Pastor Koh, Amri's ‘abductions' similar, cop tells court

KUALA LUMPUR : The investigating officer probing Pastor Raymond Koh's disappearance told the High Court that the circumstances of his alleged abduction were similar to those surrounding another missing activist, Amri Che Mat.
Supari Muhammad agreed that windshields of the vehicles used by both activists had been smashed, and that a group of individuals had alighted from several sports utility vehicles to drag them out of their cars.
He said both operations took less than a minute each.
He also admitted that Koh and Amri were both founders of their respective NGOs, and that their abductions took place in public areas.
Amri , who founded Perlis Hope, had left his home in Kangar at about 11.30pm on Nov 24, 2016. His car was found at a construction site near the Bukit Cabang Sports School early the next morning.
'If they were police operations, there would usually be marks or badges (on the SUVs). But in these cases there were none.
'I can't say they were carried out by the police because the MO (modus operandi) can be copied (replicated),' Supari said, when testifying in a lawsuit filed by Koh's wife, Susanna Liew, against the police and the government over Koh's disappearance.
Supari is one of the defendants named in the suit.
Liew wants the authorities to be held liable for her husband's abduction and for misfeasance in public office.
Supari also told the court that the now defunct Special Task Force on Organised Crime (Stafoc) coordinated investigations for Koh and Amri as well as the missing couple, Joshua Hilmy and Ruth Sitepu.
Asked by Liew's lawyer, Jerald Gomez, whether the police managed to track down the vehicles involved in Koh's abduction from footage of CCTVs located on major roads and highways, Supari said most of the CCTVs under the Petaling Jaya City Council (MBPJ) purview were not functioning at the time.
Gomez: But in (the late deputy public prosecutor) Kevin Morais's murder case, the police managed to track the suspects through the CCTV footage.
Supari: Those CCTVs were under the purview of their local council. We tried to get the footage but failed.
Trial judge Justice Su Tiang Joo then asked Supari how the authorities were able to manage the community's safety and wellbeing if the CCTVs were not functioning.
Supari told the court that the equipment came under the purview of the state government. He said the issue has been raised at state exco meetings.
On whether the police tried to obtain CCTVs from highway concessionaires, Supari said his officers managed to obtain black and white images of traffic flow but could not identify the vehicles' registration numbers.
Former e-hailing driver acquitted of kidnapping Koh
Supari also told the court that the police had, in 2017, arrested Lam Chang Nam, a former e-hailing driver, for allegedly blackmailing Koh's son, Jonathan. In 2018, Lam was subsequently charged for kidnapping Koh.
However, Supari told the court that his investigations indicated that Lam was not aware that Koh had been kidnapped.
'The instruction from the (Attorney-General's Chambers) was to file a charge under Section 365 of Penal Code (for kidnapping).
'Lam Chang Nam was acquitted at the end of the prosecution's case,' he added.
The hearing continues on May 28.

PUTRAJAYA, June 25 — The Malaysian Anti-Corruption Commission (MACC) today said the prosecution will challenge the Court of Appeal's decision to overturn Muar MP Syed Saddiq Syed Abdul Rahman's corruption conviction and sentence handed down by the High Court. MACC Chief Commissioner Tan Sri Azam Baki said the Deputy Public Prosecutor (DPP) in charge had informed him that there had been plans to take the case to the Federal Court regardless of today's outcome at the Court of Appeal. 'I was informed earlier by the prosecutor that they will be filing an appeal to the Federal Court,' he said in a press conference at MACC's headquarters here. 'The DPP informed me that if a different decision had been made, an appeal to the Federal Court would still have been pursued,' he added. When asked for his thoughts on the court's decision, Azam said he holds no personal feelings towards those involved in the cases he investigates. 'I do not feel disappointed or pleased when I investigate any case,' he said. Earlier today, Syed Saddiq was acquitted of four charges relating to the misappropriation of funds belonging to Bersatu's youth wing, Armada. A three-member Court of Appeal (CoA) panel led by Justice Datuk Ahmad Zaidi Ibrahim said the decision was unanimous. Delivering the court's decision, Justice Noorin said that High Court Judge Datuk Azhar Abdul Hamid had erred in several decisions, and that there was no element of dishonesty when the former Youth and Sports Minister instructed his staff to remove money from Armada's bank accounts. She said the trial judge did not take into account the procedures and contradictory evidence, and also took into account evidence given by witnesses under duress from MACC.

‘Tan Sri' accused of sukuk fund embezzlement converted RM11 million into digital currency, says MACC

PUTRAJAYA June 25 — The ongoing investigation into a 'Tan Sri' allegedly involved in the embezzlement of sukuk funds has revealed that millions were converted into digital currency, according to the Malaysian Anti-Corruption Commission (MACC). MACC Chief Commissioner Tan Sri Azam Baki said during a press conference that approximately RM11 million from the sukuk funds had been transferred into digital assets. 'The funds are believed to have been converted into digital currency for personal use. However, we are still tracing how the money was withdrawn and utilised. 'We suspect the money originated from the sukuk funds and was changed into digital currency. In fact, its use was not related to the MEX highway project. We also have documentation showing the currency exchange,' he said during the press conference at MACC headquarters today. Azam added that at least 10 more witnesses will be called to assist with the investigation. 'So far, statements have been recorded from 55 witnesses, and nine individuals have been arrested. A total of 14 personal accounts and eight company accounts have been frozen, involving RM156 million currently under investigation. 'We expect the investigation to be completed within the next two months, and any developments will be announced in due course,' he said. For now, Azam stated, there is no need to summon the individual with the 'Tan Sri' title again for questioning. When asked about the alleged use of the funds for gambling, Azam said the activity was believed to have occurred around the time the sukuk funds were disbursed. 'It may have been used in casinos, but I can't go into detail. I don't gamble myself, so I wouldn't know,' he said in jest. Previously, a prominent individual with the title 'Tan Sri' was among several people investigated by MACC over the alleged misappropriation of sukuk funds allocated for the MEX II highway construction project. MACC has reportedly seized a wide range of luxury assets estimated to be worth RM32 million, believed to belong to the highway concessionaire. The items include designer handbags, jewellery, high-end vehicles, luxury watches, cash, and a lavish residence. The investigation also uncovered premium alcoholic beverages valued at RM3 million and suggested that approximately RM20 million of the sukuk funds may have been spent on gambling activities. In addition to the domestic assets worth RM141 million already seized, MACC is currently tracing RM15 million worth of assets abroad linked to the case. The seized items include RM4.5 million in personal bank accounts, RM33 million in company accounts, luxury condominiums and land worth RM24.5 million, RM26 million in luxury watches, nine luxury cars valued at RM7.65 million, and jewellery and diamonds worth RM10 million. Other seized assets include RM6 million in designer handbags, gold bars, statues and gold coins worth RM3 million, and four horses estimated to be worth RM400,000.
