Karnataka high court orders release of murder suspect for not providing arrest grounds details
Bengaluru: The
Karnataka high court
has struck down a remand order and ordered the release of a murder suspect, citing failure to provide proper grounds for arrest and other essential details.
Hemantha Datta, alias Hemantha or Baby, a delivery boy from Arsikere town in Hassan district, challenged the remand order dated Feb 17, 2023, issued by Judicial Magistrate First Class (JMFC), Arsikere. He was booked under sections 302 (murder) and 201 (destruction of evidence) of the IPC. His arrest memo and remand order merely stated his requirement in a murder case, with intimation given to his brother-in-law.

His defence argued that his fundamental rights under Articles 21 and 22(1) of the Constitution were violated, stemming from the non-communication of arrest grounds. The arrest memo lacked adequate justification for his detention.
The additional state public prosecutor countered that the petitioner had received the arrest memo and intimation, in line with sections 50 and 50-A of CrPC. The prosecutor added that the requirement for a written communication of arrest grounds came into effect only after the Supreme Court's judgment in Pankaj Bansal case on Oct 3, 2023.
Justice Hemant Chandanagoudar referred to CBI vs RR Kishore case, where a constitution bench ruled that any law violating fundamental rights is void from the inception under Article 13(2). He also noted that procedural justice can be applied retrospectively, particularly when beneficial construction extends beyond procedural law.
The court observed that the arrest memo lacked essential information to the arestee-petitioner upon arrest, calling it a serious irregularity. This, the judge ruled, amounts to a violation of Articles 13(2), 21, and 22(1) of the constitution.
Justice Chandanagoudar ordered petitioner's release on a personal bond of Rs 1 lakh surety, mandating him to appear before the investigation officer when summoned and refrain from influencing any witnesses.

Three teens held for chain-snatching to fund Kashi pilgrimage trip
Short on funds for a planned pilgrimage to Kashi, three friends from Chinhat area in Lucknow turned to crime to finance their trip. According to police, the trio executed two chain-snatching incidents in different parts of the city, one of which left a woman injured. The three accused, Deepak Soni (19), Lucky Kashyap (19), and Sumit Kashyap (18) were arrested on Sunday, said DCP (East) Shashank Singh during a press briefing on Monday. 'Chain-snatching incidents were reported from Gomti Nagar and Vikasnagar. A joint team of Gomti Nagar Police and the East Zone Surveillance/Crime Team recovered three pieces of gold chain, ₹6,000 in cash, and the black Splendor motorcycle (registration no. UP32PW2426) used in the crime,' said the DCP. During interrogation, the accused confessed to the two snatching incidents one on June 6 near Sahara Plaza, Patrakarpuram, and another on May 30 outside CMS School in the Vikasnagar area. The gold chain from the Gomti Nagar incident was reportedly cut into three pieces and divided among them. 'They planned to sell the stolen jewellery and use the money for a trip to Varanasi, where they intended to visit temples in the Manduadih area and stay for a few days,' added Singh. The case began unravelling when Manju Shrivastava filed a complaint on June 6 after being targeted by the trio near Sahara Plaza Gate No. 1 in Gomti Nagar. Following the FIR, a special team was formed to track down the accused. On June 9, while conducting vehicle checks near Gwari crossing, the police intercepted a black motorcycle. When the riders tried to flee, they were chased and apprehended under the Gwari flyover. According to ADCP, North, Pankaj Singh, background checks revealed that Lucky Kashyap has a previous case under the Arms Act registered at Chinhat, while Sumit Kashyap has a prior case under Sections 363 and 366 of the IPC at Fatehpur police station in Barabanki. Police said further criminal history checks are underway.

Teacher detained for trying to bribe Education Minister with Rs 5,000
The Rajasthan Police have detained a government teacher for allegedly trying to bribe the cabinet minister for School Education, Madan Dilawar, at his Jaipur residence on Monday. The incident happened when the minister was holding a public hearing at his official residence in Civil Lines area. As per the minister, the teacher Chandrakant Vaishnav arrived with a letter, a box of sweets, and an envelope. The minister said that he didn't suspect anything upon seeing the envelope as these are usual with the letters, 'thinking it might have someone's recommendation. But then my photographer Bharat told me that apparently the envelope has money. Once we opened, it had Rs 5,000.' Vaishnav, posted as a Level 2 science teacher in Banswara's Ghatol, was seeking a recommendation for appointment as a writer in the textbook committee for science for Classes 6-8, which comes under the Rajasthan State Council of Educational Research and Training (RSCERT). To influence the minister, who has an RSS background, Vaishnav stated in his letter that he had been associated with RSS's student organisation, the 'Akhil Bharatiya Vidyarthi Parishad (ABVP), and Sangh ideology since his student days.' He said that currently, while holding the post of a teacher, he is also associated 'with organisations like the Bharatiya Mazdoor Sangh, which are associated with the ideology of the Sangh.' Indicating his willingness to rewrite textbooks as per the ideology, Vaishnav said that the new textbooks will be drafted 'as per the intention of the present government' and sought a recommendation from the minister for his inclusion in the committee. Dilawar said that this was the first such instance of his life which is also the 'worst.' 'This is the first such instance in my life; I have been in politics for 35-36 years and am a third time minister. It is quite painful that someone could think that the Education Minister can take a bribe and act on their request,' Dilawar said, adding that this was also the first time he saw this person. Taking a dig at the Congress, Dilawar said, 'I would not like to comment on the past or future. There could have been a tradition (to bribe the minister). Hence, he dared to do this.' Vaishnav, now suspended, is now being questioned by the Jaipur Police.
