until April 2, trade barriers will continue to weigh on economic growth into the future. The Organisation for Economic Cooperation and Development downgraded its forecast for Australia's GDP growth from 1.9 per cent to 1.8 per cent in 2025. But the outlook is rosier in 2025, with economic growth expected to accelerate to 2.2 per cent as interest rates continue to fall and disposable incomes recover. Treasurer Jim Chalmers said the national accounts would show an Australian economy resilient in the face of substantial headwinds at home and abroad. "Our economy has been hit by natural disasters and we're not immune to global volatility, but the progress Australians have made together means we are well placed and well prepared to face this uncertainty," he said. CBA economists also downgraded their Mach quarter GDP forecasts following Tuesday's data dump but still expect growth of 0.3 per cent, while ANZ and NAB revised down their predictions to a 0.2 per cent rise. JP Morgan left its growth prediction unchanged at 0.3 per cent while Japanese investment bank Nomura lowered its estimate to 0.1 per cent. It's unlikely GDP growth will meet the Reserve Bank's forecast of 0.5 per cent, published just over two weeks ago in its May Statement on Monetary Policy. Rates markets imply a 78 per cent chance for the RBA to cut interest rates by another 25 basis points at its next meeting in July, with two more cuts expected by Christmas.

The lingerie giant's websites went dark for three days last week as it wrestled with a 'security incident involving information technology systems.' While the tech trip up happened during the second quarter, Victoria's Secret postponed its first-quarter financial update, which was scheduled for Thursday. 'The restoration process has prevented employees from accessing certain systems and information needed to support the company's release of its financial results for the first quarter,' the firm said. Earnings will be released at a later time, but the company gave investors a preview with preliminary results that were near or above the high-end of its previous guidance. First-quarter sales came in at $1.35 billion, down from $1.36 billion a year ago, but ahead of the $1.3 billion to $1.33 billion the company forecast. Adjusted operating income totaled $32 million, down from $40 million a year earlier, but ahead of the $10 million to $30 million forecast. The question now is how much the incident will weigh on the second quarter. 'The company continues to assess the full scope and impact of the incident, under the oversight of the audit committee of the board of directors,' Victoria's Secret said. 'Although this incident has not caused a material disruption to its operations to date, the company has incurred — and may continue to incur — expenses and other financial impacts related to this incident, which could negatively impact its future financial results, including for the second quarter.' It's been a complicated stretch for the Victoria's Secret board, which, in the midst of the website outage last week, also imposed a poison pill shareholder rights plan to prevent Australian entrepreneur Brett Blundy's BBRC International from buying the company without paying a control premium.
