Kansas bills would end grace period for mail ballots and ban ranked-choice voting
Kansas's two election committees are fast at work in the Kansas Statehouse this year and have already had hearings on some of the more controversial election bills being considered.
Kansas has taken on a flurry of election security bills since 2020, when President Donald Trump baselessly blamed widespread voter fraud for his defeat. Some of the laws that passed in the Statehouse fell flat in the courts, namely the prohibition of "impersonating an election employee."
Democrats have signalled that they're not willing to work on many of the bills being considered.
"Anything that makes voting more difficult for Kansans is going to be a nonstarter with us," said Senate Minority Leader Dinah Sykes, D-Lenexa.
In 2017, the Kansas Legislature approved a three-day grace period for ballots that were sent before Election Day, but received by a county election office up to three days after the election. A bill that would make a hard deadline of 7 p.m. on Election Day for ballots was recommended to be passed by the Senate Committee on Federal and State Affairs despite substantial pushback from opponents.
Identical bills have passed the Senate and House over the past few years, but they've failed to overcome Gov. Laura Kelly's veto.
Election Day is the mail-ballot deadline for most states, with 32 states requiring the return of mail-in ballots as the polls close. The other 18, plus Puerto Rico, Washington, D.C., and the Virgin Islands allows ballots after Election Day if it is postmarked with the date it was sent.
Written testimony for the bill largely skewed oppositional, with more than 50 organizations and private citizens asking the committee to reject the bill compared to 10 proponents.
Proponents argued that the U.S. Postal Service postmarks are unreliable, would speed up tabulation and would make elections more secure.
"Nothing in this bill does anything to change voters access. Kansas makes it very easy to vote. This law would also make it harder to cheat," said Jason Sneed, executive director of Honest Elections Action Project, a Washington, D.C.-based organization that advocates for tougher election security laws.
Sneed previously managed the Heritage Foundation's election fraud database, which found 16 cases of voter fraud in Kansas since 2005.
Opponents included several civil rights groups and civic organizations like the American Civil Liberties Union, the League of Women Voters and the Disability Rights Center. Opponents argued that the bill was uncontroversial when it passed in 2017, and responded to delayed USPS service that has only gotten worse since. Some also said this would throw out ballots and cause confusion among voters.
"Could you tell me your mail delivery time? How long it's going to take for any letters? You don't know," said Davis Hammet, president of the youth voter access and engagement advocate Loud Light. "Weather events can happen that create mail delays that are outside of anyone's control. So this is just a common sense simple thing. It's about protecting people from some of the failures of the federal government."
Ann Mah, former Democratic representative from Topeka and former Kansas State Board of Education member, called the bill "pure voter suppression" of Democrats, who are more likely to vote by mail than Republicans.
The bill was also opposed by the Kansas County Clerks and Election Officials Association, which represents the county clerks and election officials in the state.
"Most properly mailed advance ballots are returned the day after the election but diminishing quantities continue to be received after Election Day," said Rick Piepho, the elections committee chair of the KCCEOA.
An identical bill, House Bill 2017, is submitted to the House, but so far the House Elections Committee hasn't scheduled a hearing on it.
Sen. Mike Thompson, R-Shawnee, introduced a bill that would ban ranked-choice voting in Kansas, which hasn't been adopted by any city thus far. Current state law doesn't have a method for ranked-choice voting outlined in statute, meaning cities couldn't do it unless lawmakers passed a law allowing it according to the Kansas Revisor of Statutes.
Madeline Malisa, a visiting fellow at Opportunity Solutions Project, argued that ranked-choice voting has been a "nightmare" in Maine, where she lives. She said the tabulation process throws out ballots, is too complicated and increases the chance of less-popular candidates to gain office.
Maine adopted ranked-choice voting in 2018, but several Republican-led states have soured on the idea after Alaska elected its first Democrat in decades in its first ranked-choice election.
Ranked-choice voting advocates argued that the practice could improve the voting process and that several of the proponents' ideas aren't backed up by evidence. About 75% of Utah voters who participated in a ranked-choice voting pilot found it easy, though neither ranked-choice or single-vote plurality voting reached majority support.
A House resolution proposed slightly altering the Kansas Constitution to more explicitly state that noncitizens aren't allowed to vote, though Kansas's laws have interpreted the current language as doing just that for over 100 years.
Some municipalities across the country have allowed noncitizens to vote in local elections, though they're barred from participating in federal elections. No city in Kansas has followed suit.
The bill was supported by two out-of-state advocacy organizations, Americans for Citizen Voting and Opportunity Solutions Project. The ACLU, Loud Light and League of Women Voters opposed it.
