Germansplaining: The AfD extremists

This was the kind of bureaucratic bombshell that comes with footnotes, will lead to court rulings, help the AfD to self-identify as a political martyr and cause controversy in Friedrich Merz's new coalition.
Last week, Germany's domestic intelligence agency, the Bundesverfassungsschutz, made official what most people with functioning moral compasses have long believed. The Alternative für Deutschland (AfD) is officially categorised as a right wing extremist organisation. Not just in three Eastern Bundesländer, as they were before, but nationwide.
The decision was made public only days before interior minister Nancy Faeser (SPD), whom the Verfassungsschutz answers to, left office for good. Her successor, Bavarian conservative Alexander Dobrindt, will now have to deal with the consequences of this difficult parting gift. You can call it a constitutional minefield. Happy first day at the office, mate.
Now, the AfD have had this coming. The party has been under surveillance officially and unofficially in several states and their radicalisation over the past few years has been about as subtle as a German oompah-oompah band in an Indian yoga retreat.
The report, which is still confidential, draws on information from 2021-2025 – and its publication was timed for after the federal election, because otherwise the cry of 'political interference' may have caused more harm for the general trust in institutions than to AfD. But it wasn't communicated well.
In a briefing to journalists (the courts, which the AfD will certainly turn to, tend to not like that kind of thing at all) the decision was justified by the party's 'prevailing ethnic and descent-based understanding of the Volk', which is 'not compatible with the free democratic basic order.' According to the Verfassungsschutz, it 'aims to exclude certain population groups from equal participation in society, to discriminate against them and therefore not to treat them as equals in legal terms.' The AfD also cultivates an 'exclusionary understanding of the Volk', the report says.
To document this, domestic intelligence draws upon terms used by AfD members such as 'Passdeutsche' (meaning they 'only' have a passport, but aren't proper Germans), 'Großer Austausch' (great replacement), 'Umvolkung' (ethnic replacement) and 'Messermigranten' (knife migrants).
As we commemorate the 80th anniversary of the Kriegsende, Germany is proud of its rule of law: the Verfassungsschutz has a legal mandate and it doesn't throw accusations around lightly.
Given the significance of labelling the largest opposition party 'extremist', however, you'd think someone might have come up with more than a meagre press release and to hand out an English version of it, too.
And considering that only very few people have actually read the roughly 1,100-page report by an executive agency, the demands to 'ban AfD now' by trade unions, the Green Party and parts of the SPD are premature. Which is why the political centre right is guarded, although the CDU/CSU, too, is discussing what the consequences of this new ruling should be.
If upheld by the courts, it opens the door to serious surveillance powers – think wiretaps, undercover agents, and the full democratic-defence toolkit, potentially used against high-ranking members of the parliamentary opposition. Note: Members of the Linke, a party considered far left extremist in some states, have successfully sued against such measures.
Another tricky question is how to deal with civil servants, police officers, members of the army or the judiciary who are AfD members. Under German law, state employees must be loyal to the democratic constitution. Being a card-carrying member of an officially extremist party isn't exactly a confidence-booster – on the other hand, every individual case has to be treated, well, individually. So sacking a teacher because of his membership alone isn't likely to happen.
The legal, ethical, and bureaucratic consequences are still being debated – fiercely.
In the latest representative survey, 61% consider the AfD to be an extreme right wing party, 31% do not. And in addition, 48% of respondents are in favour of a ban, while 37% are against.
Banning the AfD altogether is legally conceivable, in theory, but politically combustible. The hurdles are sky-high, and the potential backlash even higher. As tempting as the dream of an AfD-free Bundestag may be, banning the party wouldn't make the anger and fear that fuel it disappear.
The only sustainable way to reduce voters' support is through competent, visible, effective governance.

