Quota sub-categorisation ensures marginalised get their share: CJI B R Gavai
NEW DELHI: Nearly a year after penning the seven-judge Supreme Court bench's majority view favouring sub-categorisation of Scheduled Caste quota, India's second Dalit CJI B R Gavai has said the ruling ensured that the most backward among Dalits got a fair share in public employment and admissions to govt educational institutions.
Speaking at the Oxford Union on 'From Representation to Realisation: Embodying the Constitution's Promise' on Tuesday night, CJI Gavai stepped into the rare zone of a judge explaining his judgment in public.
The seven-judge bench judgment, authored by Justice Gavai, had on Aug 1 last year permitted states to sub-categorise castes within SC communities based on socio-economic backwardness and the degree of under-representation in govt jobs to ensure that the larger pie of 15% quota went to the most backward.
The court had asked govts to devise suitable criteria to bar the 'creamy layer' among the SCs from availing reservation.
The logic behind the court's suggestion for keeping out the 'creamy layer' was that the children of civil servants and others from among the SCs, who had moved up on the socio-economic ladder and received good education, were not deserving of quotas.
In his speech, CJI Gavai said the apex court's decision to uphold the principle of sub-classification within quotas for SCs "was not to question the relevance or success of reservations, but to ensure that the most marginalised within marginalised groups receive their fair share".
He said many decades ago, millions of citizens of India were called untouchables, but the country had marched ahead and "here we are today, where a person belonging to those very (untouchable) people is speaking openly, as the holder of the highest office in the judiciary of the country".
"This is what the Constitution of India did. It told the people of India that they belong, that they can speak for themselves, and that they have an equal place in every sphere of society and power," he said, adding that it was possible because the prime architect of the Constitution, Dr B R Ambedkar, made inclusivity and equality the bedrock of constitutional values and guarantees.

'All the super specialty institutes approved in the Congress government were cancelled,' he alleged. In the education sector, he said, the Congress government built Central University Mahendragarh, 12 new government universities, 154 new polytechnic colleges, 56 new ITI and four new government engineering colleges were opened, besides Rajiv Gandhi Education Society was built in Sonipat. 'The foundation stone of Indian National Defense University was laid in Gurgaon, 2,623 new schools were built, one new Sainik School in Rewari and six new Kendriya Vidyalayas were built. Hooda said the Congress government also gave free plots of 100 yards each to four lakh poor families including SCs. He said the Congress also started the MNREGA's employment guarantee scheme. On the agriculture sector, Hooda said the then Congress government waived electricity bills of Rs 1,600 crores and loans of Rs 2,200 crores of farmers. 'Crop loan was provided to farmers at zero interest. MSP of wheat was increased by 126 per cent, MSP of paddy by 143 per cent. Sugarcane price was increased from Rs 117 to 310 (per quintal), the highest in the country then,' he said. 'In contrast, the biggest farmer movement (against now repealed central farm laws) in history happened during the BJP government's tenure in which 750 farmers died.' Still, they did nothing on MSP guarantee or delivered on their promise of doubling farmers' income, he said. Amid row, DU says it won't teach Manusmriti in any course
Delhi University (DU) on Thursday said it will not be teaching the Manusmriti in any of its courses, days after the university's faculty and students protested against the inclusion of the text as recommended reading for a paper of the Sanskrit Department. DU Vice-Chancellor Yogesh Singh told The Hindu, 'Our stand has been clear — that Manusmriti will not be taught in any course. Last year, it was suggested that Manusmriti be included in the law syllabus. Back then, too, we had removed it. This time, it had been introduced in the Sanskrit syllabus. As soon as it was brought to our notice, we have decided to remove it.' The university also posted a statement on X: ''Dharamshastra Studies', the DSC (Discipline Specific Core) of the Sanskrit Department, where Manusmriti is mentioned as a 'recommended reading' stands deleted.' Farmers Celebrate As Tamil Nadu Releases Mettur Water On Due Date
Chennai: Tamil Nadu Chief Minister MK Stalin released waters from the Mettur Dam today to irrigate the delta region. The water would help the Kuruvai crop across the 12 delta districts including Thanjavur, Nagapattinam and Tiruvarur, covering nearly 17.5 lakh acres. Initially, 3,000 cusecs of water was released, and the outflow will be gradually increased well above 10,000 cusecs. Following the early monsoon and recent heavy rains in the Cauvery catchment areas in Karnataka, the stored water in the Mettur dam stood at 114.62 feet at 8 am today.