Currently, Kansas enfranchises "every citizen of the United States who has attained the age of 18 years and who resides in the voting area in which he or she seeks to vote." Proponents of the bill argue that it still leaves some wiggle room for municipalities to allow noncitizen voting.
"It does not prohibit a municipality from allowing a non-citizen to vote legally. It is granting the right to vote to citizens of the United States but not reserving the right to vote to only citizens of the United States," Becky Arps, director of research for Americans for Citizen Voting, wrote to the House Elections Committee.
About 15 states have language explicitly barring noncitizens from voting. Arps said some states with similar language to Kansas's statutes have cities that allow noncitizen voting. But Arps couldn't point to any currently existing city in Kansas that allows noncitizen voting.
"I am unaware of any situations where noncitizens are voting," Arps said. "You are at risk for a municipality that maybe even considers themselves a sanctuary city, I don't know if you have any of those or that consider themselves that, they would be a municipality that might decide to allow noncitizens to vote."
The committee hearing turned contentious when Hammet, president of Loud Light, could give people the impression that illegal immigrants are voting in elections and increase incendiary rhetoric surrounding immigration. He referred to the Garden City bombing plot in 2016 as an example of violence targeted at immigrants.
"In their legal defense, they tried to say that they thought it was OK because of the political rhetoric about immigrants. And I know that's no one's intention here, to be clear, but I just want you to think about this. Legally and practically, it won't do anything, but it could create fuel on the fire for some radical groups," Hammet said.
Lawmakers grilled Hammet, who is frequently an oppositional voice in committee hearings, for invoking political violence and his use of the term xenophobic.
"It's a little distasteful that we got into this," said Rep. Ricky James, R-La Cygne.
If it passes, the resolution would require approval by voters in a statewide election.
House Bill 2020 was the least controversial of the election bills that got a committee hearing this week, with even opponent testimony saying it agreed with the concept of the bill but had concerns about how it would work in practice. The bill would require the Division of Motor Vehicles to provide a list of all temporary drivers' licenses issued to noncitizens to the secretary of state, who would compare the list with voter registration rolls and delete any noncitizens on the rolls.
General counsel for the Kansas Secretary of State's Office said the process is similar to what the office has been doing on its own.
"Essentially what this bill does is it makes a statutory requirement of something that's been going on for about 15 years, and we recently worked with Gov. Kelly on this where the Department of Motor Vehicles would give us a list of people that have a temporary driver's license, and we would compare it to the voter rolls, trying to identify anyone that might be a noncitizen," Clay Barker said.
Loud Light and the ACLU submitted testimony in opposition to the bill, but Hammet said the system should required investigation and due diligence before removing people from voter rolls.
"The most dangerous thing you could do is assume that you can take two lists and perfectly compare them," Hammet said.

Jun. 9—Families hoping to send money to loved ones in other countries may be hit with additional fees from a tax and spending bill proposed by the Trump administration that would slap a 3.5% tax on remittances sent by anyone who is not a U.S. citizen. The "One Big Beautiful Bill Act" passed through the House in May and is now being debated by the Senate. The budget bill has several proposed tax changes, which include taxing money sent from an estimated 40 million non-US citizens — including green card holders, temporary workers and undocumented immigrants — to family and friends in other countries. The bill had a 5% tax but was reduced to 3.5%. The bill is another way the Trump administration is hoping to dissuade immigrants, both documented and undocumented, from coming into the country and moving money out of the U.S. economy. Republicans believe the bill would increase the average take-home pay of U.S. citizens, while Democrats believe the bill and increased taxes are "a transfer of wealth from the working class to the rich," said Daniel Garcia, spokesperson for the Democratic Party of New Mexico. What is a remittance? Remittances refer to sending money from one person to another and is typically done between family members from one country to another. A person living and working in the U.S. would send money to family members typically living in a developing country, where this money is a source of income that contributes to the country's gross domestic product (GDP). Payments are typically sent using an electronic payment service or a money transfer app. Banks, credit unions and money transfer services charge a fee for processing remittances, and fees average 10%, according to the International Monetary Fund. Cryptocurrency exchanges are not as heavily regulated and can be a way to avoid additional taxes and surcharges. "Taxing remittances would amount to a form of double taxation, since migrants already pay taxes in the country where they work," Esteban Moctezuma Barragán, Mexican Ambassador, wrote in a statement. "Imposing a tax on these transfers would disproportionately affect those with the least, without accounting for their ability to pay," Barragán added. However, some believe the 3.5% tax fee would give financial support to public services and is the most "pro-worker, pro-family and pro-American legislation we've seen in decades," said Amy Barela, chairwoman of the Republican Party of New Mexico. "Let's be clear, this measure is not about targeting individuals," she wrote in a statement to the Journal. "It's about ensuring the 3.5% fee, although modest, would also have a very meaningful impact in helping offset costs associated with public services, border security, and community infrastructure — relieving some of the financial pressure on hardworking New Mexicans who continue to bear the burden of an imbalanced system." Crucial source of revenue Mexico is the second-largest receiver of personally wired money behind India, according to the Center for Strategic and International Studies. In 2024, Latin America received $160.9 billion, with the U.S. accounting for 96.6% of all remittances to Mexico. They also make up 20-30% of GDP in countries like El Salvador, Guatemala, Haiti and Honduras. "Remittance is a very important source of revenue in our government," said Patricia Pinzón, consul of Mexico. "This would affect Mexican families and the economy in general, but I would say the basic needs of Mexican families is the most worrying thing." However, "whatever happens in one economy will affect the other," said Pinzón. "Our economies are so interrelated that everything that happens here has a consequence in Mexico," she said. "Mexicans will not stop sending money; they'll just look for alternative ways to send it." Mexican migrant workers sent 16.7% of their labor income back to their families, and more than 80% of the income remains in the U.S. economy. The average amount of remittance sent to Mexico is roughly $350 every one to two months, which "could seem like nothing for the U.S., but it's money that a whole family lives on and covers their basics in Mexico," Pinzón said.

