
12-Yr-Old Rape Survivor Delivers Baby After Moving HC For Abortion
Nagpur: A 12-year-old rape survivor, who was on June 17 allowed to terminate pregnancy in the 28th week by the Nagpur bench of Bombay high court, delivered a baby at a govt facility in Akola on June 18.
The turn of events happened after a medical board constituted by the court opined that terminating the pregnancy would endanger the minor's life.
The minor gave birth to a baby boy weighing 980gm at Akola Govt Medical College and Hospital. Both the girl and the newborn are reportedly stable and expected to be discharged soon.
A division bench of Justices Nitin Sambre and Sachin Deshmukh had earlier granted conditional permission for medical termination of pregnancy on June 17, based on undertakings from the minor and her parents.
However, the court-appointed medical board later submitted that proceeding with abortion at this stage could be life-threatening for the minor mother.
The judges had clarified that their decision was based entirely on expert medical assessment and in the best interest of the minor's health and survival.
Advocate Soniya Gajbhiye, representing the minor and her family, told TOI that they will now approach the high court again seeking directions on custody and future care of the newborn.

"The minor is herself dependent on her parents and incapable of caring for the baby. The accused, her uncle, is currently in judicial custody on charges of raping the minor," she said.
In its judgment, the bench also reiterated important constitutional principles on reproductive rights, referring to Supreme Court precedents. It observed the physical and psychological trauma of forced pregnancy, especially arising from sexual assault, violates a woman's dignity and autonomy under Article 21 of the Constitution.
"The right to bodily autonomy rests with the woman alone, irrespective of her age or marital status. No authority, including the state, can compel her to carry an unwanted pregnancy. Such coercion would strip her of the right to decide the immediate and long-term course of her life," the court had ruled, while accepting this constitutional principle had to be balanced with expert medical advice in the present case.
The petition was filed by the minor's parents through Gajbhiye. Government pleader and senior counsel Deven Chauhan, assisted by advocate HD Marathe, represented the state.

In one case, she harassed a woman colleague suspecting her to be interested in the male colleague to the extent that she quit her job," said the police officer. In the past two years, Joshilda bought at least 80 numbers through VPN and is suspected to have sent hundreds of fake emails and messages. She was devastated when she found out that her "male interest" married another woman. "She used dark web tools and spoofed emails to fake identities, but made one digital mistake that led us to her," said JCP Sharad Singhal. "She is skilled in cyber tools and meticulously tried to hide her tracks." Sources said that Joshilda mentioned the male colleague's name in at least half a dozen mails of bomb threat which led the cops to reach out to him. Joshilda was a suspect and technical surveillance confirmed that she was behind the slew of bomb hoax mails which had kept the authorities on their toes across states in the recent past. Police recovered devices, technical evidence, and fake accounts linked to 21 hoax threats. Further investigation is underway to verify if more people were involved.

MEERUT: A 13-year-old patient from Meerut admitted to the orthopaedics ward at a top hospital in the city, was allegedly sexually assaulted by a 20-year-old man inside the women's washroom around 1 am on Sunday. The girl, a Dalit, was being treated for knock knees, and was accompanied by her mother at the facility's general ward. Police said the accused Rohit Kumar, an attendant of another patient had followed the girl to the washroom and committed the crime. Her mother was asleep at the ward at the time. Kumar was held later in the day. Principal of the health facility said they have constituted a panel to probe the matter, and "will take strict measures to prevent such a crime in future." SP (Meerut city) Ayush Vikram Singh said, "The accused belongs to Kashipur, Uttarakhand. He left behind a video message in which he alleged that his wife had been previously married, was having an affair with a police inspector in Maharashtra, and was pressuring him to kill his father. Magan, also known as Ajay, addressed this message to a Panipat-based women's rights activist he knew as a 'rakhi sister.' In the video, Magan claimed that before taking the extreme step, he had received a video of his wife, Divya, dancing suggestively for her paramour, Deepak — allegedly a police inspector posted in Sambhajinagar, Maharashtra. He said the two had emotionally blackmailed him and extracted Rs 3.5 lakh: Rs 1.5 lakh from selling his wheat crop and Rs 2 lakh from mortgaging a gold bracelet. Magan's body was found hanging from a tree in his village on the night of June 18. His family located him after seeing the suicide video he had posted on social media earlier that day.
