FSSAI bans use of '100%' on food labels, says term misleads consumers

The Food Safety and Standards Authority of India (FSSAI) has issued a strong advisory against the use of the term "100%" in food labelling, citing concerns over its potential to mislead consumers.
The apex food regulator, in a statement, said it has asked all Food Business Operators (FBOs) to refrain from using the term on food labels, packaging, and promotional content, owing to its ambiguity and potential for misinterpretation within the existing regulatory provisions.
In the advisory issued on Thursday, FSSAI highlighted a noticeable surge in the use of the term "100%" across food product labels and promotional platforms.
The Authority emphasised that such terminology is not only undefined under current regulations but also misleading and likely to create a false impression among consumers.
As per the Food Safety and Standards (Advertising and Claims) Regulations, 2018, the term "100%" is not defined or referenced in any manner under the FSS Act, 2006, or the Rules and Regulations made thereunder.
Furthermore, the Sub-regulation 10(7) of the aforementioned regulations strictly prohibits any advertisement or claim that undermines other manufacturers or influences consumer perception in a misleading manner.
As per Sub-regulation 4(1), it shall be ensured that the claims must be truthful, unambiguous, meaningful, not misleading and help consumers to comprehend the information provided.
The use of the term "100%"whether in isolation or combined with other descriptorsis likely to create a false impression of absolute purity or superiority, FSSAI said and added this could mislead consumers into believing that other comparable products in the market are inferior or non-compliant with regulatory standards.
In view of these concerns, all FBOs have been advised to not use the term "100%" on food product labels, packaging, and any form of promotional content. FSSAI said it remains committed to ensuring transparency and fairness in food labelling to protect consumer interests and promote informed choices.

SC stays contempt plea against Noida CEO in 2011 housing case
Noida: The Supreme Court has stayed contempt proceedings against Noida Authority CEO Lokesh M for alleged non-compliance with an Allahabad HC order over the sanction of building plans for developing a group housing society on a plot in Sector 45 in a decade-old case. The court has directed the CEO and the petitioners to explore an amicable solution. The contempt petition, filed against the CEO in the Lucknow bench of Allahabad High Court in April, stated that despite a high court order, dated Nov 22, 2024, directing the Authority to reconsider the building plan application submitted by the petitioners under the Building Regulations, 2010, the map was rejected on technical grounds on Dec 24 that year. The case dates to 2011, when petitioner Kapil Misra and another person, received a plot at Sadarpur in Sector 45 through an exchange deed. According to the petitioners, the state govt initiated the process to acquire their 10,870 sqm plot at Rohillapur village in Sector 132 in 2006 for development. The acquisition process was quashed in 2009 after the two had challenged it in court. The petitioners had again approached the court as Noida Authority did not return their plot. Subsequently, Noida Authority allotted them a plot in Sadarpur in 2011 following the court's direction. In April 2021, the petitioners sought permission to develop group housing on the Sector 45 land. However, the Authority did not give approval. Misra filed a writ petition in 2022, and the Allahabad HC directed the Authority to decide on his application within 45 days. When this order was not followed, Misra filed a contempt petition. In response, the Authority rejected their application in Sept 2023, citing non-compliance with the Building Regulations that require a lease deed for such approvals. A revision petition filed with the state govt was dismissed last April. The petitioners maintained that an exchange deed constituted a valid transfer document under the law, granting them full property rights, including construction. They claimed the Authority's interpretation of the regulations was overly restrictive and violated their constitutional rights under Article 300A. In rejecting Kapil Misra's building plan application, the Noida Authority cited three main reasons. First, the land was originally acquired by Noida Authority and was allotted for specific purposes as per the lease deed; building plans could only be approved under the 2010 Building by-laws if all required documents were submitted. Second, building permission was granted only after a lease deed was executed, confirming the applicant is an authorised allottee. Third, Misra submitted a deed of exchange instead of a lease deed, which was not a valid document under the 2010 regulations, rendering his application incomplete and ineligible for approval. The high court found these reasons insufficient. On Nov 22, 2024, justice Alok Mathur of the Allahabad HC's Lucknow bench held that the exchange deed was a valid transfer under the Transfer of Property Act and the UP Industrial Area Development Act, 1976. "We find no reason for the Authority not to consider the petitioners' application for building plan sanction. The reasons for rejection are clearly illegal and arbitrary," the court observed. It ordered the Authority to pass a fresh decision within four weeks of receiving the certified copy of the order. On Dec 24 last year, Noida Authority once again rejected the building plan application, citing technical grounds. This prompted Misra to file a contempt application against the CEO in April 2025. On May 28, the SC bench observed the matter warranted "an amicable resolution" and granted two months for discussions. The Supreme Court stayed further contempt proceedings and listed the matter for hearing on July 29.

"Will aggressively start our inspections on other e-commerce operators": Maharashtra FDA Commissioner on Zepto's license suspended in Dharavi
Mumbai (Maharashtra) [India], June 2 (ANI): Maharashtra Food and Drugs Administration (FDA) Commissioner Rajesh Narvekar said on Monday that some food articles of quick-commerce firm Zepto had fungus, and some products had also expired, for which their food business licence was suspended in the Dharavi area. Speaking to ANI, Narvekar emphasised that the department will now start its inspections on all other e-commerce operators too. 'They will be given an Improvement Notice. They have to fulfil all the parameters mentioned in the notice. Once they come back, we will reverify whether they stand clear on all the parameters. Their suspension will be removed if their performance is satisfactory. Otherwise, it will be continued till they improve their performance... We will aggressively start our inspections on all the other e-commerce operators,' the Maharashtra FDA Commissioner said. 'This action was taken because some food articles had fungus, water had accumulated in some places, the temperature for the food items was not maintained, and some products had also expired... Action has been taken because of these discrepancies,' Narvekar said. Based on information received from Minister of State for Food and Drug Administration, Yogesh Kadam, and under the guidance of Mangesh Mane, Joint Commissioner (Food), an inspection was conducted at the premises of Kiranakart Technologies Pvt. Ltd. (Zepto), located in Dharavi, Mumbai, by Food Safety Officer Ram Bodke, the Maharashtra FDA said in a statement. The inspection revealed serious non-compliance with the Food Safety and Standards Act, 2006 and the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011, it said. Key observations during the inspection included- Fungal growth observed on certain food articles; storage of products near clogged/stagnant water, indicating poor hygiene; cold storage temperatures not maintained as per regulatory standards; wet and filthy floors, with food items stored in a disorganised and unsanitary manner, including directly on the floor and expired food products found not clearly separated from non-expired stock. 'These findings constitute a failure to comply with the conditions of the license. Accordingly, Smt. Anupamaa Balasaheb Patil, Assistant Commissioner (Food), issued an order of immediate suspension under Section 32(3) of the Food Safety and Standards Act, 2006 and Regulation 2.1.8(4) of the Licensing and Registration Regulations, 2011,' FDA Maharashtra, Mumbai Division said in a statement. As per the statement, the suspension remains effective until the establishment achieves full compliance and receives approval from the licensing authority. Faced with the suspension order, Zepto released a statement and said they have already initiated an internal review and are working closely with the concerned authorities to ensure full and swift compliance. 'We are committed to rectifying the lapses identified and strengthening our processes to provide the best and safest quality of products to our consumers. We are taking all necessary corrective measures to resume operations in accordance with regulatory obligations and applicable laws as soon as possible. We have already initiated an internal review and are working closely with the concerned authorities to ensure full and swift compliance,' the Zepto statement read. (ANI)