Trump says more troops will be deployed. Where do things stand with California protests?
Protests in Los Angeles continued to escalate late Monday, after the first contingent of National Guard troops, deployed by President Donald Trump, arrived to the city on Sunday. Late Monday news broke that Trump planned to deploy additional National Guard members to quell violent protests. Images out of L.A. showed scenes of chaos — Waymo self-driving cars lit on fire as masked protesters waved Mexican flags. At least five cars were set ablaze, according to a CBS News report. The Google-owned taxi service said they don't believe protesters intentionally targeted their vehicles but paused its service in the areas where it faced disruption. The LAPD announced they made 50 arrests during the demonstrations over the weekend. As Fox News' Bill Melugin reported, the charges included attempted murder with a Molotov cocktail, and assault with a deadly weapon on an officer. 'Five officers and five LAPD horses have sustained minor injuries, and crowds were using hand held radios to communicate law enforcement movements to each other,' Melugin reported. There was a brief reprieve in the violence early Monday, although city residents continued navigating street and freeway closures amid protests. Among the demonstrators was an interfaith group that sung hymns in front of the police, as CNN showed Monday morning. ICE agents stood behind LAPD officers. Trump announced Saturday night he would deploy 2,000 National Guardsmen to Southern California to protect federal buildings and U.S. Immigration and Customs Enforcement officers who were carrying out raids on migrants in the country illegally. On Monday, the Trump administration moved to also send 700 Marines to quell the protests. The troops were scheduled to arrive over the next 24 hours. 'You watch the same clips I did: cars burning, people rioting, we stopped it,' Trump said, speaking at the White House. 'If we didn't do the job, that place would be burning down just like the houses,' he added, referring to the wildfires in Los Angeles in January. 'I feel we had no choice ... We did the right thing.' While Trump says he felt his administration didn't have a choice and 'did the right thing,' California Democrats argue the president escalated the situation. California Gov. Gavin Newsom, who opposed the deployment of National Guard troops, criticized Trump for sending soldiers to California in a post on X. 'U.S. Marines have served honorably across multiple wars in defense of democracy,' Newsom said. 'They shouldn't be deployed on American soil facing their own countrymen to fulfill the deranged fantasy of a dictatorial President,' he said. 'This is un-American.' Hours later, in a separate post, Newsom said he 'was just informed Trump is deploying another 2,000 Guard troops to L.A.' He claimed the first set of National Guard members Trump sent to California didn't receive food or water and only roughly 300 of them are actively deployed while the rest await their next orders in federal buildings. 'This is Reckless. Pointless. And Disrespectful to our troops,' Newsom added. Newsom urged the Trump White House to rescind the National Guard deployment on Sunday. By Monday, his administration had filed a lawsuit against the federal government. Newsom and California Attorney General Rob Bonta announced they sued the Trump administration for sending the National Guard without the governor's authorization or request during a press conference Monday. 'Donald Trump is creating fear and terror by failing to adhere to the U.S. Constitution and overstepping his authority. This is a manufactured crisis to allow him to take over a state militia, damaging the very foundation of our republic,' said Newsom. 'Every governor, red or blue, should reject this outrageous overreach,' the governor added. According to Bonta, this marks California's 24th lawsuit against the Trump White House over the past four months. Newsom urged Californians to protest peacefully. During Monday's press conference, Bonta also cautioned violent demonstrators against breaking the law to avoid arrests. L.A. Mayor Karen Bass claimed the ICE raids last week and the military presence in the city sparked increased violence over the weekend. 'If you dial back time and go to Friday, if immigration raids had not happened here, we would not have had the disorder that went on last night,' Bass said on CNN's 'The Situation Room.' 'If they see ICE, they go out, and they protest, and so it's just a recipe for pandemonium that is completely unnecessary. Nothing was happening here. Los Angeles was peaceful before Friday.' Vice President J.D. Vance told the governor to do his job. 'That's all we're asking,' he added. Trump patted himself on the back for deploying the National Guard in a post on Truth Social. 'We made a great decision in sending the National Guard to deal with the violent, instigated riots in California,' he said. 'If we had not done so, Los Angeles would have been completely obliterated.' He criticized Newsom and Bass for not accepting the federal government's help nor expressing any gratitude for it. 'Instead, they choose to lie to the People of California and America by saying that we weren't needed, and that these are 'peaceful protests,'' he wrote.

