1MDB trial: Defence closes its case, court sets Sept 30 for submissions
PUTRAJAYA: The defence in former prime minister Datuk Seri Najib Razak's 1Malaysia Development Bhd (1MDB) case involving the misappropriation of RM2.28bil has closed its case after calling 26 witnesses.
Najib's lead counsel Tan Sri Muhammad Shafee Abdullah told the court that the final witness in its case was forensic document expert Tay Eue Kam.

"Yang Arif, we have officially closed the case after our 26th witness," Shafee told presiding judge Justice Collin Lawrence Sequerah here on Tuesday (May 6).
Justice Sequerah thanked parties for assisting the High Court in the case.
He then fixed Sept 30 for parties to make their submissions simultaneously, with replies due by Oct 10.
The judge also fixed Oct 21 to 24 and Oct 27 to 31 for oral submissions before the court.
"I trust that the submissions will focus on the main issues raised by the defence. I do not need to give further instructions.
"All the hearing dates fixed prior to this are hereby vacated," Justice Sequerah said.

The prosecution's trial began Aug 28, 2019 and its final day was on May 30 last year.
A total of 50 prosecution witnesses were called to the stand over 233 days.
On Oct 30, the High Court ordered Najib to enter his defence on the charges.
Najib took the stand as the first defence witness on Dec 2. A total of 26 defence witnesses testified over 58 days.

Defence witnesses included former 1MDB chairman Tan Sri Che Lodin Wok Kamarudin and the sister of Terengganu's Sultan Mizan Zainal Abidin, Tengku Datuk Rahimah Sultan Mahmud.
Najib, 71, faces four counts of using his position to obtain RM2.28bil gratification from 1MDB's funds and 21 counts of money laundering involving the same amount.

(Bernama pic) PETALING JAYA : A hostel warden at a religious boarding school was sentenced to six years' jail and two strokes of the rotan after pleading guilty to three of 15 charges of sexual assault, sodomy and unnatural intercourse against seven boys between 2023 and January this year. Seremban sessions court judge Surita Budin imposed the sentence on Khairi Fitri Baharom, 38, after the charges were read out separately, reported Bernama. The court also ordered the sentence to begin from the date of his arrest on May 25, and for him to undergo counselling sessions and police monitoring for a year after his release. Khairi was accused of committing sexual assault against a boy aged 12 years and four months at around 11pm between Dec 15 and 20, 2023, at a warden's room in the school in Jempol. He was also accused of sodomising the boy at around 10.30pm on Jan 7 this year and committing carnal intercourse against the order of nature without consent with another boy aged 10 years, seven months at 5pm, between April and December 2024 at the same location. The sexual assault charge was under Section 14(a) of the Sexual Offences Against Children Act 2017 (Act 792), read together with Section 16(1) of the same act, which provides for imprisonment of up to 20 years and whipping if convicted. The sodomy and carnal intercourse charges were under Section 377C of the Penal Code, which provides for five to 20 years' imprisonment and whipping if convicted. Khairi, who was unrepresented, pleaded for a light sentence as he had to care for his mother. However, deputy public prosecutor Norazihah Asmuni asked for a sentence that was commensurate with the crime as the victims were children and the accused was responsible for their care and protection. Khairi pleaded not guilty to 12 other charges against the same victims and five other boys aged between eight and 12 years and nine months, allegedly committed between 2024 and Jan 24 this year at the same location and at a house in Jalan Air Melana, Kuala Pilah, Negeri Sembilan. The charges are under Sections 14(a) and 14(b) of Act 792 for sexual assault, and Section 377C of the Penal Code for carnal intercourse against the order of nature.

In Seremban, hostel warden jailed six years, whipped twice for sodomy, sexual abuse of male students
KUALA LUMPUR, June 12 — A hostel warden at a Quranic learning centre has been sentenced to six years in prison and two strokes of the cane by the Sessions Court in Seremban today after pleading guilty to three out of 15 charges involving physical sexual abuse, sodomy, and unnatural sex against seven male students between 2023 and January this year. Judge Datin Surita Budin handed down the sentence against Mohd Khairi Fitri Baharom, 38, after the three charges were read separately in court, according to a report published by Bernama today. The court also ordered the prison term to begin from the date of his arrest on May 25. The accused must also undergo rehabilitation counselling and be placed under police supervision for one year following his release. According to the charges, Mohd Khairi Fitri was accused of committing physical sexual abuse against a boy aged 12 years and four months at around 11pm between December 15 and 20, 2023, in a warden's room at the learning centre in Jempol. He was also charged with sodomising the same victim at around 10.30pm on January 7, 2025, and with committing unnatural sex on another boy, aged 10 years and 7 months, at around 5pm between April and December 2024, at the same location. These offences fall under Section 14(a) of the Sexual Offences Against Children Act 2017, read together with Section 16(1) of the same Act, which provides for a maximum sentence of 20 years' imprisonment and whipping upon conviction. He was also charged under Section 377C of the Penal Code, which carries a jail term of no less than five years and up to 20 years, along with whipping. Unrepresented during the mitigation process, the accused pleaded for leniency, stating he still has a mother to care for. Deputy Public Prosecutor Norazihah Asmuni urged the court to impose an appropriate sentence, stressing that the offences involved children and that the accused had betrayed his duty as someone responsible for their care and protection. Separately, Mohd Khairi Fitri pleaded not guilty to 12 other charges involving the same victims and five additional boys aged between eight and 12 years and nine months. Court to hear Najib's bid for committal proceedings against ex-A-G on Aug 19
KUALA LUMPUR: The High Court will hear Datuk Seri Najib Razak's leave application to initiate committal proceedings against former Attorney-General Tan Sri Ahmad Terrirudin Mohd Salleh. Judge K. Muniandy made the decision after ruling that the committal application was not subject to an earlier High Court order that stayed all proceedings related to Najib's judicial review over his house arrest claim. On April 28, judge Hayatul Akmal Abdul Aziz, who has since been elevated to the Court of Appeal, granted a stay order pending Najib's final attempt to reinstate his judicial review application at the Federal Court. The court has fixed Aug 19 to hear the leave application. The former prime minister filed the application against Terrirudin, now a Federal Court judge, alleging that he misled the court during proceedings involving an alleged addendum order by the former Yang di-Pertuan Agong, which purportedly allowed Najib to serve the remainder of his sentence under house arrest. Earlier, senior federal counsel Shamsul Bolhassan submitted that the committal application should not proceed, arguing that the stay order applied to all related applications. However, Najib's lead counsel, Tan Sri Muhammad Shafee Abdullah, contended that the committal proceedings were clearly separate and independent, and that the stay applied only to the original applications that remained pending in court. He said the judge had specifically referred to "all proceedings before the court", whereas the committal leave application had not yet been brought before the court at the time the stay was issued. Najib is currently serving a six-year sentence after being convicted of misappropriating RM42 million from SRC International Sdn Bhd. The High Court had initially sentenced him to 12 years in prison and fined him RM210 million, a decision upheld by both the Court of Appeal and the Federal Court. However, following a petition for royal clemency on Sept 2, 2022, his sentence was commuted to six years and the fine was reduced to RM50 million.
