Warisan candidates who betray party will face RM10mil penalty, warns Shafie
KOTA KINABALU: Warisan candidates contesting in the upcoming Sabah state election who act against the party's direction will face a RM10mil penalty, says Datuk Seri Mohd Shafie Apdal.
The Warisan president said this was part of the party's move to ensure only committed individuals are chosen to contest, especially in critical seats.
"All candidates fielded this time, if they make any move that is not in line with the party's direction, I will sue them – RM10mil.
"We cannot allow candidates to win under our banner and then jump," he said when met by reporters after his visit to the site of a recent fire at Kampung Dopo, Petagas, Tuesday (June 17).
Warisan won 23 seats in the 2020 Sabah Election but saw its strength significantly reduced after 10 of its assemblymen defected to other parties. The party later gained two former DAP representatives from Elopura and Sri Tanjong and now holds 14 seats in the Sabah state assembly.
Meanwhile, Shafie said Warisan had closely studied the electoral roll.
"We're looking at the trends – their age, where they're inclined, what they like. More than 65% of voters now are young people," he said.

KOTA KINABALU: Parti Warisan can pursue legal action against those who betray the party but may not get the RM10mil they seek, says a lawyer. Datuk Roger Chin said while the party can sue if they choose, any chance of success would depend on contractual validity and whether the RM10mil penalty is considered "reasonable." He said the case involving former PKR vice-president Zuraida Kamaruddin sets the legal precedent. In the case, the KL High Court ruled that Zuraida had signed a legally binding bond promising RM10mil if she defected and ordered her to pay the party that amount. However, the Court of Appeal deemed the sum as "unreasonable and extravagant" under Section 75 of the Contract Act, and reduced it to RM100,000 (minus costs). "This ruling confirms that while bonding candidates is legally permissible, courts will significantly reduce penalties considered punitive or out of proportion," said Chin, who is also former Sabah Law Society president. He said Warisan president Datuk Seri Mohd Shafie Apdal's recent statement that party candidates would be asked to sign a loyalty pledge and defectors would be sued RM10mil is a mirror of the PKR bond He said courts would evaluate two key criteria – the validity of the contract (i.e. the bond must be properly signed, with informed consent) and the reasonableness of the sum, which the court would compare to actual losses incurred. "Based on the Zuraida precedent, RM10mil would almost certainly be deemed excessive," Chin said. 'Now he is not only backstabbing Sandakan but also damaging Sabah's image and future in the eyes of outside investors. If such actions continue, investors will think twice before choosing Sabah as an investment destination,' she said. She said the people of Sabah and Sandakan should not become victims of irresponsible political games, calling for rational, responsible and globally-minded representatives instead of those who 'enjoy stirring political drama for cheap publicity. 'Do not let cheap publicity sacrifice development opportunities that Sabah desperately needs. Warisan sets RM10 million surety bond for its election candidates

PUTATAN: Parti Warisan has set a RM10 million surety bond for its candidates in the coming 17th state election to prevent defections and other violations. Party President Datuk Seri Mohd Shafie Apdal said the condition ensures winning candidates face legal action if they breach party rules, including party hopping. Advertisement 'We need to match grassroots voters' preferences because candidates are crucial. They will be scrutinised, as 65 per cent of voters everywhere are young people,' he told reporters after visiting fire victims at Dewan Sri Putatan, Tuesday. 'Second, do not jump parties. That is the criteria we have set. Although we know the Anti-Hopping Act exists, I am prepared. If anyone jumps, I will take them to court for RM10 million,' he said. The former Chief Minister and Senallang Assemblyman acknowledged many are interested in candidacy, but pointed out that the primary focus is on commitment to serve the people. 'Many are eager to become candidates, but for me, this election is not about appeasing feelings. We want to take power. The people need leadership capable of solving various problems,' said Shafie, who expressed shame over politicians' tarnished reputation due to corruption and water supply issues. On the five per cent Sales and Service Tax (SST) expansion in July, Shafie voiced concerns about its direct impact on Sabahans. 'I have raised this in Parliament. My worry is price increases that will burden society. When SST is implemented, I hope the Government takes cost-saving measures in national financial management,' he said, noting the country's expenditure has reached RM400 billion. He called for preventing leakages and avoiding non-priority spending, urging the Government to play its role in addressing the issue. During his visit to the 27 families affected by two separate fires in Putatan, Shafie reiterated his previous proposal for a permanent disaster relief centre, similar to one established in Beaufort. 'Temporary placements like halls can only be used for three days. After that, victims must find elsewhere.
