Adu Dhabi court orders truck driver to pay Dhs20,000 for running over a colleague

Gulf Today06-04-2025

Abu Dhabi Family, Civil and Administrative Cases Court obligated a worker to pay a compensation of Dhs20,000 to another worker for running over him while driving a truck and reversing it in their workplace.
Earlier, the victim filed a lawsuit against four parties; namely, the truck driver, the company where the accident took place, the truck owner and the plaintiff's employer.
He requested the court to obligate them to pay him Dhs51,000 as a compensation for the injuries he sustained plus a 12 per cent legal interest from the date the lawsuit was filed until full payment.
The victim stated in his lawsuit that he had sustained multiple fractures in his bones and other parts of his body, as proven by the medical report, due to the defendants' error.
He pleaded that the defendants did not fulfill their professional obligations by failing to take safety and security measures, watch what workers do in the workplace and take precautions to protect workers from injury.
The driver was driving his truck in reverse when he ran over him inside a workplace belonging to the company, he said, adding that as a result, a criminal case was filed against the defendant under which he was fined Dhs3,000, which was paid.
In view of the harms and injuries he suffered, he filed the current lawsuit against the other three defendants because he believed they were liable for some errors that they committed and led to what happened.
According to the medical report, the plaintiff's disability was estimated at 10 per cent as he suffered from multiple fractures in the three cuneiform bones, metatarsal bones and phalanges of the left foot plus a dislocation of the proximal joint of the second big toe of the left foot.
The plaintiff was unable to bear weight on the forefoot of the left foot and complained of a pain when standing for a long time, walking for a long distance and going upstairs and downstairs, not to mention that he was unable to run and jump, the report added.
The court explained that it was evident from the criminal judgment and the forensic report that the plaintiff, 41, who was employed as a worker, sustained multiple injuries that left him with a permanent disability.
The injuries also caused pain and feelings of grief and sadness due to his inability to return as a normal worker as his peers, which might lead him to lose job opportunities, be deprived of a chance to complete some work and face a drop in income.
The court ruled that an estimated general compensation of Dhs20,000 should be paid by the driver to the plaintiff to cover all the harms he sustained but rejected the request for interest as being unnecessary.

Abu Dhabi woman lures another woman to join saving plan, defrauds her of Dhs30,000

Abu Dhabi Family, Civil, and Administrative Cases Court has ordered a woman to pay Dhs30,000 to another who she agreed with to join a joint savings scheme (known as a "jam'iya"). The two had agreed to contribute Dhs6,000 monthly for six months, totaling Dhs36,000 but the suspect paid only the first installment, received her full share of Dhs36,000, and then failed to pay the remaining installments without justification. The plaintiff filed a lawsuit demanding the appellee repay her Dhs30,000, along with Dhs5,000 in compensation for delayed payment, a 12% legal interest from the due date until full settlement, and coverage of legal fees and expenses. The plaintiff explained that she and the appellee agreed to a six-month jam'iya scheme, with each contributing Dhs6,000 monthly to reach Dhs36,000. The appellee reportedly paid the first installment of Dhs6,000, and the plaintiff transferred her Dhs36,000 but she stopped paying the remaining installments. The court ruled to terminate the agreement between the parties and ordered the appellee to return Dhs30,000 to the plaintiff.

Man offers to buy business class air ticket, defrauds another of Dhs13,000 in Abu Dhabi

Abu Dhabi Family, Civil and Administrative Cases Court has ordered a person to return Dhs13,000 plus a compensation of Dhs5,000 to another after misleading him into believing he could book a business-class ticket from the UAE to another country at a competitive price. In good faith, the victim transferred the money to the defendant's account, but the defendant then pocketed the money, failed to fulfill the agreement and procrastinated when asked to return the amount. The plaintiff filed a lawsuit against the defendant in which he requested that he be obligated to pay Dhs13,000 plus a compensation of Dhs10,000, the legal interest on the amounts required to be paid and the legal fees and expenses incurred by the lawsuit. The plaintiff pleaded that the defendant made him believe that he could book a business class ticket from the UAE to another country at a competitive price and consequently he, in good faith, transferred the amount to his account. The defendant, however, pocketed the money, failed to fulfill the agreement and procrastinated when asked to return the money, he added, noting that these actions caused him financial harm, which prompted him to file this lawsuit with the aforementioned requests. The court explained that it is legally stipulated in articles 304 and 308 of the civil proceedings law that 1) The hand that has taken is liable until it gives it back. 2) The one who extorts the property of another shall have to restore it back in the same condition in which it was at the time of extortion, and at the same place where extortion occurred. It is proven from the papers that the defendant pocketed the plaintiff's money, which was transferred to him as shown in the account statement, the court said. Therefore, the court will build on that by obligating the defendant to pay Dhs13,000to the plaintiff, it added. The court stated that as the plaintiff requested to be compensated for the harms that befell him and based on the causal relationship between the error and the harm, the court hereby estimated the compensation that the plaintiff deserves for such harms at Dhs5,000.