Mayor Bass blames Trump's ICE raids for starting riots while claiming 'things in LA are calm'
Los Angeles mayor Karen Bass blamed the Trump administration's Immigrations and Customs Enforcement (ICE) operations for starting the riots that exploded over the weekend, while claiming "things in L.A. are calm" Monday. The National Guard was deployed to Los Angeles County as anti-ICE protests continued to escalate Saturday. The unrest is centered in the city of Paramount, California, where protesters clashed with federal authorities, including ICE officers who were allegedly trying to conduct a raid at a local business. As President Donald Trump cracks down on the violent protests that have erupted, some Democrats have gone so far as to blame him for the violent unrest. "I just have to say that if you dial back time and go to Friday, if immigration raids had not happened here, we would not have the disorder that went on last night," Bass told CNN's "Situation Room" co-host Pamela Brown. "I will tell you that it is peaceful now, but we do not know where and when the next raids will be." CNN's Wolf Blitzer then juxtaposed how the state of California is preparing a lawsuit against the Trump administration for their deployment of the National Guard without their consent, with how the LAPD police chief has called out the protesters' use of violence. "So why not welcome more boots on the ground?" he asked. "I think the issue here is state power and state sovereignty," she said, "What the governor is doing is separate from what's happening in the city - but what was the reason that the president had to take the power from the governor and federalize the National Guard?" "The night before this action was taken, there was a protest that got a little unruly late at night. It was 100 people. Twenty-seven people were arrested. There wasn't a reason for this, that is the concern," she added. "And if there was, the way it happens traditionally is, is that requests are made on the local level of the governor to send National Guard troops. No request came from the city of Los Angeles. What has happened now is an entirely different situation." "And then knowing that in a city like Los Angeles - and we had talked about this for a long time - that has a very sophisticated, long-term immigrant rights organizations and institutions, that if these random raids were going to happen, then there was going to be the danger of a backlash. And you add on to that the National Guard, and it felt like fuel for a fire that was unnecessary." When asked about whether the National Guard is needed, she said they are not necessary. "No, I don't think the National Guard is needed now. Things in L.A. are calm," the mayor claimed. "I will tell you that I'm saddened by the extent of the vandalism in the form of graffiti all through the downtown area, but it is important for people to know that even in downtown, this is isolated to a few streets. This is not citywide civil unrest taking place in Los Angeles, a few streets downtown. It looks horrible. People committed crimes. It is absolutely unacceptable. And those people that set cars on fire, or did other forms of vandalism will be sought to be arrested and prosecuted. This is not the way to promote a cause like immigrant rights." Brown played a recording of local Los Angeles Police Chief Jim McDonnell condemning violence in the protests, saying he mentioned "officers being targeted with molotov cocktails, fireworks, rocks and other projectiles" and asked Bass what she is doing to support him. Bass claimed she is "completely in sync with the police chief," and people who committed crimes would be held accountable, but again condemned Trump's ICE raids. "The raids should stop, especially on people's workplaces," the mayor said, worrying about the impact on the economy and touting Los Angeles as a "city of immigrants." "I worry about the people who were detained on Friday, whose families still have not been able to reach out to them. The lawyers have not been able to go in and deal with their clients. This is unprecedented. This has not happened before. And so again, you want to talk about chaos. Well, this is what contributes to chaos," she added, again placing the blame on the Trump administration. Brown, however, questioned whether she is truly in sync with her police chief, noting that he says he and his forces are overwhelmed. Bass claimed McDonnell is receiving support from the sheriff's department and other police departments, and that everything is either manageable or has already calmed down. "I do not believe that he was describing a situation where we cannot bring it under control here. I think you should talk to him a little bit further," she said. "But what we are seeing, for example, there is nothing happening on our streets now. On Saturday, when this decision was being contemplated, there was nothing happening on our streets. As I mentioned that evening, there was a protest that got out of hand. It was a protest of 100 people.
