Judge denies defence's request to drop charges in Joshlin Smith trial

As the State closed its case in the Joshlin Smith matter on Wednesday morning, it is now time for the defence to bring forth its case.
Earlier, the State called Colonel Riaan Morris from the provincial Commercial Crimes Unit, who played six videos for the court.
The videos include Kelly Smith being filmed on Sunday, March 3, 2024, at an open prayer service being held for Joshlin.
The other videos also show Kelly having a meeting at the Spur with now Minister Gayton McKenzie.
Judge Nathan Erasmus dismissed the applications.

A few videos of the meeting with McKenzie are shown.
He was also provided with two links, which led to two videos of McKenzie, seated in the back of a vehicle, where he questions Steveno van Rhyn about his whereabouts and what happened to Joshlin.
As the State closed its case in the matter, Judge Nathan Erasmus was told that the defence counsel would bring forth Section 174 applications.
A Section 174 application, under South Africa's Criminal Procedure Act, allows an accused person to be discharged if the court believes there is no evidence to support a conviction at the close of the State's case.
Fanie Harmse, the legal representative for Jacquen 'Boeta' Appollis, chose not to bring forth an application.
Van Rhyn's lawyer, Nobuhle Mkabayi, brought forth an application.
'The defence will argue accused two has no case to answer. All state witnesses who testified didn't bring any evidence that this court can come to the conclusion that accused two has committed an offence. It will be unfair if the accused is only brought into the dock to supplement the State's case,' she submitted.
When Judge Erasmus mentions that State witness Laurentia Lombaard implicated van Rhyn, Mkabayi shot back, stating she was 'not credible'.
'Your client made a statement which I found admissible, that he admitted to being with when Joshlin was taken away, and he had gone back to find out what he's cut was,' Judge Erasmus said.
'I strongly submit there is no evidence,' Mkabayi submitted.
Kelly's lawyer, Rinesh Sivnarain, also brought forth an application to have charges discharged against his client.
'My submission case has not brought enough prima facie evidence against my client. In regards to human trafficking, only one witness, Laurentia Lombaard, and I submit that her evidence was of such poor quality that it should be rejected in its entirety,' he submitted.

Image: X Advocate Charles Mnisi, a prominent legal figure in the ongoing Senzo Meyiwa murder trial, has come under scrutiny after completing the 2025 Comrades Marathon, an 89-kilometre ultramarathon, with a finishing time of 10 hours, 42 minutes and four seconds. This comes as the State is expected to present fresh evidence in the decade-long case that has been plagued by delays. Mnisi's request was promptly denied by the presiding judge, Ratha Mokgoatlheng, who expressed visible frustration and alleged that similar requests may not be treated equally across racial lines The Black Lawyers Association (BLA) has called out Mokgoatlheng, claiming that he launched an unprecedented attack on black legal professionals. "The National Executive Committee of the BLA places it on record that we strongly reject the assertion made by Judge Mokgoatlheng that seeks to compare black and white lawyers in the carrying out of their duties, especially in court," said BLA secretary general, Takalani Chris Mamathuntsha. "What is indisputable is that black lawyers are extremely capable, excellent and high-level professionals." Mamathuntsha went on to say that the judge's remarks on black lawyers have frightened BLA members across the country. "We are extremely disappointed that this conduct by the judge is a repeat, as he did a similar act last year in June, for which he apologised. We further call on the JP of the division to reign in on this conduct and secure the sanctity of the court and the criminal justice system. "The trial at hand is for an icon of our sporting fraternity, admired by many countrywide and internationally. The family and society deserve justice and closure of this long-standing matter. The BLA stands side by side with society to demand justice for the late Senzo Meyiwa." Mnisi's participation in the iconic race, held on June 8, has reignited controversy over his commitment to the high-profile trial. Earlier last week, Mnisi submitted a request for the trial to be adjourned on Monday, June 9, citing the need to recover from the physically taxing event and to travel back. "I know this may affect the proceedings in the above-mentioned matter, but may I apologise in advance for the inconvenience to be occasioned by this request," he said in an email. Mokgoatlheng asked: "It's not even a letter; it is written in an email...I don't know what I must do because I've been told, 'I'm not coming to court on Monday; I'll be driving back'. What is this?" UNDER FIRE: Alleged kingpin Nafiz Modack Image: File Alleged underworld crime boss Nafiz Modack was found guilty of corruption charges at the Cape Town Regional court on Friday. The case was postponed to July 8 for Modack to be sentenced. The conviction comes in the wake of a sentence that was handed down to former top cop Brigadier Kolindren Govender after he entered into a plea agreement with the State after he admitted that he had a corrupt relationship with Modack. Hawks spokesperson Warrant Officer Zinzi Hani said: 'It was reported that during November 2011, Modack acted with a common purpose by paying gratification in a total amount of R146 000 to Govender in return for special treatment. 'He was also convicted of defeating the ends of justice by preventing his colleagues from performing their duties' Subsequently, Govender also admitted that during December 2012 he intervened and stopped the recovery by police of a Mercedes Benz. In doing so he prevented cooperation between an officer from the SAPS Paarl Vehicle Identification Section and the investigating officer in the matter based at the Cape Town Central police station. 'The former top cop Kolindren Govender pleaded guilty to 51 charges of corruption that relate to a corrupt relationship he had with alleged underworld figure Nafiz Modack. "Govender was handed five-years imprisonment of which four and a half years were suspended, on condition that he was not convicted of corruption.' The court ordered that the sentence would run concurrently with the six-year sentence that was handed down on a different matter. Meanwhile, the alleged underworld figure faces over 100 charges alongside fourteen other accused in the Charl Kinnear murder trial which has been placed on hold until October. Former Anti-Gang Unit detective top cop Kinnear was gunned down outside of his house in Bishop Lavis in September 2020. Modack has two other pending matters including the 'Tax Matter' where he was arrested by the Hawks in 2020 accused of defrauding SARS out of R46 million. His other matter at a High Court in Gauteng sees Modack facing firearm-related charges. Cape Times

FOUND: Relief as missing Comrades Marathon runner, Moira Harding is found

The local running community has breathed a collective sigh of relief after reports circulated that Moira Harding has been found. IOL reported that Harding vanished after completing the Comrades Marathon in Durban on Sunday. A family friend confirmed to IOL that Harding is from Kommetjie in Cape Town. At this stage, it is alleged Harding was spotted in the Point Waterfront area. Garrith Jamieson of ALS Paramedics confirmed that emergency teams are treating her. "She was found after a wide-scale search was initiated for her. Paramedics, police and Metro Police managed to locate the runner. She is in a critical condition and is being stabilised at the scene before she will be taken to hospital for further care," Jamieson said. *This is a developing story. IOL
