NYC funeral home company hit with another lawsuit over overseas burial mix-up

A second family is now suing a New York City funeral home company for what they call an unforgivable mix-up -- the wrong body being shipped out of the country for burial.
It was a shocking discovery for the family at the worst possible time. While mourning the death of the children's father, 39-year-old Elder Emilio Garcia, and watching his funeral in Guatemala via live stream, they saw the body in the casket wasn't him.
In his place was the body of a 96-year-old woman,
identified as Carmen Maldonado
.
The Rivera Funeral Home in Corona, Queens had sent the wrong body to Guatemala, where Garcia, a Queens waiter and father of four who died of a heart attack, was to be buried alongside his parents.
"It's completely irresponsible the way they have handled those bodies," said Leonor Valenta, Garcia's sister.
Valenta said to make matters worse, the funeral home seemed to have no idea where his body was.
"It was completely heartless. They were very stubborn with us. He never left the funeral home. He was there the whole time," Valenta said.
What's more, Maldonado's body was supposed to have been sent to Ecuador. Maldonado's family only found out she was mistakenly sent to Guatemala via a TikTok post.
Both families are now suing Bronx-based RG Ortiz Funeral Homes, which owns Rivera and other locations.
"The funeral home denied they made a mistake," said attorney Philip Rizzuto, who now represents both families. "I think the funeral home was hoping no one would find out about it, and they never would have told either family if this video didn't go viral."
The company was named in nearly 100 lawsuits and last year was cited by New York City for 82 violations.
The Department of Health, which oversees funeral homes, said its investigation is seeking fines and the potential revocation of licenses.
"They tortured the family. They didn't just fix it immediately," Rizzuto said. "They're taking advantage of them at their most vulnerable time of their lives."
"This was no mistake. It was negligence on their part and something that cannot be forgiven," Valenta said.
An attorney representing RG Ortiz Funeral Home said he had no comment on the series of complaints against the business. The Garcia family is seeking a jury trial, they say, to send a message.
It took 10 days for the mixed-up bodies to be properly buried in the correct countries.

A 17-year-old boy was shot — possibly by a Citi Bike-riding gunman — outside a Bronx housing development Thursday night, hours after two other boys his age were struck by gunfire in the borough, cops said. The teen was blasted in the hip as he walked on the grounds of NYCHA's Forest Houses on Trinity Avenue near East 165th Street in Longwood just before 10 p.m., police said. He was taken to Harlem Hospital, where he was listed in stable condition. The suspect fled southbound on Trinity Avenue, possibly on a Citi Bike, cops said. The violence came several hours after two 17-year-old boys — both apparent innocent bystanders — were shot and wounded around 1:20 p.m. at East 176th Street and Anthony Avenue in the Mount Hope neighborhood, police said. One of the teens was shot in the right arm, the other in the neck, police and sources said. Neither boy appeared to be the intended target of the shooter, but were struck in the crossfire, based on preliminary details, sources said. Both were taken to Columbia University Irving Medical Center, where they were listed in stable condition, police said. Neither victim has a criminal history, and they were shot from a distance, according to the sources. The 37-year-old mother of the boy struck in the arm, who declined to share her name, told The Post Friday that she is 'nerve-wrecked' by the violence. 'I'm grateful my son came home, I'm grateful my son is alive, he is functioning, no brain damage, he can walk, he can talk, he can still wipe his own butt,' she said. 'As far as we are concerned, we are blessed. 'I don't believe he or his friends have any enemies around here. It's not like there was a fight going on or any altercation going on.' Now, the still-stunned mom said she is planning on keeping her son in the safety of their home. 'From the looks of things, it doesn't seem like he is going to be outside,' she said. 'I feel like he is safer inside.' The troubling violence comes just days after NYPD Commissioner Jessica Tisch revealed that youth violence has skyrocketed in the Big Apple — and placed the blame on the state's contentious 'Raise the Age' law.

Bronx community marches in honor of Gun Violence Awareness Day after rash of shootings

Over the last few days, there have been multiple reports of gun violence in the Bronx. Hoping to make the violence stop, many went out into the community Friday, spreading the message on Gun Violence Awareness Day. "We're doing prevention, intervention, we're doing it all" Community members gathered to march for a purpose wearing bright orange shirts and chanting from the streets from La Central YMCA to St. Mary's Park in the Bronx. The march was in honor of National Gun Violence Awareness Day and to kick off Gun Violence Awareness month. Bronx District Attorney Darcel Clark hosted the march and a "Plant for Peace" to bed out flowers at St. Mary's Park. "Orange is the color for gun violence awareness. And we're planting on behalf of beautifying the park, but at the same time honoring those who lost their lives to gun violence," Clark said. "So every year now – those plants come back every year, they're perennials ... Every year we'll get to honor, you know, gun violence awareness as well as those lives that were lost." Clark expressed the march and planting for peace are just the beginning for the community to bloom in a new direction. "We have a strategy, where we're doing prevention, intervention, we're doing it all. But it's also something that communities can take ownership. They can say this is a gun violence free zone," she said. 5 shootings in the Bronx in 48 hours In the span of 48 hours, police responded to at least five shootings in the Bronx, leaving six people injured. Police say no arrests have been made in at least four of those five shootings. Police presence was evident throughout parts of the borough Friday evening. Several officers stood outside at least two locations where gun violence sent three teens to the hospital less than nine hours apart. On Thursday afternoon, surveillance video captured people running for cover as gunshots rang out on East 176th Street outside a grocery store. Police said two 17-year-olds were injured; one was shot in the neck and the other was shot in the right arm. Other recent victims of gun violence in the borough include a 17-year-old boy shot in the hip and a 15-year-old boy shot in the thigh.