Two White House officials familiar with the matter said Trump expressed confusion and frustration in the meeting about Musk's attacks on his sweeping tax and spending bill. But he held back, the officials said, because he wanted to preserve Musk's political and financial support ahead of the midterm elections. By Thursday afternoon, Trump's mood had shifted. He had not spoken to Musk since the attacks began and was fuming over what one White House aide described as a 'completely bats**t' tirade by the Tesla CEO on X, his social media platform. Musk had blasted Trump's tax bill as fiscally reckless and a 'disgusting abomination'. He vowed to oppose any Republican lawmaker who supported it. The bill would fulfil many of Trump's priorities while adding, according to the Congressional Budget Office, $2.4 trillion to the $36.2 trillion US public debt. Privately, Trump had called Musk volatile. On Thursday, he told his team, it was time to take the gloves off. Sitting next to German Chancellor Friedrich Merz in the Oval Office, Trump told reporters he was 'very disappointed' in his former adviser. Musk quickly hit back on social media and the back-and-forth devolved from there. 'The easiest way to save money in our budget, billions and billions of dollars, is to terminate Elon's government subsidies and contracts,' Trump posted on Truth Social, his social media site. Within minutes, Musk said it might be time to create a new political party and endorsed a post on X from Ian Miles Cheong, a prominent Musk supporter and right-wing activist, calling for Trump's impeachment. The Trump-Musk relationship at its height was unprecedented in Washington — a sitting president granting a billionaire tech CEO access and influence inside the White House and throughout his government. Musk spent nearly $300m backing Trump's campaign and other Republicans last year. For months, Musk played both insider and disruptor, shaping policy conversations behind the scenes, amplifying Trump's agenda to millions online, and attacking the bureaucracy and federal spending through his self-styled Department of Government Efficiency (DOGE). Musk did not respond to emails seeking comment about the downturn in relations. His super PAC spending group, America PAC, and spokeswoman Katie Miller did not respond to calls and texts requesting comment. In a statement, the White House called the breakup an 'unfortunate episode from Elon, who is unhappy with the One Big Beautiful Bill because it does not include the policies he wanted'. The Musk-Trump breakup sent Tesla's stock price plunging and drove uncertainty among Trump's allies in Congress, who are working to pass the monumental spending package that Democrats and a small number of vocal Republicans oppose. The breakup could reshape both men's futures. For Trump, losing Musk's backing threatens his growing influence among tech donors, social media audiences, and younger male voters — key groups that may now be harder to reach. It could also complicate fundraising ahead of next year's midterm elections. For Musk, the stakes are potentially even higher. The break risks intensified scrutiny of his business practices that could jeopardise government contracts and invite regulatory probes, which might threaten his companies' profits. Some of Musk's friends and associates were stunned by the fallout, with a number of them only recently expressing confidence that the partnership would endure, according to two other sources familiar with the dynamics. The split had been simmering for weeks, said the first two White House officials, but the breaking point was over personnel: Trump's decision to pull his nomination of Jared Isaacman, Musk's hand-picked candidate to be Nasa administrator. 'He was not happy' about Isaacman, one of the White House officials said of Musk. Isaacman, a billionaire entrepreneur and close Musk ally, was seen as key to advancing Musk's vision for space exploration and commercial space ventures. After his nomination was scuttled, Isaacman posted on X: 'I am incredibly grateful to President Trump, the Senate and all those who supported me.' The move was viewed within the administration as a direct snub to Musk, the two officials said, signalling a loss of political clout and deepening the rift between him and Trump's team. Before the Isaacman episode, top White House aides behind the scenes had already begun limiting Musk's influence — quietly walking back his authority over staffing and budget decisions. Trump himself reinforced that message in early March, telling his cabinet that department secretaries, not Musk, had the final say over agency operations. At the same time, Musk began to hint that his time in government would come to a close, while expressing frustration at times that he could not more aggressively cut spending. His threats and complaints about Trump's bill grew louder, but inside the White House, few believed they would seriously alter the course of the legislation — even as some worried about the fallout on the midterms from Musk's warnings to cut political spending, the first two White House officials said. Still, a fourth White House official dismissed the impact of Musk's words on the president's signature bill. 'We're very confident,' he said. 'No one has changed their minds.' But there was bafflement at the White House at how a relationship that only last week had been celebrated in the Oval Office had taken such a turn. Time will tell whether the rift can be repaired. White House aides have scheduled a call between the two men on Friday.

A particular focus has been on cracking down on employers facilitating illegal working - often subjecting migrants to squalid conditions and illegal working hours below minimum wage. Restaurants, nail bars and construction sites have been among the thousands of businesses targeted. Since July 2024, 469 visits resulted in 309 arrests - marking a 63% and 68% rise respectively to the previous year. Last month, a raid in Glasgow saw six arrested after immigration enforcement officers undertook visits to businesses across the city. Four men and two women were arrested for having no right to work in the UK and overstaying their visas. The individuals were of Indian, Iraqi, Colombian, Spanish and Portuguese nationalities. Businesses to be targeted in the sting included Malaga Tapas West End, Malaga Tapas Bearsden, The Malletsheugh, The Marmaris and Lamegos. The action forms part of a nationwide intensification which has seen illegal working visits increase by 48% and arrests spike by 51% across the UK. It comes alongside a ramp-up of operational activity to restore control of the immigration system, including the return of nearly 30,000 people with no right to be in the UK. Minister for Border Security and Asylum, Dame Angela Eagle, said: ' Illegal working simply will not be tolerated under this government. 'That's why we are intensifying our enforcement activity to target illegal workers and unscrupulous employers who undermine our border security. 'Under our Plan for Change, we are finally restoring order to our immigration system and ensuring the rules are respected and enforced.' Lynne Davidson, HM Inspector, Scotland ICE Team, said: 'There is no excuse for ignoring employment and immigration rules and those who do should be in no doubt that they will face the full consequences. 'Businesses have a legal requirement to carry out right to work checks on employees and we will continue to pursue unscrupulous employers and those who break immigration laws.' Ramping up illegal working enforcement activity forms a key part of the Home Office's drive to restore order to the immigration system under the UK Government 's Plan for Change. In many cases, individuals travelling to the UK illegally are sold a lie by smuggling gangs that they will be able to live and work freely in the UK, when in reality they often end up facing poor pay, inhumane working hours and squalid living conditions The UK Government is also introducing tough new laws to clamp down on illegal working by extending Right to Work checks on those hiring gig economy and zero-hours workers in sectors like construction, food delivery, beauty salons and courier services.
