Can't allow high courts to exercise power under Article 142: SC

The Supreme Court on Tuesday dismissed a plea which sought the power of the top court under Article 142 of the Constitution to be granted to the high courts. Article 142 empowers the top court to pass "any decree or order necessary for doing complete justice in any case or matter pending before it" within the country.
A bench of Justices Abhay S Oka and Ujjal Bhuyan wondered how could it allow such a plea and said, "How can we grant such prayer? It requires an amendment to the Constitution. You go to Parliament. Prayer made in this petition is completely misconceived. Power conferred under Article 142 of the Constitution is only on this court and not the high courts. Therefore, we cannot allow high court to exercise power of this court under Article 142."

Supreme Court(File photo) NEW DELHI: SC on Monday turned down Tamil Nadu govt's plea for urgent listing of its suit against the Centre for the release of over Rs 2,291 crore under the Samagra Shiksha Scheme (SSS). Appearing before a bench of Justices Prashant Kumar Mishra and Justice Manmohan, senior advocate P Wilson pleaded that there was urgency in the case and the state should be granting hearing during the vacation. The bench, however, said that there was no urgency and the suit could be listed for hearing in due course. The state sought early hearing alleging that lack of funds was depriving the Right to Education to nearly 48 lakh students and the new academic year had already started on June 3. Tamil Nadu govt filed the original suit under Article 131 of the Constitution, alleging that Union govt was withholding funds under SSS over the non-implementation of the National Education Policy 2020.

Bainsla successfully pressured the BJP-led state govt by threatening a major stir if the demand for 5% reservation for Most Backward Classes (MBC) was not included in the Ninth Schedule of the Constitution. While the govt appeared to soften its stance under pressure, the party leadership neither condemned nor commented on Bainsla's confrontational posture. This move was interpreted by political observers as a crack in the BJP's disciplinary framework. Bainsla, who contested and lost the 2023 Assembly elections from Deoli-Uniara to Congress candidate Harish Meena, was reportedly sidelined within the party since then. Party insiders say he was not given space to raise community demands and was denied a ticket in the Deoli-Uniara bypolls in Nov 2024, fuelling his frustration and pushing him to take an aggressive stance to regain his position in the community. "Being the son of the late Kirori Singh Bainsla, a towering figure in the Gurjar movement, he carries significant influence. During Congress leader Rahul Gandhi's Bharat Jodo Yatra, Bainsla's threat to oppose the march forced the Congress into damage control, resulting in formation of a four-member cabinet committee.
